A BILL
To amend title II of the Social Security Act to eliminate
the waiting periods for disability insurance benefits and
Medicare coverage for individuals with metastatic breast
cancer, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Metastatic Breast Can-4
cer Access to Care Act’’. 5

SEC. 2. ELIMINATION OF WAITING PERIOD FOR INDIVID-1
UALS WITH METASTATIC BREAST CANCER. 2
(a) I
NGENERAL.—Section 223(a) of the Social Secu-3
rity Act (42 U.S.C. 423(a)) is amended— 4
(1) in paragraph (1), in the matter following 5
subparagraph (E), by inserting ‘‘or metastatic 6
breast cancer’’ after ‘‘amyotrophic lateral sclerosis’’; 7
and 8
(2) in paragraph (2)(B), by inserting ‘‘or (iii)’’ 9
after ‘‘clause (ii)’’. 10
(b) E
FFECTIVEDATE.—The amendments made by 11
this section shall apply with respect to applications for dis-12
ability insurance benefits filed after the date of the enact-13
ment of this Act. 14
SEC. 3. WAIVER OF 24-MONTH WAITING PERIOD FOR MEDI-15
CARE COVERAGE OF INDIVIDUALS WITH 16
METASTATIC BREAST CANCER. 17
(a) I
NGENERAL.—Section 226(h) of the Social Secu-18
rity Act (42 U.S.C. 426(h)) is amended by inserting ‘‘or 19
metastatic breast cancer’’ after ‘‘amyotrophic lateral scle-20
rosis (ALS)’’. 21
(b) E
FFECTIVEDATE.—The amendments made by 22
this section shall apply to benefits for months beginning 23
after the date of the enactment of this Act. 24
