1818 This Act may be cited as the ‘‘Break the Chain Act’’. 4
1919 SEC. 2. FAMILY-SPONSORED IMMIGRATION PRIORITIES. 5

4646 ‘‘(2) The number computed under this paragraph for 17
4747 a fiscal year is the number of aliens who were paroled into 18
4848 the United States under section 212(d)(5) in the second 19
4949 preceding fiscal year who— 20
5050 ‘‘(A) did not depart from the United States 21
5151 (without advance parole) within 365 days; and 22
5252 ‘‘(B)(i) did not acquire the status of an alien 23
5353 lawfully admitted to the United States for perma-24

213213 ‘‘(s)(1) The initial period of authorized admission for 6
214214 a nonimmigrant described in section 101(a)(15)(W) shall 7
215215 be 5 years, but may be extended by the Secretary of 8
216216 Homeland Security for additional 5-year periods if the 9
217217 United States citizen son or daughter of the nonimmigrant 10
218218 is still residing in the United States. 11
219219 ‘‘(2) A nonimmigrant described in section 12
220220 101(a)(15)(W)— 13
221221 ‘‘(A) is not authorized to be employed in the 14
222222 United States; and 15
223223 ‘‘(B) is not eligible for any Federal, State, or 16
224224 local public benefit. 17
225225 ‘‘(3) The United States citizen son or daughter shall 18
226226 file a petition with the Secretary of Homeland Security 19
227227 on behalf of the alien parent in order for the alien parent 20
228228 to be issued a visa or otherwise be provided nonimmigrant 21
229229 status under section 101(a)(15)(W). 22
230230 ‘‘(4) An alien is ineligible to be issued a visa or other-23
231231 wise be provided nonimmigrant status under section 24
232232 101(a)(15)(W), or to be admitted into the United States 25

314314 petition under section 204 of the Immigration 14
315315 and Nationality Act (8 U.S.C. 1154) pending 15
316316 as of the date of enactment of this Act seeking 16
317317 classification of an alien under section 17
318318 201(b)(2)(A)(i) with respect to a parent of a 18
319319 United States citizen, or under section 19
320320 203(a)(1), (2)(B), (3), or (4) of such Act (8 20
321321 U.S.C. 1151(b)(2)(A)(i), 1153(a)(1), (2)(B), 21
322322 (3), or (4)). Any application for adjustment of 22
323323 status or an immigrant visa based on such a 23
324324 petition shall be invalid. 24

332332 amendments made by this section, an alien with 4
333333 regard to whom a petition or application for 5
334334 status under paragraph (1), (2)(B), (3), or (4) 6
335335 of section 203(a) of the Immigration and Na-7
336336 tionality Act (8 U.S.C. 1153(a)), as in effect on 8
337337 September 30, 2020, was approved prior to the 9
338338 date of the enactment of this Act, may be 10
339339 issued a visa pursuant to that paragraph in ac-11
340340 cordance with the availability of visas under 12
341341 subparagraph (B). 13
342342 (B) A
343343 VAILABILITY OF VISAS.—Visas may 14
344344 be issued to beneficiaries of approved petitions 15
345345 under each category described in subparagraph 16
346346 (A), but only until such time as the number of 17
347347 visas that would have been allocated to that 18
348348 category in fiscal year 2025, notwithstanding 19
349349 the amendments made by this section, have 20
350350 been issued. When the number of visas de-21
351351 scribed in the previous sentence have been 22
352352 issued for each category described in subpara-23
