16	16	turers of cylinders, and for other purposes.
17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘Compressed Gas Cyl-4
21	21	inder Safety and Oversight Improvements Act of 2025’’. 5
22	22	SEC. 2. REGULATION OF FOREIGN MANUFACTURERS OF 6
23	23	CYLINDERS USED IN TRANSPORTING HAZ-7
24	24	ARDOUS MATERIALS. 8
25	25	(a) D
26	26	EFINITIONS.—In this section: 9

30	30	(1) CYLINDER.—The term ‘‘cylinder’’ means 1
31	31	any cylinder specified under any of sections 178.36 2
32	32	through 178.68 of title 49, Code of Federal Regula-3
33	33	tions (or successor regulations). 4

35	35	OREIGN MANUFACTURER OF CYLINDERS ; 5
36	36	FMOC.—The term ‘‘foreign manufacturer of cyl-6
37	37	inders’’ or ‘‘FMOC’’ means an entity that manufac-7
38	38	tures cylinders outside of the United States that are 8
39	39	intended to be represented, marked, certified, or sold 9
40	40	as qualified for use in transporting a hazardous ma-10
41	41	terial in commerce in the United States. 11

43	43	N GOOD STANDING .—The term ‘‘in good 12
44	44	standing’’, with respect to an FMOC, means that 13
45	45	the FMOC— 14
46	46	(A) is approved by the Secretary pursuant 15
47	47	to section 107.807 of title 49, Code of Federal 16
48	48	Regulations (or a successor regulation); and 17
49	49	(B) has demonstrated 3 years of compli-18
50	50	ance with— 19
51	51	(i) part 107 of title 49, Code of Fed-20
52	52	eral Regulations (or successor regulations); 21
53	53	and 22
54	54	(ii) chapter 51 of title 49, United 23
55	55	States Code. 24

59	59	(4) SECRETARY.—The term ‘‘Secretary’’ means 1
60	60	the Secretary of Transportation. 2

62	62	PPROVAL OF FOREIGNMANUFACTURERS OF 3

64	64	YLINDERS.— 4
65	65	(1) I
66	66	N GENERAL.—The Secretary shall promul-5
67	67	gate regulations to provide that an approval pro-6
68	68	vided to an FMOC pursuant to section 107.807 of 7
69	69	title 49, Code of Federal Regulations (or a successor 8
70	70	regulation), shall be for a period of not longer than 9
71	71	1 year, except as provided under paragraph (2). 10

73	73	YEAR APPROVAL.—The Secretary may 11
74	74	provide a 5-year approval of an FMOC pursuant to 12
75	75	section 107.807 of title 49, Code of Federal Regula-13
76	76	tions (or a successor regulation), if the following re-14
77	77	quirements are met: 15
78	78	(A) The FMOC attests that none of the 16
79	79	cylinders made by the FMOC are prohibited 17
80	80	from entry to the United States under section 18
81	81	307 of the Tariff Act of 1930 (19 U.S.C. 19
82	82	1307). 20
83	83	(B) The FMOC certifies that— 21
84	84	(i) the information provided pursuant 22
85	85	to subsection (e) is accurate; and 23

90	90	sibility to inform the Secretary if any such 2
91	91	information materially changes. 3
92	92	(C) The Secretary determines that the 4
93	93	FMOC is in good standing. 5

95	95	ACILITY INSPECTIONS.— 6

97	97	EFINITION OF OBSTRUCTS .—In this 7
98	98	paragraph, the term ‘‘obstructs’’ means taking 8
99	99	actions that are known, or reasonably should be 9
100	100	known, to prevent, hinder, or impede an inspec-10
101	101	tion. 11

103	103	ENALTIES.—The Secretary may sus-12
104	104	pend or terminate an approval of an FMOC if 13
105	105	the FMOC obstructs or prevents the Secretary 14
106	106	from carrying out an inspection under section 15
107	107	107.807(c) of title 49, Code of Federal Regula-16
108	108	tions (or a successor regulation). 17

110	110	NTERACTION WITH OTHER STATUTES , 18
111	111	AGREEMENTS, REGULATIONS.—Nothing in this sec-19
112	112	tion may be construed to prevent the harmonization 20
113	113	of cylinder standards otherwise authorized by law. 21

115	115	THER CAUSE FOR SUSPENSION OR TERMI -22
116	116	NATION.—The Secretary may suspend or terminate 23
117	117	an approval of an FMOC on determination that the 24
118	118	FMOC knowingly or intentionally misrepresented re-25

128	128	N GENERAL.—Not later than 1 year after 5
129	129	the date of enactment of this Act, the Secretary 6
130	130	shall promulgate such regulations as are necessary 7
131	131	to establish a process, as determined by the Sec-8
132	132	retary, for any interested party to request a reevalu-9
133	133	ation of the approval of FMOC cylinders under sec-10
134	134	tion 107.807 of title 49, Code of Federal Regula-11
135	135	tions (or a successor regulation), to review the accu-12
136	136	racy and safety of the actions of the FMOC. 13

138	138	ETITION FOR REEVALUATION .—The regu-14
139	139	lations promulgated under paragraph (1) shall allow 15
140	140	an interested party to file a petition if that party 16
141	141	has evidence of inaccurate, changed, or fraudulent 17
142	142	attestations or responses made by an FMOC to the 18
143	143	Secretary under subsection (e). 19

161	161	ANDCOMPLIANCEWITHDOTPROCESSES.— 7

163	163	DDITIONAL QUESTIONS .—The Secretary 8
164	164	shall require, as part of an application for approval 9
165	165	pursuant to section 107.807 of title 49, Code of 10
166	166	Federal Regulations (or a successor regulation), that 11
167	167	the applicant answer the following questions: 12
168	168	(A) Whether the FMOC applying, or any 13
169	169	entity controlling more than 10 percent of that 14
170	170	FMOC, has ever been subject to a civil mone-15
171	171	tary penalty under title 49, United States Code, 16
172	172	relating to any actions carried out as an ap-17
173	173	proved FMOC or during the application for ap-18
174	174	proval under that section. 19
175	175	(B) Whether the FMOC applying, or any 20
176	176	entity controlling more than 10 percent of that 21
177	177	FMOC, has been delinquent in the payment of 22
178	178	any civil monetary penalties or other fines or 23
179	179	fees under title 49, United States Code. 24

184	184	entity controlling more than 10 percent of that 2
185	185	FMOC, is subject to the Do Not Pay Initiative 3
186	186	established under section 3354 of title 31, 4
187	187	United States Code, as of the date of the appli-5
188	188	cation. 6
189	189	(D) Whether the FMOC applying, or any 7
190	190	entity controlling more than 10 percent of that 8
191	191	FMOC, is listed in the Military End User List 9
192	192	of the Department of Commerce as of the date 10
193	193	of the application. 11
194	194	(E) Whether the FMOC applying, or any 12
195	195	entity controlling more than 10 percent of that 13
196	196	FMOC, is identified by the Department of De-14
197	197	fense as an entity listed under section 1237 of 15
198	198	the Strom Thurmond National Defense Author-16
199	199	ization Act for Fiscal Year 1999 (50 U.S.C. 17
200	200	1701 note; Public Law 105–261) as of the date 18
201	201	of application. 19
202	202	(F) Whether the FMOC applying, or any 20
203	203	entity controlling more than 10 percent of that 21
204	204	FMOC, has been found guilty of a criminal 22
205	205	penalty or assessed a civil penalty under section 23
206	206	1760 of division A of the John S. McCain Na-24

213	213	entity controlling more than 10 percent of that 4
214	214	FMOC, is subject to a final antidumping or 5
215	215	countervailing duty order from the Department 6
216	216	of Commerce as of the date of application. 7
217	217	(2) D
218	218	ENIAL OF APPLICATION .—The Secretary 8
219	219	may deny under section 107.709 of title 49, Code of 9
220	220	Federal Regulations (or a successor regulation), an 10
221	221	application for approval under section 107.807 of 11
222	222	that title (or a successor regulation) based on the re-12
223	223	sponses to the questions required under paragraph 13
224	224	(1). 14

226	226	OREIGNMANUFACTURERS LISTINGAPPROV-15
227	227	ALS.—Not later than 1 year after the date of enactment 16
228	228	of this Act, and annually thereafter, the Secretary shall 17
229	229	publish and maintain on the website of the Pipeline and 18
230	230	Hazardous Materials Safety Administration a list of ap-19
231	231	proved foreign manufacturers of cylinders and the dura-20
232	232	tion of those approvals. 21
233	233	(g) A
234	234	UTHORIZING FOREIGNINSPECTIONS.—Not 22
235	235	later than 18 months after the date of enactment of this 23
236	236	Act, the Secretary shall revise section 107.807(d) of title 24
237	237	49, Code of Federal Regulations— 25

242	242	Secretary determines there is good cause, an inspec-2
243	243	tion under that section shall be carried out annually 3
244	244	for such duration as the Secretary determines appro-4
245	245	priate; 5
246	246	(2) to specify that a refusal of inspection under 6
247	247	that section shall result in a loss of the status of in 7
248	248	good standing; 8
249	249	(3) to allow the Secretary to request, at the dis-9
250	250	cretion of the Secretary— 10
251	251	(A) production of test and production 11
252	252	records; and 12
253	253	(B) random sample testing; and 13
254	254	(4) to allow for the recovery of all associated 14
255	255	costs of foreign inspections to include travel, time, 15
256	256	and other costs, as determined by the Secretary. 16
