3535 SECTION 1. SHORT TITLE. 1
3636 This Act may be cited as the ‘‘Rights for the Trans-2
3737 portation Security Administration Workforce Act’’ or the 3
3838 ‘‘Rights for the TSA Workforce Act’’. 4
3939 SEC. 2. DEFINITIONS. 5
4040 In this Act— 6
4141 (1) the term ‘‘2022 Determination’’ means the 7
4242 publication, entitled ‘‘Determination on Transpor-8
4343 tation Security Officers and Collective Bargaining’’, 9
4444 issued on December 30, 2022, by Administrator 10
4545 David P. Pekoske, as modified, or any superseding 11
4646 subsequent determination; 12
4747 (2) the term ‘‘adjusted basic pay’’ means— 13
4848 (A) the rate of pay fixed by law or admin-14
4949 istrative action for a position occupied by a cov-15
5050 ered employee before any deductions; and 16
5151 (B) any regular, fixed supplemental pay-17
5252 ment for non-overtime hours of work creditable 18
5353 as basic pay for retirement purposes, including 19
5454 any applicable locality payment and any special 20
5555 rate supplement; 21
5656 (3) the term ‘‘Administration’’ means the 22
5757 Transportation Security Administration; 23
5858 (4) the term ‘‘Administrator’’ means the Ad-24

106106 N GENERAL.—Notwithstanding any other 14
107107 provision of law, effective as of the date of enact-15
108108 ment of this Act— 16
109109 (A) any TSA personnel management sys-17
110110 tem in use for covered employees and covered 18
111111 positions on the day before that date of enact-19
112112 ment, and any personnel management policy, 20
113113 letter, guideline, or directive of the Administra-21
114114 tion in effect on that day, may not be modified; 22
115115 (B) no personnel management policy, let-23
116116 ter, guideline, or directive of the Administration 24
117117 that was not established before that date issued 25

128128 terminate with respect to covered employees 8

133133 AY.—Notwithstanding paragraph 11
134134 (1)(A), the limitation in that paragraph shall 12
135135 not apply to any personnel management policy, 13
136136 letter, guideline, or directive of the Administra-14
137137 tion relating to annual adjustments to pay 15
138138 schedules and locality-based comparability pay-16
139139 ments in order to maintain parity with those 17
140140 adjustments authorized under sections 5303, 18
141141 5304, 5304a, and 5318 of title 5, United States 19
142142 Code; and 20
143143 (B) A
144144 DDITIONAL POLICY .—Notwith-21
145145 standing paragraph (1)(B), new personnel man-22
146146 agement policy of the Administration may be 23
147147 issued if— 24

167167 Administration relating to an emerging 15
168168 threat to transportation security, including 16
169169 national emergencies or disasters and pub-17
170170 lic health threats to transportation secu-18
171171 rity, may be modified or established until 19
172172 the conversion date. 20

174174 UBMISSION TO CONGRESS .—Not 21
175175 later than 7 days after the date on which 22
176176 any personnel management policy, letter, 23
177177 guideline, or directive of the Administra-24
178178 tion is modified or established under clause 25

193193 before the date of enactment of this Act, and any per-10

195195 of the Administration in effect on the day before the date 12
196196 of enactment of this Act, shall remain in effect until the 13
197197 conversion date. 14

201201 N GENERAL.—Except as provided in para-16
202202 graph (2), effective beginning on a date determined 17
203203 by the Secretary, but in no event later than Decem-18

206206 tems shall cease to be in effect; 21
207207 (B) section 114(n) of title 49, United 22
208208 States Code, is repealed; 23

221221 title 5, United States Code, with respect to cov-10
222222 ered employees or covered positions shall cease 11
223223 to be effective; and 12
224224 (F) covered employees and covered posi-13
225225 tions shall be subject to the provisions of title 14
226226 5, United States Code. 15

228228 HAPTERS 71 AND 77 OF TITLE 5 .—Not 16
229229 later than 90 days after the date of enactment of 17
230230 this Act— 18
231231 (A) chapters 71 and 77 of title 5, United 19
232232 States Code, shall apply to covered employees 20
233233 carrying out screening functions pursuant to 21
234234 section 44901 of title 49, United States Code; 22
235235 and 23
236236 (B) any policy, letter, guideline, or direc-24
237237 tive issued under section 111(d) of the Aviation 25

246246 SSISTANCE OF OTHER AGENCIES .—Not 5
247247 later than 180 days after the date of enactment of 6
248248 this Act, or December 31, 2025, whichever is ear-7
249249 lier— 8
250250 (A) the Director of the Office of Personnel 9
251251 Management shall establish a position series 10
252252 and classification standard for the positions of 11
253253 Transportation Security Officer, Federal air 12
254254 marshal, Transportation Security Inspector, 13
255255 and other positions requested by the Adminis-14
256256 trator; and 15
257257 (B) the National Finance Center of the 16
258258 Department of Agriculture shall make nec-17
259259 essary changes to Financial Management Serv-18
260260 ices and Human Resources Management Serv-19
261261 ices to ensure payroll, leave, and other per-20
262262 sonnel processing systems for covered employees 21
263263 are consistent with chapter 53 of title 5, United 22
264264 States Code, and provide functions as needed to 23
265265 implement this Act. 24

267267 AFEGUARDS ON GRIEVANCES ANDAPPEALS.— 25

271271 (1) IN GENERAL.—Each covered employee with 1
272272 a grievance or appeal pending within the Adminis-2
273273 tration on the date of enactment of this Act or initi-3
274274 ated during the transition period described in sub-4
275275 section (c) may have that grievance or appeal re-5
276276 moved to proceedings pursuant to title 5, United 6
277277 States Code, or continued within TSA. 7
278278 (2) A
279279 UTHORITY.—With respect to any griev-8
280280 ance or appeal continued within the Administration 9
281281 under paragraph (1), the Administrator may con-10
282282 sider and finally adjudicate that grievance or appeal 11
283283 notwithstanding any other provision of this Act. 12

285285 RESERVATION OF RIGHTS .—Notwith-13
286286 standing any other provision of law, any appeal or 14
287287 grievance continued under this section that is not fi-15
288288 nally adjudicated under paragraph (2) shall be pre-16
289289 served and all timelines tolled until the rights af-17
290290 forded by application of chapters 71 and 77 of title 18
291291 5, United States Code, are made available under 19
292292 subsection (c)(2). 20
293293 SEC. 4. TRANSITION RULES. 21

295295 ONREDUCTION IN PAY ANDCOMPENSATION.— 22
296296 Under such pay conversion rules as the Secretary may pre-23
297297 scribe to carry out this Act, a covered employee converted 24
298298 from a TSA personnel management system to the provi-25

304304 (1) may not be subject to any reduction in ei-3
305305 ther the rate of adjusted basic pay payable or law 4
306306 enforcement availability pay payable to that covered 5
307307 employee; and 6
308308 (2) shall be credited for years of service in a 7
309309 specific pay band under a TSA personnel manage-8
310310 ment system as if the covered employee had served 9
311311 in an equivalent General Schedule position at the 10
312312 same grade, for purposes of determining the appro-11
313313 priate step within a grade at which to establish the 12
314314 converted rate of pay of the covered employee. 13

316316 ETIREMENTPAY.— 14
317317 (1) I
318318 N GENERAL.—Not later than 90 days after 15
319319 the date of enactment of this Act, the Secretary 16
320320 shall submit to the appropriate congressional com-17
321321 mittees a proposal, including proposed legislative 18
322322 changes if needed, for determining the average pay 19
323323 of any covered employee who retires not later than 20
324324 3 years after the conversion date for purposes of cal-21
325325 culating the retirement annuity of the covered em-22
326326 ployee. 23

330330 (2) REQUIREMENTS.—The proposal required 1
331331 under paragraph (1) shall be structured in a manner 2
332332 that— 3
333333 (A) is consistent with title 5, United States 4
334334 Code; and 5
335335 (B) appropriately accounts for the service 6
336336 of a covered employee to which the proposal ap-7
337337 plies, and the annual rate of basic pay of such 8
338338 a covered employee, following the conversion 9
339339 date. 10

341341 IMITATION ONPREMIUMPAY.— 11
342342 (1) I
343343 N GENERAL.—Notwithstanding section 12
344344 5547 of title 5, United States Code, or any other 13
345345 provision of law, a Federal air marshal or criminal 14
346346 investigator who is appointed to that position before 15
347347 the date of enactment of this Act may be eligible for 16
348348 premium pay up to the maximum level allowed by 17
349349 the Administrator before the date of enactment of 18
350350 this Act. 19
351351 (2) OPM
352352 RECOGNITION.—The Director of the 20
353353 Office of Personnel Management shall recognize pre-21
354354 mium pay paid pursuant to paragraph (1) as fully 22
355355 creditable for the purposes of calculating pay and re-23
356356 tirement benefits. 24

366366 (A) in subsection (a)(2), in the matter pre-6
367367 ceding subparagraph (A), by striking ‘‘sub-7
368368 section (k)’’ and inserting ‘‘subsection (l)’’; 8
369369 (B) by redesignating subsection (k) as sub-9
370370 section (l); and 10
371371 (C) by inserting after subsection (j) the 11
372372 following: 12
373373 ‘‘(k) The provisions of subsections (a) through (h) 13
374374 providing for availability pay shall apply to any Federal 14
375375 air marshal who is an employee of the Transportation Se-15
376376 curity Administration.’’. 16

378378 VERTIME.—Section 5542 of title 5, United 17
379379 States Code, is amended by adding at the end the 18
380380 following: 19
381381 ‘‘(i) Notwithstanding any other provision of law, a 20
382382 Federal air marshal who is an employee of the Transpor-21
383383 tation Security Administration shall receive overtime pay 22
384384 under this section, at such a rate and in such a manner 23
385385 so that such Federal air marshal does not receive less 24
386386 overtime pay than such Federal air marshal would receive 25

391391 provisions of section 7 of the Fair Labor Standards Act 2
392392 of 1938 (29 U.S.C. 207).’’. 3

394394 FFECTIVE DATE.—The amendments made 4
395395 by paragraphs (1) and (2) shall apply beginning on 5
396396 the conversion date. 6
397397 (e) C
398398 OLLECTIVE BARGAINING UNIT.—Notwith-7
399399 standing section 7112 of title 5, United States Code, fol-8
400400 lowing the application of chapter 71 of that title pursuant 9
401401 to section 3(c)(2) of this Act, screening agents shall re-10
402402 main eligible to form a collective bargaining unit. 11
403403 (f) P
404404 RESERVATION OF OTHERRIGHTS.—The Sec-12
405405 retary shall take any actions necessary to ensure that the 13
406406 following rights are preserved and available for each cov-14
407407 ered employee beginning on the conversion date, and for 15
408408 any covered employee appointed after the conversion date, 16
409409 and continue to remain available to covered employees 17
410410 after the conversion date: 18
411411 (1) Any annual leave, sick leave, or other paid 19
412412 leave accrued, accumulated, or otherwise available to 20
413413 a covered employee immediately before the conver-21
414414 sion date shall remain available to the covered em-22
415415 ployee until used, subject to any limitation on accu-23
416416 mulated leave under chapter 63 of title 5, United 24
417417 States Code. 25

422422 under chapter 89 of title 5, United States Code, on 2
423423 the same basis as full-time covered employees. 3
424424 (3) Notwithstanding section 6329a of title 5, 4
425425 United States Code, covered employees are provided 5
426426 appropriate leave during national emergencies to as-6
427427 sist the covered employees and ensure the Adminis-7
428428 tration meets mission requirements. 8
429429 (4) Eligible screening agents receive a split-shift 9
430430 differential for regularly scheduled split-shift work 10
431431 as well as regularly scheduled overtime and irregular 11
432432 and occasional split-shift work. 12
433433 (5) Notwithstanding sections subsections (c), 13
434434 (e), and (f) of section 5754 of title 5, United States 14
435435 Code, eligible covered employees receive group reten-15
436436 tion incentives, as appropriate. 16
437437 SEC. 5. CONSULTATION REQUIREMENT. 17

439439 XCLUSIVEREPRESENTATIVE.— 18

443443 PPLICATION.—Beginning on the date 20
444444 that chapter 71 of title 5, United States Code 21
445445 (referred to in this subsection as ‘‘chapter 71’’), 22
446446 begins to apply to covered employees under sec-23
447447 tion 3(c)(2), the labor organization certified by 24
448448 the Federal Labor Relations Authority on June 25

458458 ULE OF CONSTRUCTION .—Nothing in 6
459459 this subsection may be construed to prevent 7
460460 covered employees from selecting an exclusive 8
461461 representative other than the labor organization 9
462462 described in paragraph (1) for purposes of col-10
463463 lective bargaining under chapter 71. 11

465465 ATIONAL LEVEL.— 12
466466 (A) I
467467 N GENERAL.—Notwithstanding any 13
468468 provision of chapter 71, collective bargaining 14
469469 for any unit of covered employees shall occur at 15
470470 the national level, but may be supplemented by 16
471471 local level bargaining and local level agreements 17

625625 ceived race, ethnicity, religion, gender identity, 21
626626 or sexuality of an individual; and 22
627627 (B) in which the alleged perpetrator is a 23
628628 member of the general public. 24

697697 bers of the general public against screening agents 10
698698 since January 1, 2019. 11
699699 (2) Procedures for reporting the assaults and 12
700700 threats described in paragraph (1), including infor-13
701701 mation on how the Administrator communicates the 14
702702 availability of those procedures. 15
703703 (3) Any steps taken by the Administration to 16
704704 prevent and respond to the assaults and threats de-17
705705 scribed in paragraph (1). 18
706706 (4) Any related civil actions and criminal refer-19
707707 rals made annually since January 1, 2019. 20
708708 (5) Any additional authorities needed by the 21
709709 Administrator to better prevent or respond to the as-22
