2424 SECTION 1. SHORT TITLE. 3
2525 This Act may be cited as the ‘‘Supporting Disabled 4
2626 National Guardsmen Act’’. 5

3232 FORCES BASED ON DISABILITY INCURRED 3
3333 WHILE PERFORMING STATE ACTIVE DUTY. 4
3434 Section 1204 of title 10, United States Code, is 5
3535 amended— 6
3636 (1) in paragraph (2)(B)(i)— 7
3737 (A) by striking ‘‘active duty or inactive- 8
3838 duty training;’’ and inserting an em dash; and 9
3939 (B) by inserting before clause (ii) the fol-10
4040 lowing new subclauses: 11
4141 ‘‘(I) active duty; 12
4242 ‘‘(II) inactive-duty training; or 13
4343 ‘‘(III) State active duty (as that 14
4444 term is defined in section 4303 of title 15
4545 38);’’; 16
4646 (2) by inserting ‘‘(a) I
4747 NGENERAL.—’’ before 17
4848 ‘‘Upon a determination’’; and 18
4949 (3) by adding at the end the following new sub-19

5252 IMITATION.—In the case of a member retired 21
5353 under this section based on a disability described in sub-22
5454 clause (III) of subsection (a)(2)(B)(i), the Secretary con-23
5555 cerned shall reduce retired pay, computed under section 24
5656 1401 of this title and paid to such member, to the extent 25
5757 that the Secretary concerned determines such retired pay 26

6969 STABLISHMENT.—Subchapter VIII of chapter 8
7070 17 of title 38, United States Code, is amended by adding 9
7171 at the end the following new section: 10
7272 ‘‘§ 1789A. Health care for members of the National 11
7373 Guard who incur disabilities while per-12
7474 forming State active duty 13
7575 ‘‘(a) I
7676 NGENERAL.—Subject to subsection (b), a 14
7777 member of the National Guard who incurs a disability 15
7878 while performing State active duty shall be eligible for hos-16
7979 pital care and medical services furnished by the Secretary 17
8080 to treat such disability and any illness or condition arising 18
8181 from such disability. 19
8282 ‘‘(b) L
8383 IMITATION.—(1) The Secretary may only fur-20
8484 nish hospital care and medical services under subsection 21
8585 (a) to the extent and in the amount provided in advance 22
8686 in appropriations Acts for such purpose. 23
8787 ‘‘(2) The Secretary may provide reimbursement for 24
8888 hospital care or medical services provided to an individual 25

9393 of such care or services has exhausted without success all 2
9494 claims and remedies reasonably available to the individual 3
9595 or provider against a third party (as defined in section 4
9696 1725(f) of this title) for payment of such care or services, 5
9797 including with respect to health-plan contracts (as defined 6
9898 in such section). 7
9999 ‘‘(c) S
100100 TATEACTIVEDUTYDEFINED.—In this sec-8
101101 tion, the term ‘State active duty’ has the meaning given 9
102102 that term in section 4303 of this title.’’. 10

104104 LERICALAMENDMENT.—The table of sections 11
105105 at the beginning of such chapter is amended by inserting 12
106106 after the item relating to section 1789 the following new 13
107107 item: 14
