3131 CATIONS FOR TERRORIST ACTIVITY. 3
3232 It is the sense of Congress that— 4
3333 (1) the heightened terrorism threat landscape 5
3434 and the increasing utilization of generative artificial 6
3535 intelligence applications by terrorist organizations 7
3636 represent a national security threat, and the chal-8
3737 lenges posed by such threat are not well understood; 9
3838 and 10
3939 (2) the Department of Homeland Security, in 11
4040 consultation with the Office of the Director of Na-12
4141 tional Intelligence, must take steps to recognize, as-13
4242 sess, and address such threat, thereby reducing risks 14
4343 to the people of the United States. 15
4444 SEC. 3. ANNUAL ASSESSMENTS ON TERRORISM THREATS 16

4949 (a) A
5050 SSESSMENTS.— 21
5151 (1) I
5252 N GENERAL.—Not later than 180 days 22
5353 after the date of the enactment of this Act and an-23
5454 nually thereafter for five years, the Secretary of 24
5555 Homeland Security, in consultation with the Direc-25
5656 tor of National Intelligence, shall submit to the ap-26

6161 terrorism threats to the United States posed by ter-2
6262 rorist organizations utilizing generative artificial in-3

6565 ONTENTS.—Each terrorism threat assess-5
6666 ment under paragraph (1) shall include the fol-6
6767 lowing: 7
6868 (A) An analysis of incidents during the im-8
6969 mediately preceding calendar year in which ter-9
7070 rorist organizations have utilized or attempted 10
7171 to utilize generative artificial intelligence appli-11
7272 cations to carry out the following: 12
7373 (i) Spread violent extremist messaging 13
7474 and facilitate the ability to radicalize and 14
7575 recruit individuals to violence. 15
7676 (ii) Enhance their ability to develop or 16
7777 deploy chemical, biological, radiological, or 17
7878 nuclear weapons. 18
7979 (B) Recommendations on appropriate 19
8080 measures to counter terrorism threats to the 20
8181 United States posed by such terrorist organiza-21
8282 tions. 22

8484 OORDINATION.—Each terrorism threat as-23
8585 sessment under paragraph (1)— 24

8989 (A) shall be coordinated with the Office of 1
9090 the General Counsel, the Privacy Office, and 2
9191 the Office of for Civil Rights and Civil Liberties 3
9292 of the Department of Homeland Security prior 4
9393 to release outside the Department to ensure 5
9494 each such assessment complies with applicable 6
9595 law and protects individuals’ privacy, civil 7
9696 rights, and civil liberties, and 8
9797 (B) may be informed by existing products, 9

100100 ORM.—Each terrorism threat assessment 11
101101 under paragraph (1) shall be submitted in unclassi-12
102102 fied form, but may include a classified annex only 13
103103 for the protection of intelligence sources and meth-14
104104 ods relating to the matters contained in such assess-15
105105 ment. The Secretary of Homeland Security shall 16
106106 post on a publicly available website of the Depart-17
107107 ment of Homeland Security the unclassified portion 18
108108 of each such assessment. 19

110110 RIEFING.—Not later than 30 days after 20
111111 the submission of each terrorism threat assessment 21
112112 under paragraph (1), the Secretary of Homeland Se-22
113113 curity shall brief the appropriate congressional com-23
114114 mittees regarding each such assessment. The head 24
115115 of any other relevant Federal department or agency 25

120120 such committee, in consultation with the Secretary, 2
121121 determines such is appropriate. 3

123123 PPROPRIATE CONGRESSIONAL COMMIT -4
124124 TEES.—In this subsection, the term ‘‘appropriate 5
125125 congressional committees’’ means the Committee on 6
126126 Homeland Security, the Permanent Select Com-7
127127 mittee on Intelligence, and the Committee on En-8
128128 ergy and Commerce of the House of Representatives 9
129129 and the Committee on Homeland Security and Gov-10
130130 ernmental Affairs, the Select Committee on Intel-11
131131 ligence, and the Committee on Commerce, Science, 12
132132 and Transportation of the Senate. 13
133133 (b) I
134134 NFORMATION SHARING.—The Secretary of 14
135135 Homeland Security shall review information relating to 15
136136 terrorism threats to the United States posed by terrorist 16
137137 organizations utilizing generative artificial intelligence ap-17
138138 plications that is gathered by State and local fusion cen-18
139139 ters and the National Network of Fusion Centers, and in-19
140140 corporate such information, as appropriate, into the De-20
141141 partment of Homeland Security’s own information relat-21
142142 ing to such. The Secretary shall ensure the dissemination 22
143143 to State and local fusion centers and the National Net-23
144144 work of Fusion Centers of such information. 24

146146 EFINITIONS.—In this section: 25

151151 APPLICATIONS.—The term ‘‘generative artificial in-2
152152 telligence applications’’ means the class of artificial 3
153153 intelligence models that emulate the structure and 4
154154 characteristics of input data in order to generate de-5
155155 rived synthetic content, including images, videos, 6
156156 audio, text, and other digital content. 7

158158 USION CENTER.—The term ‘‘fusion cen-8
159159 ter’’ has the meaning given such term in subsection 9
160160 (k) of section 210A of the Homeland Security Act 10
161161 of 2002 (6 U.S.C. 124h). 11

163163 ATIONAL NETWORK OF FUSION CEN -12
164164 TERS.—The term ‘‘National Network of Fusion Cen-13
165165 ters’’ means a decentralized arrangement of fusion 14
166166 centers intended to enhance the ability of individual 15
167167 State and local fusion centers to leverage the capa-16
168168 bilities and expertise of all such fusion centers for 17
169169 the purpose of enhancing analysis and homeland se-18
170170 curity information sharing nationally. 19

172172 ERRORIST ORGANIZATION .—The term 20
173173 ‘‘terrorist organization’’ means— 21
174174 (A) any entity designated as a foreign ter-22
175175 rorist organization pursuant to section 219 of 23
176176 the Immigration and Nationality Act (8 U.S.C. 24
177177 1189); or 25
