35 | 35 | | ANCE.—For fiscal year 2023 and each fiscal year there-9 |

36 | 36 | | after, the Secretary shall withhold 100 percent of the 10 |
---|
37 | 37 | | amount required to be apportioned under each of sections 11 |
---|
38 | 38 | | 104(b)(1), 104(b)(3), and 104(b)(4) of this title to any 12 |
---|
39 | 39 | | State that is described in subsection (b). 13 |

42 | 42 | | subsection is a State that has enacted a law that allows 15 |

43 | 43 | | the State to provide a driver’s license or other identifica-16 |

44 | 44 | | tion card to an alien who is unlawfully present in the 17 |

50 | 50 | | subsection (a) from apportionment to any State shall 21 |

51 | 51 | | remain available until the end of the fiscal year for 22 |

68 | 68 | | held from a State under paragraph (1), the State 8 |

69 | 69 | | has not repealed the law described in subsection (b), 9 |
---|
70 | 70 | | the Secretary shall apportion the corresponding 10 |
---|
71 | 71 | | withheld funds described in subsection (a) on a pro-11 |
---|
72 | 72 | | portional basis to all remaining States that have not 12 |
---|
73 | 73 | | enacted laws described in subsection (b). 13 |

75 | 75 | | ITHHOLDING IN FUTURE YEAR .—In the 14 |

76 | 76 | | case in which a State has funds withheld under 15 |

77 | 77 | | paragraph (1) and is reapportioned funds under 16 |

78 | 78 | | paragraph (2) and subsequently enacts a law de-17 |
---|
79 | 79 | | scribed in subsection (b) after the date on which the 18 |

80 | 80 | | funds are reapportioned under paragraph (2), the 19 |
