A BILL
To prohibit the President and the Secretary of Health and
Human Services from declaring certain emergencies or
disasters for the purpose of imposing gun control.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Protecting the Right 4
to Keep and Bear Arms Act of 2025’’. 5

SEC. 2. LIMITATION ON DECLARATIONS BY PRESIDENT. 1
The President (or any designee thereof) shall not, for 2
the purpose of imposing gun control, declare an emergency 3
pursuant to the National Emergencies Act (50 U.S.C. 4
1601 et seq.) or an emergency or major disaster pursuant 5
to the Robert T. Stafford Disaster Relief and Emergency 6
Assistance Act (42 U.S.C. 5121 et seq.). 7
SEC. 3. LIMITATION ON DECLARATIONS BY HHS. 8
The Secretary of Health and Human Services shall 9
not, for the purpose of imposing gun control, declare a 10
public health emergency pursuant to section 319 of the 11
Public Health Service Act (42 U.S.C. 247d). 12
SEC. 4. FIREARMS POLICIES. 13
Section 706(a) of the Robert T. Stafford Disaster Re-14
lief and Emergency Assistance Act (42 U.S.C. 5207(a)) 15
is amended— 16
(1) in paragraph (3), by striking ‘‘; or’’ and in-17
serting a semicolon; 18
(2) in paragraph (4), by striking the period and 19
inserting a semicolon; and 20
(3) by adding at the end the following: 21
‘‘(5) prohibit the possession, manufacture, sale, 22
or transfer of arms, as protected by the Second 23
Amendment to the Constitution of the United 24
States; 25

‘‘(6) prohibit the possession, manufacture, sale, 1
or transfer of ammunition; 2
‘‘(7) prohibit the possession, manufacture, sale, 3
or transfer of ammunition feeding devices; or 4
‘‘(8) prohibit the possession, manufacture, sale, 5
or transfer of firearms accessories.’’. 6
