18	18	To amend the Endangered Species Act of 1973 to prohibit
19	19	the taking for a trophy of any endangered or threatened
20	20	species of fish or wildlife in the United States and the
21	21	importation of endangered and threatened species tro-
22	22	phies into the United States, and for other purposes.
23	23	Be it enacted by the Senate and House of Representa-1
24	24	tives of the United States of America in Congress assembled, 2
25	25	SECTION 1. SHORT TITLE. 3
26	26	This Act may be cited as the ‘‘Prohibiting Threat-4
27	27	ened and Endangered Creature Trophies Act of 2025’’ or 5
28	28	the ‘‘ProTECT Act of 2025’’. 6

32	32	SEC. 2. FINDINGS. 1
33	33	The Congress finds the following: 2
34	34	(1) Trophy hunting of imperiled species under-3
35	35	mines efforts to conserve wildlife populations be-4
36	36	cause trophy hunters routinely target the biggest, 5
37	37	strongest males, and removing those individuals 6
38	38	from the population can decrease genetic variation, 7
39	39	decrease reproduction, alter social structures, in-8
40	40	crease infanticide, and cause unnatural evolutionary 9
41	41	impacts. 10
42	42	(2) When trophy hunting of imperiled species is 11
43	43	sanctioned, poaching activity increases, further 12
44	44	threatening the survival of wildlife populations. 13
45	45	(3) Legal trade in wildlife parts and products 14
46	46	can provide cover for markets for illegal trade in 15
47	47	wildlife products, which is worth up to 16
48	48	$20,000,000,000 annually and run by professional 17
49	49	criminal networks linked to other transnational orga-18
50	50	nized criminal activities, including trafficking in nar-19
51	51	cotics, weapons, and humans. 20
52	52	(4) While the Endangered Species Act of 1973 21
53	53	(16 U.S.C. 1531 et seq.) currently prohibits the take 22
54	54	and import of species listed under that Act as en-23
55	55	dangered species, it does not automatically extend 24
56	56	those protections to species listed as threatened spe-25
57	57	cies. 26

65	65	ROHIBITION OFTAKING ORIMPORTING.—Sec-4
66	66	tion 9 of the Endangered Species Act of 1973 (16 U.S.C. 5
67	67	1538) is amended by adding at the end the following: 6
68	68	‘‘(h) T
69	69	ROPHIES.—It is unlawful for any person sub-7
70	70	ject to the jurisdiction of the United States— 8
71	71	‘‘(1) to take for a trophy within the United 9
72	72	States or the territorial sea of the United States any 10
73	73	species of fish or wildlife listed under section 4 as 11
74	74	a threatened species; or 12
75	75	‘‘(2) to import into the United States any tro-13
76	76	phy of any species of fish or wildlife listed under sec-14
77	77	tion 4 as a threatened species.’’. 15

79	79	ROHIBITION OFPERMITS.—Section 10(a) of the 16
80	80	Endangered Species Act of 1973 (16 U.S.C. 1539(a)) is 17
81	81	amended— 18
82	82	(1) in paragraph (1), by striking ‘‘The Sec-19
83	83	retary may permit’’ and inserting ‘‘Except as other-20
84	84	wise provided in this subsection, the Secretary may 21
85	85	permit’’; and 22
86	86	(2) by adding at the end the following: 23
87	87	‘‘(3) The Secretary may not permit or otherwise 24
88	88	allow— 25

93	93	wildlife listed under section 4; or 2
94	94	‘‘(B) importing into the United States any tro-3
95	95	phy of any species of fish or wildlife listed under sec-4
96	96	tion 4, notwithstanding section 9(b).’’. 5

98	98	NTIQUES.—Section 10(h)(1) of the Endangered 6
99	99	Species Act of 1973 (16 U.S.C. 1539(h)(1)) is amended 7
100	100	by striking ‘‘Sections 4(d), 9(a), and 9(c) do not apply’’ 8
101	101	and inserting ‘‘Sections 4(d), 9(a), 9(c), and 9(h)(2) do 9
102	102	not apply’’. 10

104	104	EFINITION.—Section 3 of the Endangered Spe-11
105	105	cies Act of 1973 (16 U.S.C. 1532) is amended— 12
106	106	(1) by redesignating paragraph (21) as para-13
107	107	graph (22); and 14
108	108	(2) by inserting after paragraph (20) the fol-15
109	109	lowing: 16
110	110	‘‘(21) The term ‘trophy’ means a whole dead 17
111	111	animal, or a readily recognizable part or derivative 18
112	112	of an animal, that— 19
113	113	‘‘(A) is raw, processed, or manufactured; 20
114	114	and 21
115	115	‘‘(B) was obtained under a hunting license 22
116	116	or other authorization issued by any State, for-23
117	117	eign government, or private landowner.’’. 24
