2828 NGENERAL.—Chapter 1 of title 23, United 3
2929 States Code, is amended by adding at the end the fol-4
3030 lowing new section: 5
3131 ‘‘§ 180. Withholding of funds for providing identifica-6
3232 tion cards to certain aliens 7

3434 ITHHOLDING OF FUNDS FORNONCOMPLI-8
3535 ANCE.—For fiscal year 2023 and each fiscal year there-9
3636 after, the Secretary shall withhold 100 percent of the 10
3737 amount required to be apportioned under each of sections 11
3838 104(b)(1), 104(b)(3), and 104(b)(4) of this title to any 12
3939 State that is described in subsection (b). 13

4141 TATEDESCRIBED.—A State described in this 14
4242 subsection is a State that has enacted a law that allows 15
4343 the State to provide a driver’s license or other identifica-16
4444 tion card to an alien who is unlawfully present in the 17
4545 United States. 18
4646 ‘‘(c) E
4747 FFECT OFWITHHOLDINGFUNDS.— 19
4848 ‘‘(1) I
4949 N GENERAL.—Any funds withheld under 20
5050 subsection (a) from apportionment to any State shall 21
5151 remain available until the end of the fiscal year for 22
5252 which the funds are apportioned. 23
5353 ‘‘(2) R
5454 EAPPORTIONMENT.—If, before the last 24
5555 day of the fiscal year for which funds withheld under 25
5656 subsection (a) are apportioned to a State, the State 26

6060 repeals all laws of such State described in subsection 1
6161 (b), the Secretary shall, on the first day on which 2
6262 the State repeals all such laws, apportion to the 3
6363 State the funds withheld under subsection (a) that 4
6464 remain available for apportionment to the State. 5

6666 PPORTIONMENT AMONG STATES .—If, at 6
6767 the end of the fiscal year in which funds are with-7
6868 held from a State under paragraph (1), the State 8
6969 has not repealed the law described in subsection (b), 9
7070 the Secretary shall apportion the corresponding 10
7171 withheld funds described in subsection (a) on a pro-11
7272 portional basis to all remaining States that have not 12
7373 enacted laws described in subsection (b). 13
7474 ‘‘(4) W
7575 ITHHOLDING IN FUTURE YEAR .—In the 14
7676 case in which a State has funds withheld under 15
7777 paragraph (1) and is reapportioned funds under 16
7878 paragraph (2) and subsequently enacts a law de-17
7979 scribed in subsection (b) after the date on which the 18
8080 funds are reapportioned under paragraph (2), the 19
8181 Secretary shall withhold the amount of funds with-20
8282 held under subsection (a) in the fiscal year following 21
8383 the fiscal year in which such actions occur and each 22
8484 fiscal year thereafter. 23

8686 DENTIFICATIONCARDDEFINED.—The term 24
8787 ‘identification card’ means a personal identification card, 25
