1616 Be it enacted by the Senate and House of Representa-1
1717 tives of the United States of America in Congress assembled, 2
1818 SECTION 1. SHORT TITLE. 3
1919 This Act may be cited as the ‘‘Agency Accountability 4
2020 and Cost Transparency Act of 2025’’. 5
2121 SEC. 2. REQUIREMENT TO IDENTIFY WHETHER MAJOR 6
2222 RULES ARE BUDGET NEUTRAL. 7
2323 (a) I
2424 NGENERAL.—The head of each agency shall— 8
2525 (1) before promulgating a major rule— 9
2626 (A) estimate the cost of the rule; 10

3030 (B) identify whether any rule of the agency 1
3131 may be repealed to offset the cost of the major 2
3232 rule; and 3
3333 (C) repeal any rule identified under sub-4
3434 paragraph (B); and 5
3535 (2) include a statement along with each major 6
3636 rule published in the Federal Register that identifies 7
3737 whether the rule is budget neutral. 8

3939 EFINITIONS.—In this section: 9
4040 (1) A
4141 GENCY.—The terms ‘‘agency’’ has the 10
4242 meaning given that term in section 551 of title 5, 11
4343 United States Code. 12
4444 (2) B
4545 UDGET NEUTRAL .—The term ‘‘budget 13
4646 neutral’’ means that the cost of the rule is equal to 14
4747 the total amount of costs to the public eliminated as 15
4848 a result of the repeal of any rule identified under 16
4949 paragraph (1)(B). 17

5151 OST OF THE RULE .—The term ‘‘cost of 18
5252 the rule’’ means the cost to the public of the rule, 19
5353 including any cost incurred to understand or imple-20
5454 ment the rule. 21

5656 AJOR RULE.—The term ‘‘major rule’’ 22
5757 means any rule, including an interim final rule, that 23
5858 the Administrator of the Office of Information and 24
5959 Regulatory Affairs of the Office of Management and 25

6363 Budget or the Federal agency promulgating such 1
6464 rule finds has resulted in or is likely to result in— 2
6565 (A) an annual effect on the economy of 3
6666 $100 million or more; 4
6767 (B) a major increase in costs or prices for 5
6868 consumers, individual industries, Federal, 6
6969 State, or local government agencies, or geo-7
7070 graphic regions; or 8
7171 (C) significant adverse effects on competi-9
7272 tion, employment, investment, productivity, in-10
7373 novation, or the ability of United States-based 11
7474 enterprises to compete with foreign-based enter-12
7575 prises in domestic and export markets. 13
7676 (5) R
7777 ULE.—The term ‘‘rule’’ has the meaning 14
7878 given such term in section 551, except that such 15
7979 term— 16
8080 (A) includes interpretative rules, general 17
8181 statements of policy, and all other agency guid-18
8282 ance documents; and 19
8383 (B) does not include— 20
8484 (i) any rule of particular applicability, 21
8585 including a rule that approves or pre-22
8686 scribes for the future rates, wages, prices, 23
8787 services, or allowances therefore, corporate 24
8888 or financial structures, reorganizations, 25

9292 mergers, or acquisitions thereof, or ac-1
9393 counting practices or disclosures bearing 2
9494 on any of the foregoing; 3
9595 (ii) any rule relating to agency man-4
9696 agement or personnel; or 5
9797 (iii) any rule of agency organization, 6
9898 procedure, or practice that does not sub-7
9999 stantially affect the rights or obligations of 8
