SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Maintaining Innova-4
tion and Safe Technologies Act’’. 5

SEC. 2. GUIDANCE ON MEDICARE PAYMENT FOR CERTAIN 1
ITEMS INVOLVING ARTIFICIAL INTEL-2
LIGENCE. 3
Not later than January 1, 2027, the Secretary of 4
Health and Human Services shall use existing communica-5
tions mechanisms to issue guidance on requirements for 6
payment under part B of title XVIII of the Social Security 7
Act (42 U.S.C. 1395j et seq.) for remote monitoring de-8
vices, such as continuous glucose monitors, that— 9
(1) use an artificial intelligence component 10
(such as a continuous adjustment component); and 11
(2) transmit information to a health care pro-12
vider for purposes of management and treatment of 13
an individual. 14
