To amend the Higher Education Act of 1965 to require that any institution
of higher education that is a nonprofit organization under section
501(c)(3) of the Internal Revenue Code be deemed a nonprofit institution
of higher education for purposes of such Act.

To amend the Higher Education Act of 1965 to require

Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘IHE Nonprofit Clarity 4
Act’’. 5

SEC. 2. DEFINITION OF NONPROFIT INSTITUTION OF HIGH-1
ER EDUCATION. 2
Section 103(13) of the Higher Education Act of 1965 3
(20 U.S.C. 1003(13)) is amended by inserting at the end 4
the following: ‘‘Notwithstanding the preceding sentence, in 5
the case of an institution of higher education that is an 6
organization described in section 501(c)(3) of the Internal 7
Revenue Code and exempt from taxation under section 8
501(a) of such Code, such institution of higher education 9
shall be deemed to be a nonprofit institution of higher edu-10
cation for purposes of this Act.’’. 11
