2121 This Act may be cited as the ‘‘Eliminating the Mar-4
2222 riage Penalty in SSI Act’’ or the ‘‘EMPSA Act’’. 5

2828 LIGIBILITY FORBENEFITS.—Section 1611(a) of 2
2929 the Social Security Act (42 U.S.C. 1382(a)) is amended 3
3030 by adding at the end the following: 4
3131 ‘‘(4) Notwithstanding paragraphs (1) and (2) of this 5
3232 subsection, each individual who has attained 18 years of 6
3333 age, who is diagnosed with an intellectual or develop-7
3434 mental disability, whose income, other than income ex-8
3535 cluded pursuant to section 1612(b), is at not more than 9
3636 the rate in effect for purposes of paragraph (1)(A) of this 10
3737 subsection, and whose resources, other than resources ex-11
3838 cluded pursuant to section 1613(a), are not more than the 12
3939 applicable amount in effect for purposes of paragraph 13
4040 (3)(B) of this subsection, shall be an eligible individual 14
4141 for purposes of this title.’’. 15
4242 (b) A
4343 MOUNT OFBENEFIT.—Section 1611(b) of such 16
4444 Act (42 U.S.C. 1382(b)) is amended by adding at the end 17
4545 the following: 18
4646 ‘‘(3) Notwithstanding paragraphs (1) and (2) of this 19
4747 subsection, the benefit under this title for an individual 20
4848 described in subsection (a)(4) of this section, whether or 21
4949 not the individual has an eligible spouse, shall be payable 22
5050 at the rate in effect for purposes of such paragraph (1), 23
5151 reduced by the amount of income, not excluded pursuant 24
5252 to section 1612(b), of the individual.’’. 25

6161 amount of, benefits for an individual described in section 6
6262 1611(a)(4) who is married, the income and resources of 7
6363 the individual is deemed to not include any income or re-8
6464 sources of the spouse.’’. 9
