381381 ate, the procedures described in subpara-16
382382 graph (D) shall apply to consideration of 17
383383 the joint resolution of the House. 18

388388 ‘‘(i) as an exercise of the rulemaking 22

405405 XCLUSIONPROCESS; REPORT.—Section 232 of 10
406406 the Trade Expansion Act of 1962 (19 U.S.C. 1862) is 11
407407 amended by inserting after subsection (f) the following: 12
408408 ‘‘(g) A
409409 DMINISTRATION OFEXCLUSIONPROCESS.— 13
410410 ‘‘(1) I
411411 N GENERAL.—The United States Inter-14
412412 national Trade Commission shall administer a proc-15
413413 ess for granting requests for the exclusion of covered 16
414414 articles from any actions, including actions to im-17
415415 pose duties or quotas, taken by the President under 18
416416 subsection (c). 19
417417 ‘‘(2) R
418418 EQUIREMENTS.—In administering the 20
419419 process required by paragraph (1), the International 21
420420 Trade Commission shall— 22
421421 ‘‘(A) consider, when determining whether 23
422422 to grant an exclusion with respect to a covered 24
423423 article, if— 25

428428 the United States and is of sufficient qual-2
429429 ity, available in sufficient quantities, and 3
430430 available on a reasonable timeframe; 4
431431 ‘‘(ii) the failure to grant the exclusion 5
432432 would result in severe economic harm; and 6
433433 ‘‘(iii) the failure to grant the exclusion 7
434434 would impair the ability of the United 8
435435 States to maintain effective pressure to re-9
436436 move an unreasonable or discriminatory 10
437437 practice burdening United States com-11
438438 merce, and further if the International 12
439439 Trade Commission determines that— 13
440440 ‘‘(I) the article or a reasonable 14
441441 substitute is not commercially avail-15
442442 able to person requesting an exclusion 16
443443 under paragraph (1) with respect to a 17
444444 covered article; 18
445445 ‘‘(II) the imposition of the duty 19
446446 with respect to the article would un-20
447447 reasonably increase consumer prices 21
448448 for day-to-day items consumed by low- 22
449449 or middle-income families in the 23
450450 United States; 24

455455 would have an unreasonable impact on 2
456456 manufacturing output of the United 3
457457 States; 4
458458 ‘‘(IV) the imposition of the duty 5
459459 would have an unreasonable impact on 6
460460 the ability of an entity to fulfill con-7
461461 tracts or to build critical infrastruc-8
462462 ture; or 9
463463 ‘‘(V) the failure to grant the ex-10
464464 clusion is likely to result in a par-11
465465 ticular entity or entities having the 12
466466 ability to abuse a dominant market 13
467467 position; and 14
468468 ‘‘(B) ensure that an exclusion granted with 15
469469 respect to a covered article is available to any 16
470470 person that imports the covered article; 17
471471 ‘‘(C) not disclose business proprietary in-18
472472 formation; and 19
473473 ‘‘(D) establish guidelines to provide for— 20
