1818 This Act may be cited as the ‘‘Federal Freeze Act’’. 4
1919 SEC. 2. FREEZE ON FEDERAL HIRING AND SALARIES. 5

2323 GENCY.—The term ‘‘agency’’ has the 7
2424 meaning given the term in section 551 of title 5, 8

2929 (2) BASELINE NUMBER .—The term ‘‘baseline 1
3030 number’’ means, with respect to an agency, the 2
3131 number of employees employed by the agency (in-3
3232 cluding individuals occupying full-time equivalent po-4
3333 sitions in the agency), as of the date of enactment 5
3434 of this Act. 6

3636 MPLOYEE.—The term ‘‘employee’’ means 7
3737 an employee of an agency. 8
3838 (b) G
3939 ENERALPROHIBITIONS.—Notwithstanding any 9
4040 other provision of law or regulation, during the 1-year pe-10
4141 riod beginning on the date of enactment of this Act, the 11
4242 following shall apply: 12
4343 (1)(A) Except as provided in subparagraph (B), 13
4444 the head of an agency may not increase the number 14
4545 of employees employed by the agency beyond the 15
4646 baseline number. 16
4747 (B) During the 1-year period beginning on the 17
4848 date of enactment of this Act, the head of an agency 18
4949 may appoint an individual to a position within the 19
5050 agency, even if appointing that individual would in-20
5151 crease the number of employees employed by the 21
5252 agency beyond the baseline number, if the agency 22
5353 head determines that making that appointment 23
5454 serves the interest of law enforcement, public safety, 24
5555 or the national security of the United States. 25

5959 (2) The annual rate of basic pay of an em-1
6060 ployee, as in effect on the date of enactment of this 2
6161 Act, may not be increased. 3

6363 EDUCTION INFORCE.—The head of each agency 4
6464 shall take such measures, without regard to any other pro-5
6565 vision of law or regulation, to ensure that— 6
6666 (1) as of the date that is 2 years after the date 7
6767 of enactment of this Act, the number of employees 8
6868 employed by the agency is 2 percent less than the 9
6969 baseline number; and 10
7070 (2) as of the date that is 3 years after the date 11
7171 of enactment of this Act, the number of employees 12
7272 employed by the agency is 5 percent less than the 13
7373 baseline number. 14
