2525 This Act may be cited as the ‘‘Keep America’s Water-4

3131 The Coastal Zone Management Act of 1972 (16 2
3232 U.S.C. 1451 et seq.) is amended by inserting after section 3
3333 306A (16 U.S.C. 1455a) the following: 4
3434 ‘‘SEC. 306B. WORKING WATERFRONTS. 5
3535 ‘‘(a) T
3636 ASKFORCE.— 6
3737 ‘‘(1) I
3838 N GENERAL.—The Secretary shall estab-7
3939 lish a task force to work directly with covered enti-8
4040 ties, users of working waterfronts, and coastal stake-9
4141 holders to identify and address critical needs with 10
4242 respect to working waterfronts. 11
4343 ‘‘(2) M
4444 EMBERSHIP.—The Secretary shall ap-12
4545 point members of the Task Force, and shall in-13
4646 clude— 14
4747 ‘‘(A) experts in the unique economic, so-15
4848 cial, cultural, ecological, geographic, and re-16
4949 source concerns of working waterfronts; and 17
5050 ‘‘(B) representatives from— 18
5151 ‘‘(i) the Office of Coastal Management 19
5252 of the National Oceanic and Atmospheric 20
5353 Administration; 21
5454 ‘‘(ii) the United States Fish and Wild-22
5555 life Service; 23
5656 ‘‘(iii) the Department of Agriculture; 24
5757 ‘‘(iv) the Environmental Protection 25
5858 Agency; 26

7474 UNCTIONS.—The Task Force shall— 12
7575 ‘‘(A) identify and prioritize critical needs 13
7676 with respect to working waterfronts in coastal 14
7777 states that have a management program ap-15
7878 proved under section 306, in the areas of— 16
7979 ‘‘(i) economic and cultural importance 17
8080 of such working waterfronts to commu-18
8181 nities; 19
8282 ‘‘(ii) changing circumstances and 20
8383 threats such working waterfronts face from 21
8484 trade barriers and environmental changes, 22
8585 including sea level rise, extreme weather 23
8686 events, ocean acidification, and harmful 24
8787 algal blooms; and 25

9292 fronts and highlighting them within com-2
9393 munities; 3
9494 ‘‘(B) outline options, in consultation with 4
9595 coastal states and coastal stakeholders, to ad-5
9696 dress each critical need identified under sub-6
9797 paragraph (A), including adaptation and miti-7
9898 gation options where applicable; 8
9999 ‘‘(C) identify which Federal agency is re-9
100100 sponsible for addressing each critical need iden-10
101101 tified under subparagraph (A); and 11
102102 ‘‘(D) recommend which Federal agency is 12
103103 best suited to address each critical need identi-13
104104 fied under subparagraph (A) for which no re-14
105105 sponsible Federal agency is identified under 15
106106 subparagraph (C). 16
107107 ‘‘(4) R
108108 EPORT.—Not later than 18 months after 17
109109 the date of the enactment of this section, the Task 18
110110 Force shall submit to Congress a report regarding 19
111111 the findings of the Task Force under this sub-20
112112 section. 21
113113 ‘‘(5) I
114114 MPLEMENTATION.—Not later than 30 22
115115 months after the date of the enactment of this sec-23
116116 tion, the head of each Federal agency identified 24
117117 under paragraph (3)(C) shall, to the extent prac-25

125125 ORKINGWATERFRONTSPLAN.— 4
126126 ‘‘(1) I
127127 N GENERAL.—A covered entity may sub-5
128128 mit to the Secretary a working waterfronts plan for 6
129129 approval under this subsection, which, as applicable 7
130130 and with respect to the covered entity— 8
131131 ‘‘(A) shall— 9
132132 ‘‘(i) provide for the preservation and 10
133133 expansion of access to coastal waters by 11
134134 coastal users; 12
135135 ‘‘(ii) be complementary to and incor-13
136136 porate the policies, objectives, and regula-14
137137 tions of regional and local working water-15
138138 fronts plans or strategies in effect before 16
139139 the date of the enactment of this section; 17
140140 ‘‘(iii) be developed through a process 18
141141 that— 19
142142 ‘‘(I) ensures the involvement of 20
143143 coastal stakeholders; and 21
144144 ‘‘(II) is consistent with other 22
145145 coastal management programs, regu-23
146146 lations, and activities of the covered 24
147147 entity; 25

152152 of the covered entity, if any; 2
153153 ‘‘(v) if the covered entity designates a 3
154154 qualified holder under clause (iv)— 4
155155 ‘‘(I) ensure that such qualified 5
156156 holder complies with the duty of a 6
157157 qualified holder to enforce each work-7
158158 ing waterfront covenant to which the 8
159159 qualified holder is a party; and 9
160160 ‘‘(II) certify that the covered en-10
161161 tity retains the responsibility to en-11
162162 sure that each affected working water-12
163163 front is managed in a manner that is 13
164164 consistent with the working water-14
165165 fronts plan of the covered entity; and 15
166166 ‘‘(vi) include— 16
167167 ‘‘(I) an assessment of the eco-17
168168 nomic, social, cultural, and historical 18
169169 value of working waterfronts; 19
170170 ‘‘(II) a description of any rel-20
171171 evant non-Federal laws and regula-21
172172 tions that affect working waterfronts 22
173173 in the geographic areas identified 23
174174 under subclauses (III) and (IV); 24

180180 fronts are, as of the date of the enact-3
181181 ment of this subsection, under threat 4
182182 of conversion to uses incompatible 5
183183 with commercial and recreational fish-6
184184 ing, recreational fishing and boating 7
185185 businesses, aquaculture, boatbuilding, 8
186186 or other water-dependent, coastal-re-9
187187 lated business, and the level of that 10
188188 threat; 11
189189 ‘‘(IV) an identification of geo-12
190190 graphic areas with a historical connec-13
191191 tion to working waterfronts where 14
192192 working waterfronts are not, as of the 15
193193 date of the enactment of this section, 16
194194 available, and, where appropriate, an 17
195195 assessment of the environmental im-18
196196 pacts of any expansion or new devel-19
197197 opment of working waterfronts on the 20
198198 coastal ecosystems of such geographic 21
199199 areas; 22
200200 ‘‘(V) an identification of addi-23
201201 tional working waterfronts needs, in-24

207207 ‘‘(VI) a strategic and prioritized 3
208208 plan for the preservation, expansion, 4
209209 and improvement of each relevant 5
210210 working waterfront; 6
211211 ‘‘(VII) for geographic areas iden-7
212212 tified under subclauses (III) and (IV), 8
213213 an identification of the current avail-9
214214 ability and potential for expansion of 10
215215 public access to coastal waters in such 11
216216 geographic areas; 12
217217 ‘‘(VIII) a description of the de-13
218218 gree of community support for the 14
219219 plan included under subclause (VI); 15
220220 and 16
221221 ‘‘(IX) a contingency plan for any 17
222222 property that reverts to the covered 18
223223 entity pursuant to a determination 19
224224 made by the covered entity under sub-20
225225 section (c)(11)(B); and 21
226226 ‘‘(B) may— 22
227227 ‘‘(i) be developed using existing infor-23
228228 mation contained in relevant surveys, 24
229229 plans, or other documents to fulfill the in-25

236236 ment, hazards resilience plan, or identifica-4
237237 tion of waterfront properties exposed to 5
238238 sea level rise or inundation; and 6
239239 ‘‘(iii) be part of a management pro-7
240240 gram approved under section 306. 8
241241 ‘‘(2) D
242242 URATION OF APPROVAL .— 9
243243 ‘‘(A) I
244244 N GENERAL.—A working waterfronts 10
245245 plan approved by the Secretary under this sub-11
246246 section shall be effective during the 5-year pe-12
247247 riod beginning on the date of such approval. 13
248248 ‘‘(B) M
249249 AINTENANCE OF APPROVAL .—An 14
250250 eligible covered entity that participates in the 15
251251 grant program on the basis of an approved 16
252252 working waterfronts plan of that eligible cov-17
253253 ered entity shall resubmit such working water-18
254254 fronts plan for approval by the Secretary before 19
255255 the end of each 5-year period described in sub-20
256256 paragraph (A). 21
257257 ‘‘(c) W
258258 ORKINGWATERFRONTSGRANTPROGRAM.— 22
259259 ‘‘(1) I
260260 N GENERAL.—The Secretary shall, in con-23
261261 sultation with covered entities, Federal agencies the 24

266266 coastal stakeholders with expertise in working water-1
267267 fronts planning, establish a regionally equitable and 2
268268 competitive grant program, to be known as the 3
269269 ‘Working Waterfronts Grant Program’. 4
270270 ‘‘(2) U
271271 SES.—The Secretary may award grants 5
272272 under this subsection to eligible covered entities— 6
273273 ‘‘(A) to implement or revise an approved 7
274274 working waterfronts plan of such eligible cov-8
275275 ered entity, including— 9
276276 ‘‘(i) acquiring a working waterfront or 10
277277 an interest in a working waterfront; 11
278278 ‘‘(ii) making improvements to a work-12
279279 ing waterfront, including constructing or 13
280280 repairing wharfs, boat ramps, or related 14
281281 facilities; or 15
282282 ‘‘(iii) carrying out necessary climate 16
283283 adaptation mitigation activities for a work-17
284284 ing waterfront; or 18
285285 ‘‘(B) to develop a working waterfronts plan 19
286286 of such eligible covered entity under subsection 20
287287 (b). 21
288288 ‘‘(3) A
289289 PPLICATION.— 22
290290 ‘‘(A) I
291291 N GENERAL.—To be eligible for a 23
292292 grant under this subsection, an eligible covered 24

298298 ‘‘(i) that, if applicable, is consistent 3
299299 with the management program of the eligi-4
300300 ble covered entity approved under section 5
301301 306; and 6
302302 ‘‘(ii) in such form, at such time, and 7
303303 containing such information as the Sec-8
304304 retary determines appropriate. 9
305305 ‘‘(B) D
306306 EADLINE.—Not later than 60 days 10
307307 after the date on which the Secretary receives 11
308308 an application for a grant under this para-12
309309 graph, the Secretary shall approve or reject 13
310310 such application. 14
311311 ‘‘(4) G
312312 UIDELINES.—The Secretary shall, in 15
313313 consultation with the entities described in paragraph 16
314314 (1), issue guidelines regarding the implementation of 17
315315 the grant program. 18
316316 ‘‘(5) C
317317 RITERIA.—In awarding a grant to an eli-19
318318 gible covered entity, the Secretary shall take into ac-20
319319 count the following criteria: 21
320320 ‘‘(A) The economic, cultural, and historical 22
321321 significance of working waterfronts to the eligi-23
322322 ble covered entity. 24

327327 fronts needs of the eligible covered entity, as 2
328328 described in the approved working waterfronts 3
329329 plan of the eligible covered entity, if any. 4
330330 ‘‘(C) The ability of the eligible covered en-5
331331 tity to meet the matching requirement under 6
332332 paragraph (10). 7
333333 ‘‘(D) The potential for rapid turnover in 8
334334 the ownership of relevant working waterfronts, 9
335335 and, if applicable, the need for the eligible cov-10
336336 ered entity to respond quickly when property in 11
337337 an existing or potential working waterfront area 12
338338 or public access area, as identified in the ap-13
339339 proved working waterfronts plan of the eligible 14
340340 covered entity, if any, comes under threat of 15
341341 conversion to incompatible uses or becomes 16
342342 available for purchase. 17
343343 ‘‘(E) As applicable, the impact of the ap-18
344344 proved working waterfronts plan of the eligible 19
345345 covered entity, if any, on the coastal ecosystem 20
346346 and working waterfronts of the eligible covered 21
347347 entity and the users of the coastal ecosystem of 22
348348 the eligible covered entity. 23
349349 ‘‘(6) O
350350 THER TECHNICAL AND FINANCIAL AS -24
351351 SISTANCE.— 25

356356 an eligible covered entity that is awarded a 2
357357 grant under this subsection, the Secretary shall 3
358358 provide to such eligible covered entity technical 4
359359 assistance— 5
360360 ‘‘(i) to identify and obtain sources of 6
361361 Federal technical or financial assistance 7
362362 other than that provided under this sub-8
363363 section to develop a working waterfronts 9
364364 plan for approval under subsection (b) or 10
365365 to implement or revise an approved work-11
366366 ing waterfronts plan; 12
367367 ‘‘(ii) to develop a working waterfronts 13
368368 plan for approval under subsection (b); 14
369369 ‘‘(iii) to implement or revise an ap-15
370370 proved working waterfronts plan; 16
371371 ‘‘(iv) to integrate resilience planning 17
372372 into working waterfronts preservation ef-18
373373 forts of such eligible covered entity; 19
374374 ‘‘(v) to develop additional tools to pro-20
375375 tect working waterfronts; 21
376376 ‘‘(vi) regarding guidance for best 22
377377 storm water management practices with 23
378378 regard to working waterfronts; or 24

383383 practices regarding working waterfronts 2
384384 and resilience planning. 3
385385 ‘‘(B) L
386386 IMITATION.—The Secretary may 4
387387 use not more than 5 percent of the amounts 5
388388 made available under this subsection in each 6
389389 fiscal year to provide technical assistance under 7
390390 this paragraph. 8
391391 ‘‘(7) P
392392 UBLIC ACCESS REQUIREMENT .—A 9
393393 project carried out with a grant awarded under this 10
394394 subsection, other than a project that involves com-11
395395 mercial fishing or other industrial access points to 12
396396 which the eligible covered entity determines public 13
397397 access would be unsafe, shall provide for the expan-14
398398 sion, improvement, or preservation of reasonable and 15
399399 appropriate public access to coastal waters at or in 16
400400 the vicinity of working waterfronts. 17
401401 ‘‘(8) L
402402 IMITATION ON ACQUISITION.—An eligible 18
403403 covered entity that is awarded a grant under this 19
404404 subsection, or any entity to which such eligible cov-20
405405 ered entity allocates a portion of such grant under 21
406406 paragraph (9), may use such grant award to acquire 22
407407 title to or an interest in a working waterfront, in-23
408408 cluding an easement, only— 24

413413 seller; or 2
414414 ‘‘(B) for less than fair market value from 3
415415 a seller that certifies to the Secretary that the 4
416416 seller is willing and is not subject to coercion. 5

418418 LLOCATION.— 6
419419 ‘‘(A) I
420420 N GENERAL.—An eligible covered en-7
421421 tity that is awarded a grant under this sub-8
422422 section may allocate a portion of such grant 9
423423 award to a unit of State or local government, 10
424424 a nonprofit organization, a fishing cooperative, 11
425425 or any other appropriate entity for the purpose 12
426426 of carrying out this subsection if such eligible 13
427427 covered entity ensures that any such allocated 14
428428 grant award is used consistently with this sub-15
429429 section. 16
430430 ‘‘(B) I
431431 DENTIFIED WORKING WATER -17
432432 FRONTS.—The Secretary shall encourage each 18
433433 eligible covered entity that is awarded a grant 19
434434 under this subsection to equitably allocate such 20
435435 grant award among working waterfronts identi-21
436436 fied in the approved working waterfronts plan 22
437437 of each such eligible covered entity, if any. 23
438438 ‘‘(10) M
439439 ATCHING REQUIREMENT .— 24

443443 ‘‘(A) IN GENERAL.—Except as provided in 1
444444 subparagraph (B), the Federal share of a 2
445445 project carried out with a grant awarded under 3
446446 this subsection may not exceed 75 percent. 4
447447 ‘‘(B) W
448448 AIVER OF MATCHING REQUIRE -5
449449 MENT.—The Secretary may waive the applica-6
450450 tion of subparagraph (A)— 7
451451 ‘‘(i) with respect to an eligible covered 8
452452 entity that is awarded a grant under this 9
453453 subsection that has designated a qualified 10
454454 holder that is located within— 11
455455 ‘‘(I) a disadvantaged community; 12
456456 or 13
457457 ‘‘(II) a community that has an 14
458458 inability to draw on other sources of 15
459459 funding because of the small popu-16
460460 lation or low income of the commu-17
461461 nity; or 18
462462 ‘‘(ii) for any other reason the Sec-19
463463 retary determines appropriate. 20
464464 ‘‘(C) N
465465 ON-FEDERAL SHARE .—An eligible 21
466466 covered entity that is awarded a grant under 22
467467 this subsection may satisfy the non-Federal 23
468468 share of a project carried out with a grant 24
469469 awarded under this subsection through in-kind 25

474474 cluding the following: 2
475475 ‘‘(i) The value, as determined by an 3
476476 appraisal performed at such time before 4
477477 the award of the grant as the Secretary de-5
478478 termines appropriate, of a working water-6
479479 front or an interest in a working water-7
480480 front, including conservation and other 8
481481 easements, that is held in perpetuity by a 9
482482 qualified holder, if the working waterfront 10
483483 or interest in a working waterfront— 11
484484 ‘‘(I) is identified in the grant ap-12
485485 plication; and 13
