3131 mission shall promulgate, under section 553 of title 5, 2
3232 United States Code, a final consumer product safety 3
3333 standard for fixed and freestanding retractable awnings 4
3434 within the jurisdiction of the Commission to protect 5
3535 against the risk of death or serious injury related to the 6
3636 hazards associated with such awnings, including the risk 7
3737 of death or serious injury related to the awning unexpect-8
3838 edly opening and striking a person while removing the 9
3939 bungee tie-downs for the cover of the awning. 10

4141 ETERMINATION OF SCOPE.—The Con-11
4242 sumer Product Safety Commission shall specify the types 12
4343 of retractable awning devices within the jurisdiction of the 13
4444 Commission that are within the scope of subsection (a) 14
4545 as part of a standard promulgated under this section, as 15
4646 reasonably necessary to protect against hazards associated 16
4747 with retractable awnings. 17

4949 REATMENT OF STANDARD.—A consumer prod-18
5050 uct safety standard promulgated under subsection (a) 19
5151 shall be treated as a consumer product safety rule promul-20
5252 gated under sections 7 and 9 of the Consumer Product 21
5353 Safety Act (15 U.S.C. 2056 and 2058). 22
