3333 ‘‘(A) a consistency determination provided 3
3434 to the coastal state by a Federal agency under 4
3535 subsection (c)(1)(C); 5
3636 ‘‘(B) a determination or other finding of a 6
3737 Federal agency under subsection (c)(2) that a 7
3838 development project in the coastal zone of the 8
3939 coastal state is consistent with the enforceable 9
4040 policies of the approved state management pro-10
4141 gram of the coastal state; 11
4242 ‘‘(C) a certification provided to the coastal 12
4343 state by an applicant under subsection 13
4444 (c)(3)(A) or person under subsection (c)(3)(B); 14
4545 and 15
4646 ‘‘(D) a determination or other finding of a 16
4747 State or local government under subsection (d) 17
4848 that an application for Federal assistance sub-18
4949 mitted by such State or local government is 19
5050 consistent with the enforceable policies of the 20
5151 approved state management program of the 21
5252 coastal state. 22

5454 IMITATION ON OBJECTION.—An objection 23
5555 or other challenge by a coastal state to an activity 24

6363 EVIEW OF PRESUMPTIVE CONCUR -3

6666 N GENERAL.—Not later than 30 5
6767 days after the Secretary receives a consistency 6
6868 determination, certification, or other relevant 7
6969 finding under this section, the Secretary may 8
7070 issue a written determination with respect to an 9
7171 activity subject to a conclusive presumption of 10
7272 concurrence under paragraph (1) that nullifies 11
7373 the conclusive presumption of concurrence if the 12
7474 Secretary finds that the activity is not a cov-13
7575 ered activity. 14
7676 ‘‘(B) P
7777 RESUMPTION OF FINALITY .—If the 15
7878 Secretary does not issue a written determina-16
7979 tion under subparagraph (A) with respect to an 17
8080 activity subject to a conclusive presumption of 18
8181 concurrence under paragraph (1) within the 19
8282 time period described in that subparagraph, the 20
8383 conclusive presumption of concurrence shall be 21
8484 final and binding. 22

8888 CTIVITY WITH A SIGNIFICANT NA -24
8989 TIONAL OR REGIONAL ECONOMIC IMPACT .—The 25

9494 gional economic impact’ means an activity— 2
9595 ‘‘(i) that is authorized or funded in 3
9696 whole or in part by the Federal Govern-4
9797 ment; and 5
9898 ‘‘(ii) that is carried out in— 6
9999 ‘‘(I) an area with a low per cap-7
100100 ita income; or 8
101101 ‘‘(II) an area with a high unem-9
102102 ployment rate. 10
103103 ‘‘(B) A
104104 REA WITH A HIGH UNEMPLOYMENT 11
105105 RATE.—The term ‘area with a high unemploy-12
106106 ment rate’ means an area where the unemploy-13
107107 ment rate, for the most recent 24-month period 14
108108 for which data is available, is at least 1 percent-15
109109 age point higher than the national average un-16
110110 employment rate for such period, as determined 17
111111 by the Secretary using the most recent data 18
112112 available from— 19
113113 ‘‘(i) the Bureau of Economic Analysis 20
114114 of the Department of Commerce; 21
115115 ‘‘(ii) the Bureau of Labor Statistics of 22
116116 the Department of Labor; 23
117117 ‘‘(iii) another Federal source the Sec-24
118118 retary determines appropriate; or 25

129129 come’ means an area where the per capita in-7
130130 come is not more than 20 percent less than the 8
131131 national average per capita income, as deter-9
132132 mined by the Secretary using the most recent 10
133133 data available from— 11
134134 ‘‘(i) the Bureau of Economic Analysis 12
135135 of the Department of Commerce; or 13
136136 ‘‘(ii) another Federal source the Sec-14
137137 retary determines appropriate. 15
138138 ‘‘(D) C
139139 OVERED ACTIVITY.—The term ‘cov-16
140140 ered activity’ means— 17
141141 ‘‘(i) a national security activity; 18
142142 ‘‘(ii) a critical infrastructure project; 19
143143 ‘‘(iii) a disaster recovery or mitigation 20
144144 activity; or 21
145145 ‘‘(iv) an activity with a significant na-22
146146 tional or regional economic impact. 23

149149 term ‘critical infrastructure’ has the meaning 25

157157 PROJECT.—The term ‘critical infrastructure 4
158158 project’ means any project— 5
159159 ‘‘(i) that is authorized or funded in 6
160160 whole or in part by the Federal Govern-7
161161 ment; and 8
162162 ‘‘(ii) that involves— 9
163163 ‘‘(I) the planning, construction, 10
164164 maintenance, or improvement of crit-11
165165 ical infrastructure; 12
166166 ‘‘(II) a facility or an activity as-13
167167 sociated with any critical infrastruc-14
168168 ture sectors; or 15
169169 ‘‘(III) a material or asset that is 16
170170 essential to the operation, mainte-17
171171 nance, or development of critical in-18
172172 frastructure. 19

175175 TORS.—The term ‘critical infrastructure sec-21
176176 tors’ has the meaning given the term in section 22
177177 2001 of the Homeland Security Act of 2002 (6 23
178178 U.S.C. 601). 24

183183 ACTIVITY.—The term ‘disaster recovery or miti-2
184184 gation activity’ means an activity— 3
185185 ‘‘(i) that is authorized or funded in 4
186186 whole or in part by the Federal Govern-5
187187 ment; and 6
188188 ‘‘(ii) that is carried out to prevent, 7
189189 prepare for, respond to, recover from, or 8
190190 mitigate the effects of— 9
191191 ‘‘(I) an emergency; 10
192192 ‘‘(II) a major disaster; or 11
193193 ‘‘(III) any other incident or 12
194194 threat that the Administrator of the 13
195195 Federal Emergency Management 14
196196 Agency determines poses a significant 15
197197 risk to public health, safety, or prop-16
198198 erty. 17
199199 ‘‘(I) E

201201 terms ‘emergency’ and ‘major disaster’ have 19
202202 such meanings given such terms in section 102 20
203203 of the Robert T. Stafford Disaster Relief and 21

207207 term ‘intelligence community’ has the meaning 24
