A BILL 
To require the Secretary of Defense to request modifications 
relating to certain permits issued under the Federal 
Water Pollution Control Act, and for other purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Department of Defense 4
PFAS Discharge Prevention Act’’. 5

SEC. 2. STORMWATER DISCHARGE PERMITS FOR DEPART-1
MENT OF DEFENSE FACILITIES. 2
(a) R
EQUEST FORREVISION.—Not later than one 3
year after the date of enactment of this Act, the Secretary 4
of Defense shall, with respect to each permit under section 5
402(p) of the Federal Water Pollution Control Act (33 6
U.S.C. 1342(p)) that applies to a Department of Defense 7
facility, request from the State that issued the permit, or 8
the Administrator of the Environmental Protection Agen-9
cy, as applicable, approval of a modification to such per-10
mit, or a revision to an applicable stormwater manage-11
ment plan, to require— 12
(1) monitoring of discharges of perfluoroalkyl 13
and polyfluoroalkyl substances not less frequently 14
than quarterly; and 15
(2) implementation of appropriate best manage-16
ment practices or control technologies to reduce such 17
discharges consistent with the requirements of such 18
Act. 19
(b) F
UNDING.—Of the funds authorized to be appro-20
priated by this Act, or otherwise made available to the 21
Secretary in each fiscal year, for perfluoroalkyl and 22
polyfluoroalkyl substances remediation efforts, not less 23
than 1 percent shall be obligated or expended annually for 24

testing for such substances in stormwater runoff at De-1
partment of Defense facilities. 2
