18	18	Be it enacted by the Senate and House of Representa-1
19	19	tives of the United States of America in Congress assembled, 2
20	20	SECTION 1. SHORT TITLE. 3
21	21	This Act may be cited as the ‘‘NTIA Policy and Cy-4
22	22	bersecurity Coordination Act’’. 5
23	23	SEC. 2. POLICY DEVELOPMENT AND CYBERSECURITY. 6

33	33	‘‘SEC. 106. OFFICE OF POLICY DEVELOPMENT AND CYBER-4
34	34	SECURITY. 5
35	35	‘‘(a) E
36	36	STABLISHMENT.—There shall be within the 6
37	37	NTIA an office to be known as the Office of Policy Devel-7
38	38	opment and Cybersecurity (in this section referred to as 8
39	39	the ‘Office’). 9
40	40	‘‘(b) A
41	41	SSOCIATEADMINISTRATOR.—The head of the 10
42	42	Office shall be an Associate Administrator for Policy De-11
43	43	velopment and Cybersecurity (in this section referred to 12
44	44	as the ‘Associate Administrator’), who shall report to the 13
45	45	Assistant Secretary. 14
46	46	‘‘(c) D
47	47	UTIES.— 15
48	48	‘‘(1) I
49	49	N GENERAL.—The Associate Adminis-16
50	50	trator shall oversee and conduct national commu-17
51	51	nications and information policy analysis and devel-18
52	52	opment for the internet and communications tech-19
53	53	nologies. 20

55	55	ARTICULAR DUTIES .—In carrying out 21
56	56	paragraph (1), the Associate Administrator shall— 22
57	57	‘‘(A) develop, analyze, and advocate for 23
58	58	market-based policies that promote innovation, 24
59	59	competition, consumer access, digital inclusion, 25

64	64	the communications, media, and technology 2

66	66	‘‘(B) conduct studies, as delegated by the 4
67	67	Assistant Secretary or required by Congress, on 5
68	68	how individuals in the United States access and 6
69	69	use the internet, wireline and wireless teleph-7
70	70	ony, mass media, other digital services, and 8
71	71	video services; 9
72	72	‘‘(C) coordinate transparent, consensus- 10
73	73	based, multistakeholder processes to create 11
74	74	guidance for and to support the development 12
75	75	and implementation of cybersecurity and pri-13
76	76	vacy policies with respect to the internet and 14
77	77	other communications networks; 15
78	78	‘‘(D) promote increased collaboration be-16
79	79	tween security researchers and providers of 17
80	80	communications services and software system 18
81	81	developers; 19
82	82	‘‘(E) perform such duties as the Assistant 20
83	83	Secretary considers appropriate relating to the 21
84	84	program for preventing future vulnerabilities es-22
85	85	tablished under section 8(a) of the Secure and 23
86	86	Trusted Communications Networks Act of 2019 24

92	92	security and resilience to cybersecurity incidents 2
93	93	of communications networks while fostering in-3
94	94	novation, including policies that promote secure 4
95	95	communications network supply chains; 5
96	96	‘‘(G) at the direction of the Assistant Sec-6
97	97	retary, present security of the digital economy 7
98	98	and infrastructure and cybersecurity policy ef-8
99	99	forts before the Commission, Congress, and 9
100	100	elsewhere; 10
101	101	‘‘(H) provide advice and assistance to the 11
102	102	Assistant Secretary in carrying out the policy 12
103	103	responsibilities of the NTIA with respect to cy-13
104	104	bersecurity policy matters, including the evalua-14
105	105	tion of the impact of cybersecurity matters 15
106	106	pending before the Commission, other Federal 16
107	107	agencies, and Congress; 17
108	108	‘‘(I) in addition to the duties described in 18
109	109	subparagraph (H), perform such other duties 19
110	110	regarding the policy responsibilities of the 20
111	111	NTIA with respect to cybersecurity policy mat-21
112	112	ters as the Assistant Secretary considers appro-22
113	113	priate; 23
114	114	‘‘(J) develop policies to accelerate innova-24
115	115	tion and commercialization with respect to ad-25

126	126	‘‘(L) provide public access to relevant data, 8
127	127	research, and technical assistance on innovation 9
128	128	and commercialization with respect to commu-10
129	129	nications technologies, consistent with the pro-11
130	130	tection of classified information; 12
131	131	‘‘(M) strengthen collaboration on and co-13
132	132	ordination of policies relating to innovation and 14
133	133	commercialization with respect to communica-15
134	134	tions technologies, including policies focused on 16
135	135	the needs of small businesses and rural commu-17
136	136	nities— 18
137	137	‘‘(i) within the Department of Com-19
138	138	merce; 20
139	139	‘‘(ii) between the Department of Com-21
140	140	merce and State government agencies, as 22
141	141	appropriate; and 23
142	142	‘‘(iii) between the Department of 24
143	143	Commerce and the Commission or any 25

158	158	EDESIGNATION.—The position of As-9
159	159	sociate Administrator for Policy Analysis and 10
160	160	Development at the NTIA is hereby redesig-11
161	161	nated as the position of Associate Adminis-12
162	162	trator for Policy Development and Cybersecu-13
163	163	rity. 14

165	165	ONTINUATION OF SERVICE .—The in-15
166	166	dividual serving as Associate Administrator for 16
167	167	Policy Analysis and Development at the NTIA 17
168	168	on the date of the enactment of this Act shall 18
169	169	become, as of such date, the Associate Adminis-19
170	170	trator for Policy Development and Cybersecu-20
171	171	rity. 21

173	173	DEFINED.—In this subsection, the 22
174	174	term ‘‘NTIA’’ means the National Telecommuni-23
175	175	cations and Information Administration. 24
