A BILL
To amend section 236A of the Immigration and Nationality
Act with respect to the requirement to cross reference
the terrorist screening database.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Identifying Potential 4
Terrorist at the Border Act of 2025’’. 5
SEC. 2. REQUIREMENT TO REVIEW FEDERAL TERRORIST 6
SCREENING DATABASE. 7
Section 236A of the Immigration and Nationality Act 8
(8 U.S.C. 1226A) is amended— 9
(1) in subsection (a)(3)— 10

(A) in subparagraph (A), by striking ‘‘; 1
or’’; 2
(B) in subparagraph (B), by striking the 3
period at the end and insert ‘‘; or’’; and 4
(C) by adding at the end the following: 5
‘‘(C) is on the terrorist screening data-6
base.’’; and 7
(2) by adding at the end the following: 8

EQUIREMENT TOREVIEWFEDERALTER-9
RORISTSCREENINGDATABASE.—Notwithstanding any 10
other provision of law, the Commissioner of U.S. Customs 11
and Border Protection shall take into and maintain cus-12
tody over an alien until the Commissioner cross references 13
the name of such alien with the terrorist screening data-14
base and a result for such cross reference is received by 15
the Commissioner. 16
‘‘(e) T
ERRORISTSCREENINGDATABASEDEFINED.— 17
In this section, the term ‘terrorist screening database’ 18
shall have the meaning given such term in section 2101 19
of the Homeland Security Act of 2002.’’. 20
