2323 SEC. 2. STATE OF RESIDENCE. 6

2525 EFINITIONS.—Section 921 of title 18, United 7
2626 States Code, is amended— 8
2727 (1) in subsection (a)— 9

3434 ‘‘(38)(A) The term ‘State of residence’ means— 4
3535 ‘‘(i) the State in which an individual re-5

3737 ‘‘(ii) in the case of an individual, or spouse 7
3838 of an individual, who is an active duty member 8
3939 of the Armed Forces— 9
4040 ‘‘(I) the State in which the permanent 10
4141 duty station of the member is located; and 11
4242 ‘‘(II) the State in which the member 12
4343 maintains a place of abode from which the 13
4444 member commutes each day to the perma-14
4545 nent duty station of the member; or 15
4646 ‘‘(iii) in the case of an individual who does 16
4747 not have a physical residence in any State, the 17
4848 State in which an individual maintains a private 18
4949 mailbox or post office box. 19
5050 ‘‘(B) For purposes of subparagraph (A)(i)— 20
5151 ‘‘(i) an individual resides in a State if the 21
5252 individual is present in the State with the inten-22
5353 tion of making a home in that State; and 23
5454 ‘‘(ii) an individual who maintains a home 24
5555 in more than 1 State is a resident of each such 25

7878 ‘‘(II) the address for a private mail-18
7979 box or post office box maintained by the 19
8080 transferee, if the transferee does not have 20
