22	22	Be it enacted by the Senate and House of Representa-1
23	23	tives of the United States of America in Congress assembled, 2
24	24	SECTION 1. SHORT TITLE. 3
25	25	This Act may be cited as the ‘‘Keep America’s Water-4
26	26	fronts Working Act of 2025’’. 5

31	31	The Coastal Zone Management Act of 1972 (16 2
32	32	U.S.C. 1451 et seq.) is amended by inserting after section 3
33	33	306A (16 U.S.C. 1455a) the following: 4
34	34	‘‘SEC. 306B. WORKING WATERFRONTS. 5
35	35	‘‘(a) T
36	36	ASKFORCE.— 6
37	37	‘‘(1) I
38	38	N GENERAL.—The Secretary shall estab-7
39	39	lish a task force to work directly with covered enti-8
40	40	ties, users of working waterfronts, and coastal stake-9
41	41	holders to identify and address critical needs with 10
42	42	respect to working waterfronts. 11
43	43	‘‘(2) M
44	44	EMBERSHIP.—The Secretary shall ap-12
45	45	point members of the Task Force, and shall in-13
46	46	clude— 14
47	47	‘‘(A) experts in the unique economic, so-15
48	48	cial, cultural, ecological, geographic, and re-16
49	49	source concerns of working waterfronts; and 17
50	50	‘‘(B) representatives from— 18
51	51	‘‘(i) the Office of Coastal Management 19
52	52	of the National Oceanic and Atmospheric 20
53	53	Administration; 21
54	54	‘‘(ii) the United States Fish and Wild-22
55	55	life Service; 23
56	56	‘‘(iii) the Department of Agriculture; 24
57	57	‘‘(iv) the Environmental Protection 25
58	58	Agency; 26

68	68	ministration; 7
69	69	‘‘(ix) such other Federal agencies as 8
70	70	the Secretary determines appropriate; 9
71	71	‘‘(x) Indian Tribes; and 10
72	72	‘‘(xi) Native Hawaiian organizations. 11

74	74	UNCTIONS.—The Task Force shall— 12
75	75	‘‘(A) identify and prioritize critical needs 13
76	76	with respect to working waterfronts in coastal 14
77	77	states that have a management program ap-15
78	78	proved under section 306, in the areas of— 16
79	79	‘‘(i) economic and cultural importance 17
80	80	of such working waterfronts to commu-18
81	81	nities; 19
82	82	‘‘(ii) changing circumstances and 20
83	83	threats such working waterfronts face from 21
84	84	trade barriers and environmental changes, 22
85	85	including sea level rise, extreme weather 23
86	86	events, ocean acidification, and harmful 24
87	87	algal blooms; and 25

92	92	fronts and highlighting them within com-2
93	93	munities; 3
94	94	‘‘(B) outline options, in consultation with 4
95	95	coastal states and coastal stakeholders, to ad-5
96	96	dress each critical need identified under sub-6
97	97	paragraph (A), including adaptation and miti-7
98	98	gation options where applicable; 8
99	99	‘‘(C) identify which Federal agency is re-9
100	100	sponsible for addressing each critical need iden-10
101	101	tified under subparagraph (A); and 11
102	102	‘‘(D) recommend which Federal agency is 12
103	103	best suited to address each critical need identi-13
104	104	fied under subparagraph (A) for which no re-14
105	105	sponsible Federal agency is identified under 15
106	106	subparagraph (C). 16
107	107	‘‘(4) R
108	108	EPORT.—Not later than 18 months after 17
109	109	the date of the enactment of this section, the Task 18
110	110	Force shall submit to Congress a report regarding 19
111	111	the findings of the Task Force under this sub-20
112	112	section. 21
113	113	‘‘(5) I
114	114	MPLEMENTATION.—Not later than 30 22
115	115	months after the date of the enactment of this sec-23
116	116	tion, the head of each Federal agency identified 24
117	117	under paragraph (3)(C) shall, to the extent prac-25

125	125	ORKINGWATERFRONTSPLAN.— 4
126	126	‘‘(1) I
127	127	N GENERAL.—A covered entity may sub-5
128	128	mit to the Secretary a working waterfronts plan for 6
129	129	approval under this subsection, which, as applicable 7
130	130	and with respect to the covered entity— 8
131	131	‘‘(A) shall— 9
132	132	‘‘(i) provide for the preservation and 10
133	133	expansion of access to coastal waters by 11
134	134	coastal users; 12
135	135	‘‘(ii) be complementary to and incor-13
136	136	porate the policies, objectives, and regula-14
137	137	tions of regional and local working water-15
138	138	fronts plans or strategies in effect before 16
139	139	the date of the enactment of this section; 17
140	140	‘‘(iii) be developed through a process 18
141	141	that— 19
142	142	‘‘(I) ensures the involvement of 20
143	143	coastal stakeholders; and 21
144	144	‘‘(II) is consistent with other 22
145	145	coastal management programs, regu-23
146	146	lations, and activities of the covered 24
147	147	entity; 25

152	152	of the covered entity, if any; 2
153	153	‘‘(v) if the covered entity designates a 3
154	154	qualified holder under clause (iv)— 4
155	155	‘‘(I) ensure that such qualified 5
156	156	holder complies with the duty of a 6
157	157	qualified holder to enforce each work-7
158	158	ing waterfront covenant to which the 8
159	159	qualified holder is a party; and 9
160	160	‘‘(II) certify that the covered en-10
161	161	tity retains the responsibility to en-11
162	162	sure that each affected working water-12
163	163	front is managed in a manner that is 13
164	164	consistent with the working water-14
165	165	fronts plan of the covered entity; and 15
166	166	‘‘(vi) include— 16
167	167	‘‘(I) an assessment of the eco-17
168	168	nomic, social, cultural, and historical 18
169	169	value of working waterfronts; 19
170	170	‘‘(II) a description of any rel-20
171	171	evant non-Federal laws and regula-21
172	172	tions that affect working waterfronts 22
173	173	in the geographic areas identified 23
174	174	under subclauses (III) and (IV); 24

180	180	fronts are, as of the date of the enact-3
181	181	ment of this subsection, under threat 4
182	182	of conversion to uses incompatible 5
183	183	with commercial and recreational fish-6
184	184	ing, recreational fishing and boating 7
185	185	businesses, aquaculture, boatbuilding, 8
186	186	or other water-dependent, coastal-re-9
187	187	lated business, and the level of that 10
188	188	threat; 11
189	189	‘‘(IV) an identification of geo-12
190	190	graphic areas with a historical connec-13
191	191	tion to working waterfronts where 14
192	192	working waterfronts are not, as of the 15
193	193	date of the enactment of this section, 16
194	194	available, and, where appropriate, an 17
195	195	assessment of the environmental im-18
196	196	pacts of any expansion or new devel-19
197	197	opment of working waterfronts on the 20
198	198	coastal ecosystems of such geographic 21
199	199	areas; 22
200	200	‘‘(V) an identification of addi-23
201	201	tional working waterfronts needs, in-24

207	207	‘‘(VI) a strategic and prioritized 3
208	208	plan for the preservation, expansion, 4
209	209	and improvement of each relevant 5
210	210	working waterfront; 6
211	211	‘‘(VII) for geographic areas iden-7
212	212	tified under subclauses (III) and (IV), 8
213	213	an identification of the current avail-9
214	214	ability and potential for expansion of 10
215	215	public access to coastal waters in such 11
216	216	geographic areas; 12
217	217	‘‘(VIII) a description of the de-13
218	218	gree of community support for the 14
219	219	plan included under subclause (VI); 15
220	220	and 16
221	221	‘‘(IX) a contingency plan for any 17
222	222	property that reverts to the covered 18
223	223	entity pursuant to a determination 19
224	224	made by the covered entity under sub-20
225	225	section (c)(11)(B); and 21
226	226	‘‘(B) may— 22
227	227	‘‘(i) be developed using existing infor-23
228	228	mation contained in relevant surveys, 24
229	229	plans, or other documents to fulfill the in-25

235	235	‘‘(ii) include a vulnerability assess-3
236	236	ment, hazards resilience plan, or identifica-4
237	237	tion of waterfront properties exposed to 5
238	238	sea level rise or inundation; and 6
239	239	‘‘(iii) be part of a management pro-7
240	240	gram approved under section 306. 8
241	241	‘‘(2) D
242	242	URATION OF APPROVAL .— 9
243	243	‘‘(A) I
244	244	N GENERAL.—A working waterfronts 10
245	245	plan approved by the Secretary under this sub-11
246	246	section shall be effective during the 5-year pe-12
247	247	riod beginning on the date of such approval. 13
248	248	‘‘(B) M
249	249	AINTENANCE OF APPROVAL .—An 14
250	250	eligible covered entity that participates in the 15
251	251	grant program on the basis of an approved 16
252	252	working waterfronts plan of that eligible cov-17
253	253	ered entity shall resubmit such working water-18
254	254	fronts plan for approval by the Secretary before 19
255	255	the end of each 5-year period described in sub-20
256	256	paragraph (A). 21
257	257	‘‘(c) W
258	258	ORKINGWATERFRONTSGRANTPROGRAM.— 22
259	259	‘‘(1) I
260	260	N GENERAL.—The Secretary shall, in con-23
261	261	sultation with covered entities, Federal agencies the 24

266	266	coastal stakeholders with expertise in working water-1
267	267	fronts planning, establish a regionally equitable and 2
268	268	competitive grant program, to be known as the 3
269	269	‘Working Waterfronts Grant Program’. 4
270	270	‘‘(2) U
271	271	SES.—The Secretary may award grants 5
272	272	under this subsection to eligible covered entities— 6
273	273	‘‘(A) to implement or revise an approved 7
274	274	working waterfronts plan of such eligible cov-8
275	275	ered entity, including— 9
276	276	‘‘(i) acquiring a working waterfront or 10
277	277	an interest in a working waterfront; 11
278	278	‘‘(ii) making improvements to a work-12
279	279	ing waterfront, including constructing or 13
280	280	repairing wharfs, boat ramps, or related 14
281	281	facilities; or 15
282	282	‘‘(iii) carrying out necessary climate 16
283	283	adaptation mitigation activities for a work-17
284	284	ing waterfront; or 18
285	285	‘‘(B) to develop a working waterfronts plan 19
286	286	of such eligible covered entity under subsection 20
287	287	(b). 21
288	288	‘‘(3) A
289	289	PPLICATION.— 22
290	290	‘‘(A) I
291	291	N GENERAL.—To be eligible for a 23
292	292	grant under this subsection, an eligible covered 24

298	298	‘‘(i) that, if applicable, is consistent 3
299	299	with the management program of the eligi-4
300	300	ble covered entity approved under section 5
301	301	306; and 6
302	302	‘‘(ii) in such form, at such time, and 7
303	303	containing such information as the Sec-8
304	304	retary determines appropriate. 9
305	305	‘‘(B) D
306	306	EADLINE.—Not later than 60 days 10
307	307	after the date on which the Secretary receives 11
308	308	an application for a grant under this para-12
309	309	graph, the Secretary shall approve or reject 13
310	310	such application. 14
311	311	‘‘(4) G
312	312	UIDELINES.—The Secretary shall, in 15
313	313	consultation with the entities described in paragraph 16
314	314	(1), issue guidelines regarding the implementation of 17
315	315	the grant program. 18
316	316	‘‘(5) C
317	317	RITERIA.—In awarding a grant to an eli-19
318	318	gible covered entity, the Secretary shall take into ac-20
319	319	count the following criteria: 21
320	320	‘‘(A) The economic, cultural, and historical 22
321	321	significance of working waterfronts to the eligi-23
322	322	ble covered entity. 24

327	327	fronts needs of the eligible covered entity, as 2
328	328	described in the approved working waterfronts 3
329	329	plan of the eligible covered entity, if any. 4
330	330	‘‘(C) The ability of the eligible covered en-5
331	331	tity to meet the matching requirement under 6
332	332	paragraph (10). 7
333	333	‘‘(D) The potential for rapid turnover in 8
334	334	the ownership of relevant working waterfronts, 9
335	335	and, if applicable, the need for the eligible cov-10
336	336	ered entity to respond quickly when property in 11
337	337	an existing or potential working waterfront area 12
338	338	or public access area, as identified in the ap-13
339	339	proved working waterfronts plan of the eligible 14
340	340	covered entity, if any, comes under threat of 15
341	341	conversion to incompatible uses or becomes 16
342	342	available for purchase. 17
343	343	‘‘(E) As applicable, the impact of the ap-18
344	344	proved working waterfronts plan of the eligible 19
345	345	covered entity, if any, on the coastal ecosystem 20
346	346	and working waterfronts of the eligible covered 21
347	347	entity and the users of the coastal ecosystem of 22
348	348	the eligible covered entity. 23
349	349	‘‘(6) O
350	350	THER TECHNICAL AND FINANCIAL AS -24
351	351	SISTANCE.— 25

356	356	an eligible covered entity that is awarded a 2
357	357	grant under this subsection, the Secretary shall 3
358	358	provide to such eligible covered entity technical 4
359	359	assistance— 5
360	360	‘‘(i) to identify and obtain sources of 6
361	361	Federal technical or financial assistance 7
362	362	other than that provided under this sub-8
363	363	section to develop a working waterfronts 9
364	364	plan for approval under subsection (b) or 10
365	365	to implement or revise an approved work-11
366	366	ing waterfronts plan; 12
367	367	‘‘(ii) to develop a working waterfronts 13
368	368	plan for approval under subsection (b); 14
369	369	‘‘(iii) to implement or revise an ap-15
370	370	proved working waterfronts plan; 16
371	371	‘‘(iv) to integrate resilience planning 17
372	372	into working waterfronts preservation ef-18
373	373	forts of such eligible covered entity; 19
374	374	‘‘(v) to develop additional tools to pro-20
375	375	tect working waterfronts; 21
376	376	‘‘(vi) regarding guidance for best 22
377	377	storm water management practices with 23
378	378	regard to working waterfronts; or 24

383	383	practices regarding working waterfronts 2
384	384	and resilience planning. 3
385	385	‘‘(B) L
386	386	IMITATION.—The Secretary may 4
387	387	use not more than 5 percent of the amounts 5
388	388	made available under this subsection in each 6
389	389	fiscal year to provide technical assistance under 7
390	390	this paragraph. 8
391	391	‘‘(7) P
392	392	UBLIC ACCESS REQUIREMENT .—A 9
393	393	project carried out with a grant awarded under this 10
394	394	subsection, other than a project that involves com-11
395	395	mercial fishing or other industrial access points to 12
396	396	which the eligible covered entity determines public 13
397	397	access would be unsafe, shall provide for the expan-14
398	398	sion, improvement, or preservation of reasonable and 15
399	399	appropriate public access to coastal waters at or in 16
400	400	the vicinity of working waterfronts. 17
401	401	‘‘(8) L
402	402	IMITATION ON ACQUISITION.—An eligible 18
403	403	covered entity that is awarded a grant under this 19
404	404	subsection, or any entity to which such eligible cov-20
405	405	ered entity allocates a portion of such grant under 21
406	406	paragraph (9), may use such grant award to acquire 22
407	407	title to or an interest in a working waterfront, in-23
408	408	cluding an easement, only— 24

413	413	seller; or 2
414	414	‘‘(B) for less than fair market value from 3
415	415	a seller that certifies to the Secretary that the 4
416	416	seller is willing and is not subject to coercion. 5

418	418	LLOCATION.— 6
419	419	‘‘(A) I
420	420	N GENERAL.—An eligible covered en-7
421	421	tity that is awarded a grant under this sub-8
422	422	section may allocate a portion of such grant 9
423	423	award to a unit of State or local government, 10
424	424	a nonprofit organization, a fishing cooperative, 11
425	425	or any other appropriate entity for the purpose 12
426	426	of carrying out this subsection if such eligible 13
427	427	covered entity ensures that any such allocated 14
428	428	grant award is used consistently with this sub-15
429	429	section. 16
430	430	‘‘(B) I
431	431	DENTIFIED WORKING WATER -17
432	432	FRONTS.—The Secretary shall encourage each 18
433	433	eligible covered entity that is awarded a grant 19
434	434	under this subsection to equitably allocate such 20
435	435	grant award among working waterfronts identi-21
436	436	fied in the approved working waterfronts plan 22
437	437	of each such eligible covered entity, if any. 23
438	438	‘‘(10) M
439	439	ATCHING REQUIREMENT .— 24

443	443	‘‘(A) IN GENERAL.—Except as provided in 1
444	444	subparagraph (B), the Federal share of a 2
445	445	project carried out with a grant awarded under 3
446	446	this subsection may not exceed 75 percent. 4
447	447	‘‘(B) W
448	448	AIVER OF MATCHING REQUIRE -5
449	449	MENT.—The Secretary may waive the applica-6
450	450	tion of subparagraph (A)— 7
451	451	‘‘(i) with respect to an eligible covered 8
452	452	entity that is awarded a grant under this 9
453	453	subsection that has designated a qualified 10
454	454	holder that is located within— 11
455	455	‘‘(I) a disadvantaged community; 12
456	456	or 13
457	457	‘‘(II) a community that has an 14
458	458	inability to draw on other sources of 15
459	459	funding because of the small popu-16
460	460	lation or low income of the commu-17
461	461	nity; or 18
462	462	‘‘(ii) for any other reason the Sec-19
463	463	retary determines appropriate. 20
464	464	‘‘(C) N
465	465	ON-FEDERAL SHARE .—An eligible 21
466	466	covered entity that is awarded a grant under 22
467	467	this subsection may satisfy the non-Federal 23
468	468	share of a project carried out with a grant 24

724	724	agreement in recordable form entered into between 10
725	725	a person that holds title to or an interest in a work-11
726	726	ing waterfront and a covered entity that is awarded 12
727	727	a grant under the grant program or a qualified hold-13
728	728	er of such covered entity that provides such assur-14
729	729	ances as the Secretary determines necessary to en-15
730	730	sure the following: 16
731	731	‘‘(A) Except as provided in subparagraph 17
732	732	(C), the title to or interest in the working wa-18
733	733	terfront will be held by an entity that is subject 19
734	734	to such agreement in perpetuity. 20
735	735	‘‘(B) The working waterfront will be man-21
736	736	aged in a manner that is consistent with the 22
737	737	purposes of this section, and the working water-23
738	738	front will not be converted to any use that is in-24
739	739	consistent with this section. 25

760	760	enforcement and oversight by the covered entity 18

821	821	may use amounts received under this section as 17
822	822	a source of revenue (restricted solely to interest 18

825	825	of the principal and interest on a revenue or 21
826	826	general obligation bond issued by the eligible 22
827	827	coastal state to provide matching funds under 23
828	828	subsection (e) if the proceeds of the sale of the 24

847	847	may not provide financial assistance described in 13
848	848	subsection (f) to a covered entity that does not have 14
849	849	the technical, managerial, and financial capability to 15

853	853	REVAILING WAGES.—The Secretary shall 18
854	854	ensure compliance with the provisions of the Act of 19
855	855	March 3, 1931 (40 U.S.C. 3141 et seq.; commonly 20
856	856	known as the ‘Davis-Bacon Act’) with respect to any 21
857	857	construction project carried out in whole or in part 22
858	858	with financial assistance made available from a 23
859	859	working waterfronts preservation loan fund. 24

888	888	preservation loan fund in the first fiscal year 23

950	950	terest rate equal to or greater than 0 percent 22
951	951	shall not be considered additional subsidization 23

960	960	pursuant to paragraph (1)— 5
961	961	‘‘(A) may not exceed 35 percent; and 6
962	962	‘‘(B) to the extent that there are, as deter-7
963	963	mined by the Secretary, sufficient applications 8
964	964	from disadvantaged communities for loans, may 9
965	965	not be less than 12 percent. 10

967	967	LIGIBLECOASTALSTATECONTRIBUTION.— 11
968	968	Each capitalization agreement entered into under sub-12
969	969	section (a)(1) shall require that the eligible coastal state 13
970	970	subject to such agreement deposit in the working water-14
971	971	fronts preservation loan fund of the eligible coastal state 15
972	972	an amount equal to not less than 20 percent of the total 16
973	973	amount of the capitalization grant to be made to the eligi-17
974	974	ble coastal state on or before the date on which the capital-18
975	975	ization grant payment is made to the eligible coastal state. 19
976	976	‘‘(f) T
977	977	YPES OFASSISTANCE.—The amounts depos-20
978	978	ited into a working waterfronts preservation loan fund of 21
979	979	an eligible coastal state under this section may be used 22
980	980	by the eligible coastal state— 23
981	981	‘‘(1) to make a loan to a covered entity, on the 24
982	982	condition that— 25

998	998	‘‘(i) terminates not later than the date 13
999	999	that is 40 years after the completion of the 14

1003	1003	‘‘(D) the recipient of the loan will establish 18
1004	1004	a dedicated source of revenue (or, in the case 19
1005	1005	of a privately owned working waterfront prop-20
1006	1006	erty, demonstrate that there is adequate secu-21
1007	1007	rity) for the repayment of the loan; and 22
1008	1008	‘‘(E) the working waterfronts preservation 23
1009	1009	loan fund of the eligible coastal state will be 24

1022	1022	a project eligible for financial assistance under this 10
1023	1023	section) if the guarantee or purchase would improve 11
1024	1024	credit market access or reduce the interest rate ap-12
1025	1025	plicable to the obligation; 13
1026	1026	‘‘(4) as a source of revenue or security for the 14
1027	1027	payment of principal and interest on a revenue or 15
1028	1028	general obligation bond issued by the eligible coastal 16
1029	1029	state if the proceeds of the sale of the bond will be 17
1030	1030	deposited into the working waterfronts preservation 18
1031	1031	loan fund of the eligible coastal state; or 19
1032	1032	‘‘(5) to earn interest on the amounts deposited 20
1033	1033	into the working waterfronts preservation loan fund 21
1034	1034	of the eligible coastal state. 22
