To amend the Internal Revenue Code of 1986 to protect
small businesses from unemployment insurance premium
increases by reason of unrepaid State advances.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. PROTECTION OF SMALL BUSINESS FROM UN-3
EMPLOYMENT INSURANCE PREMIUM IN-4
CREASES BY REASON OF UNREPAID STATE 5
ADVANCES. 6
(a) I
NGENERAL.—Section 3302(c) of the Internal 7
Revenue Code of 1986 is amended by adding at the end 8
the following new paragraph: 9

‘‘(4) CREDITS OFSMALLBUSINESSESNOTRE-1

‘‘(A) I
N GENERAL.—Paragraph (2) shall not 3
apply with respect to any specified small business. 4
‘‘(B) S
PECIFIED SMALL BUSINESS .—For pur-5
poses of this paragraph, the term ‘specified small 6
business’ means any taxpayer if such taxpayer em-7
ploys fewer than 500 employees as of the close of 8
the third quarter of the calendar year immediately 9
preceding the second consecutive January 1 referred 10
to in paragraph (2)(A)(i).’’. 11
(b) E
FFECTIVEDATE.—The amendment made by 12
this section shall apply to taxable years beginning after 13
the date of the enactment of this Act. 14
