18	18	To amend the Immigration and Nationality Act to provide
19	19	that aliens who have been convicted of or who have
20	20	committed Social Security fraud are inadmissible and
21	21	deportable.
22	22	Be it enacted by the Senate and House of Representa-1
23	23	tives of the United States of America in Congress assembled, 2
24	24	SECTION 1. SHORT TITLE. 3
25	25	This Act may be cited as the ‘‘Consequences for So-4
26	26	cial Security Fraud Act’’. 5

31	31	TO SOCIAL SECURITY FRAUD OR IDENTIFICA-2
32	32	TION DOCUMENT FRAUD. 3
33	33	(a) I
34	34	NADMISSIBILITY.—Section 212(a)(2) of the Im-4
35	35	migration and Nationality Act (8 U.S.C. 1182(a)(2)) is 5
36	36	amended by adding at the end the following: 6
37	37	‘‘(J) S
38	38	OCIAL SECURITY FRAUD OR IDENTI -7
39	39	FICATION DOCUMENT FRAUD .— 8
40	40	‘‘(i) I
41	41	N GENERAL.—Any alien who has 9
42	42	been convicted of, who admits having com-10
43	43	mitted, or who admits committing acts 11
44	44	which constitute the essential elements of a 12
45	45	covered COVID offense, an offense under 13
46	46	section 208 of the Social Security Act (42 14
47	47	U.S.C. 408) (relating to social security ac-15
48	48	count numbers or social security cards), an 16
49	49	offense under section 1028 of title 18, 17
50	50	United States Code (relating to fraud and 18
51	51	related activity in connection with identi-19
52	52	fication documents, authentication fea-20
53	53	tures, and information), or a conspiracy to 21
54	54	commit such an offense, is inadmissible. 22
55	55	‘‘(ii) C
56	56	OVERED COVID OFFENSE .—For 23
57	57	purposes of this subparagraph, the term 24
58	58	‘covered COVID offense’ means an offense 25
59	59	of fraud pertaining to— 26

64	64	‘‘(aa) paragraph (36) or 2
65	65	(37) of subsection (a) of section 3
66	66	7 of the Small Business Act (15 4
67	67	U.S.C. 636); or 5
68	68	‘‘(bb) subsection (b) of such 6
69	69	section in response to the 7
70	70	COVID–19 pandemic; or 8
71	71	‘‘(II) a grant made under— 9
72	72	‘‘(aa) section 5003 of the 10
73	73	American Rescue Plan Act of 11
74	74	2021 (15 U.S.C. 9009c); or 12
75	75	‘‘(bb) section 324 of the 13
76	76	Economic Aid to Hard-Hit Small 14
77	77	Businesses, Nonprofits, and 15
78	78	Venues Act (15 U.S.C. 9009a).’’. 16

80	80	EPORTABILITY.—Section 237(a)(2) of the Im-17
81	81	migration and Nationality Act (8 U.S.C. 1227(a)(2)) is 18
82	82	amended by adding at the end the following: 19

85	85	FICATION DOCUMENT FRAUD .—Any alien who 21
86	86	has been convicted of, who admits having com-22
87	87	mitted, or who admits committing acts which 23

89	89	COVID offense (as such term is defined in sec-25
