2121 Be it enacted by the Senate and House of Representa-1
2222 tives of the United States of America in Congress assembled, 2
2323 SECTION 1. SHORT TITLE. 3
2424 This Act may be cited as the ‘‘Undertaking Negotia-4
2525 tions on Investment and Trade for Economic Dynamism 5
2626 Act’’ or the ‘‘UNITED Act’’. 6
2727 SEC. 2. SENSE OF CONGRESS. 7
2828 It is the sense of Congress that— 8

3434 strengthen the economy of the United States, im-3
3535 prove the standard of living of the people of the 4
3636 United States, and advance the strategic interests of 5
3737 the United States; 6
3838 (2) agreements to reduce or eliminate barriers 7
3939 to trade and investment between the United States 8
4040 and its allies will foster mutually beneficial economic 9
4141 relationships that advance the economic interests of 10
4242 workers, farmers, ranchers, and businesses of all 11
4343 sizes in the United States; 12
4444 (3) the shared values and long history of the 13
4545 ‘‘special relationship’’ between the United States and 14
4646 the United Kingdom present a unique opportunity to 15
4747 deepen the mutually beneficial economic and stra-16
4848 tegic relationship between those countries and fur-17
4949 ther expand prosperity for the citizens of those coun-18
5050 tries; 19
5151 (4) a high-standard, comprehensive trade agree-20
5252 ment between the United States and the United 21
5353 Kingdom would help strengthen that relationship, 22
5454 improve the economic prospects of people in both 23
5555 countries, increase the resilience of critical supply 24
5656 chains, support collaboration in emerging tech-25

6363 Kingdom Trade and Investment Working Group and 4
6464 the bilateral negotiations initiated by President Don-5
6565 ald Trump have laid groundwork toward a com-6
6666 prehensive trade agreement; 7
6767 (6) the United States-United Kingdom Dia-8
6868 logue on the Future of Atlantic Trade, initiated by 9
6969 President Joe Biden, along with the signing of the 10
7070 Atlantic Declaration for a Twenty-First Century 11
7171 U.S.-U.K. Economic Partnership, continues long-12
7272 standing efforts to improve economic cooperation be-13
7373 tween the United States and the United Kingdom; 14
7474 (7) the robust labor and environmental protec-15
7575 tions in the United Kingdom reduce the risk of regu-16
7676 latory arbitrage that undercuts workers and busi-17
7777 nesses in the United States; 18
7878 (8) Congress passed the Agreement between the 19
7979 United States of America, the United Mexican 20
8080 States, and Canada (USMCA) with overwhelming bi-21
8181 partisan support, setting high standards in North 22
8282 America with respect to labor rights, the environ-23
8383 ment, intellectual property, non-market practices, 24

8888 ture negotiations; 2
8989 (9) trade agreements with foreign trading part-3
9090 ners that share the values and ambition of the 4
9191 United States offer an opportunity to build on the 5
9292 USMCA and set high international standards across 6
9393 many important policy areas; 7
9494 (10) any trade negotiations between the United 8
9595 States and the United Kingdom must honor the 9
9696 agreement between the Government of Ireland and 10
9797 the Government of the United Kingdom signed on 11
9898 April 10, 1998 (commonly known as the ‘‘Good Fri-12
9999 day Agreement’’), and any trade agreement between 13
100100 those countries must advance peace, stability, and 14
101101 prosperity in Ireland and Northern Ireland; 15
102102 (11) the United Kingdom, like many key trad-16
103103 ing partners of the United States, is actively negoti-17
104104 ating for expanded access to foreign markets and 18
105105 the United States must likewise seek to advance its 19
106106 access to foreign markets to ensure that businesses, 20
107107 consumers, farmers, ranchers, and workers in the 21
108108 United States are not left behind; and 22
109109 (12) to effectively pursue comprehensive trade 23
110110 negotiations with the United Kingdom for purposes 24
111111 of a trade agreement between the United States and 25

116116 gotiating authority to the President, which should— 2
117117 (A) enable the swift negotiation and pas-3
118118 sage through Congress of such an agreement; 4
119119 and 5
120120 (B) be narrowly tailored to provide clear 6
121121 direction to the executive branch of the United 7
122122 States Government. 8
123123 SEC. 3. NEGOTIATING AND TRADE AGREEMENTS AUTHOR-9
124124 ITY FOR COMPREHENSIVE AGREEMENT WITH 10
125125 THE UNITED KINGDOM. 11

127127 NITIATION OFNEGOTIATIONS.—Not later than 12
128128 180 days after the date of the enactment of this Act, in 13
129129 order to enhance the economic well-being of the United 14
130130 States, the President shall seek to initiate negotiations 15
131131 with the United Kingdom regarding tariff and nontariff 16
132132 barriers affecting any industry, product, or service sector. 17

134134 UTHORITY FOR COMPREHENSIVE TRADE 18

136136 GREEMENTWITH THEUNITEDKINGDOM.— 19

138138 N GENERAL.—To strengthen the economic 20
139139 competitiveness of the United States, the President 21
140140 may enter into a comprehensive trade agreement 22
141141 with the United Kingdom regarding tariff and non-23
142142 tariff barriers affecting trade between the United 24
143143 States and United Kingdom. 25

155155 continuance of any existing duty, continuance of ex-7
156156 isting duty-free or excise treatment, or such addi-8
157157 tional duties as the President determines to be re-9
158158 quired or appropriate to carry out an agreement en-10
159159 tered into under subsection (b). 11

163163 ODIFICATIONS OR ADDITIONS TO 13
164164 AGREEMENT.—Substantial modifications to, or 14
165165 substantial additional provisions of, an agree-15
166166 ment entered into after March 1, 2029, are not 16
167167 covered by the authority under paragraph (1). 17

169169 MOUNT OF DUTY MODIFICATION .— 18
170170 No proclamation may be made under paragraph 19
171171 (1) that— 20
172172 (i) reduces any rate of duty (other 21
173173 than a rate of duty that does not exceed 5 22
174174 percent ad valorem on the date of the en-23
175175 actment of this Act) to a rate of duty that 24
176176 is less than 50 percent of the rate of such 25

183183 that applicable under the Uruguay Round 4
184184 Agreements (as defined in section 2(7) of 5

186186 U.S.C. 3501)) or a successor agreement, 7
187187 on any import sensitive agricultural prod-8
188188 uct; or 9
189189 (iii) increases any rate of duty above 10
190190 the rate that applied on the date of the en-11
191191 actment of this Act. 12

195195 ONGRESS.—To ensure the alignment of the trade policy 14
196196 priorities of Congress with the content of any agreement 15
197197 under this section, the President shall consult with Con-16
198198 gress before and throughout negotiations initiated under 17
199199 subsection (a) and shall notify Congress of the intention 18
200200 of the President to enter into an agreement under sub-19
201201 section (b) or to make a proclamation under subsection 20
202202 (c). 21

212212 (A) IN GENERAL.—The provisions of sec-1
213213 tion 151 of the Trade Act of 1974 (19 U.S.C. 2
214214 2191) apply to a bill of either House of Con-3
215215 gress that contains provisions described in sub-4
216216 paragraph (B) to the same extent as such sec-5
217217 tion 151 applies to implementing bills under 6
218218 that section. A bill to which this paragraph ap-7
219219 plies shall hereafter in this section be referred 8
220220 to as an ‘‘implementing bill’’. 9

222222 ROVISIONS SPECIFIED.—The provi-10
223223 sions described in this subparagraph are— 11
224224 (i) a provision approving a trade 12
225225 agreement entered into under this section 13
226226 and approving the statement of adminis-14
227227 trative action, if any, proposed to imple-15
228228 ment such trade agreement; and 16
229229 (ii) if changes in existing laws or new 17
230230 statutory authority are required to imple-18
231231 ment such trade agreement, only such pro-19
232232 visions as are strictly necessary or appro-20
233233 priate to implement such trade agreement, 21
234234 either repealing or amending existing laws 22
235235 or providing new statutory authority. 23

237237 EADLINE FOR SUBMISSION OF BILL .—The 24
238238 procedures under paragraph (1) apply to imple-25

243243 agreement entered into under this section before 2

246246 IMITATION ONWAIVER, SUSPENSION, ORTER-4
247247 MINATION.—An agreement entered into under this section 5
248248 shall not be waived, suspended, or terminated, in whole 6
249249 or in part, with respect to the United States without the 7
250250 express approval by Congress of such termination. 8

254254 RADEPRIORITIES AND ACCOUNTABILITY ACT OF 10
255255 2015.—An agreement under this section shall not enter 11
256256 into force with respect to the United States and an imple-12
257257 menting bill shall not qualify for trade authorities proce-13
258258 dures under subsection (e), including an agreement that 14
259259 does not require changes to United States law or an imple-15
260260 menting bill in connection therewith, unless the following 16
261261 requirements under the Bipartisan Congressional Trade 17
262262 Priorities and Accountability Act of 2015 (19 U.S.C. 4201 18
263263 et seq.) are carried out with respect to that agreement 19
264264 or implementing bill to the same extent as would be re-20
265265 quired of an agreement entered into under section 103(b) 21
266266 of that Act (19 U.S.C. 4202(b)), notwithstanding the expi-22
267267 ration of authority to enter into an agreement under such 23
268268 section 103(b): 24
