To amend title XVIII of the Social Security Act to remove 
in-person requirements under Medicare for mental health 
services furnished through telehealth and telecommuni-
cations technology. 
Be it enacted by the Senate and House of Representa-1

SECTION 1. REMOVING THE IN-PERSON REQUIREMENTS 1
UNDER MEDICARE FOR MENTAL HEALTH 2
SERVICES FURNISHED THROUGH TELE-3
HEALTH AND TELECOMMUNICATIONS TECH-4
NOLOGY. 5
(a) I
NGENERAL.—Section 1834(m)(7) of the Social 6
Security Act (42 U.S.C. 1395m(m)(7)) is amended to read 7
as follows: 8
‘‘(7) T
REATMENT OF SUBSTANCE USE DIS -9
ORDER SERVICES AND MENTAL HEALTH SERVICES 10
FURNISHED THROUGH TELEHEALTH .—The geo-11
graphic requirements described in paragraph 12
(4)(C)(i) shall not apply with respect to telehealth 13
services furnished on or after July 1, 2020, to an el-14
igible telehealth individual with a substance use dis-15
order diagnosis for purposes of treatment of such 16
disorder or co-occurring mental health disorder, as 17
determined by the Secretary, or, on or after the first 18
day after the end of the emergency period described 19
in section 1135(g)(1)(B), to an eligible telehealth in-20
dividual for purposes of diagnosis, evaluation, or 21
treatment of a mental health disorder, as determined 22
by the Secretary, at an originating site described in 23
paragraph (4)(C)(ii) (other than an originating site 24
described in subclause (IX) of such paragraph) or, 25

for the period for which clause (iii) of paragraph 1
(4)(C) applies, at any site described in such clause.’’. 2

curity Act (42 U.S.C. 1395m(y)(2)) is amended by strik-5
ing ‘‘prior to April 1, 2025’’. 6

ENTALHEALTHVISITSFURNISHED BYFEDER-7
ALLY QUALIFIED HEALTH CENTERS.—Section 8
1834(o)(4)(B) of the Social Security Act (42 U.S.C. 9
1395m(o)(4)(B)) is amended by striking ‘‘prior to April 10
1, 2025’’. 11
