3636 SECTION 1. SHORT TITLE. 3
3737 This Act may be cited as the ‘‘Protect Our Proba-4
3838 tionary Employees Act’’. 5

4242 SEC. 2. RESUMPTION OF PROBATIONARY PERIOD. 1
4343 (a) I
4444 NGENERAL.—Notwithstanding any other provi-2
4545 sion of law, the duration of the probationary or trial period 3
4646 for a covered appointment of a covered probationary em-4
4747 ployee to become final shall be equal to the difference be-5
4848 tween— 6
4949 (1) the duration of such probationary or trial 7
5050 period that, but for this Act, would apply to such 8
5151 covered appointment; and 9
5252 (2) the duration of the probationary or trial pe-10
5353 riod that such covered probationary employee served 11
5454 in the previous Federal position of such covered pro-12
5555 bationary employee, to the extent that such duration 13
5656 does not exceed the duration described in paragraph 14
5757 (1). 15

5959 UNSET.—This Act shall terminate on January 16
6060 20, 2029. 17

6262 EFINITIONS.—In this Act— 18
6363 (1) C
6464 OVERED APPOINTMENT .—The term ‘‘cov-19
6565 ered appointment’’ means an appointment of a cov-20
6666 ered probationary employee to a position in the 21
6767 former employing agency of such covered proba-22
6868 tionary employee that, to the extent practicable, is 23
6969 the same as the previous Federal position of such 24
7070 covered probationary employee. 25

7474 (2) COVERED PROBATIONARY EMPLOYEE .—The 1
7575 term ‘‘covered probationary employee’’ means an in-2
7676 dividual who— 3
7777 (A) is, or was, involuntarily separated from 4
7878 Government service during the period beginning 5
7979 on January 20, 2025, and ending on the date 6
8080 specified in subsection (b); and 7
8181 (B) immediately prior to such separation, 8
8282 held a position in an Executive agency and 9
8383 serving a probationary or trial period under an 10
8484 initial appointment. 11

8686 XECUTIVE AGENCY.—The term ‘‘Executive 12
8787 agency’’ has the meaning given such term in section 13
8888 105 of title 5, United States Code. 14
8989 (4) F
9090 ORMER EMPLOYING AGENCY .—With re-15
9191 spect to a covered probationary employee, the term 16
9292 ‘‘former employing agency’’ means the Executive 17
9393 agency from which the separation of such individual 18
9494 made such individual a covered probationary em-19
9595 ployee. 20

9797 REVIOUS FEDERAL POSITION .—The term 21
9898 ‘‘previous Federal position’’ means the position in 22
9999 the Federal Government held by the covered proba-23
