3434 SECTION 1. SHORT TITLE. 3
3535 This Act may be cited as the ‘‘Preventing Illegal 4
3636 Weapons Trafficking Act of 2025’’. 5

4141 In this Act— 2
4242 (1) the term ‘‘machinegun’’ has the meaning 3
4343 given the term ‘‘machine gun’’ in section 5845 of 4
4444 the Internal Revenue Code of 1986; and 5
4545 (2) the term ‘‘machinegun conversion device’’ 6
4646 means any part designed and intended solely and ex-7
4747 clusively, or combination of parts designed and in-8
4848 tended, for use in converting a weapon into a ma-9
4949 chinegun. 10
5050 SEC. 3. PREVENTION AND INTERCEPTION STRATEGY. 11

5252 TRATEGY.— 12

5454 N GENERAL.—Not later than 120 days 13
5555 after the date of enactment of this Act, the Attorney 14
5656 General, the Secretary of Homeland Security, and 15
5757 the Secretary of the Treasury shall develop and im-16
5858 plement a strategy to prevent or intercept the impor-17
5959 tation or trafficking of machinegun conversion de-18
6060 vices. 19

6262 ONTENTS.—The strategy described in 20
6363 paragraph (1) shall include plans to optimize— 21
6464 (A) the capacity of Federal law enforce-22
6565 ment agencies to detect, intercept, and seize 23
6666 machinegun conversion devices; 24
6767 (B) the coordination between State and 25
6868 local law enforcement agencies and Federal law 26

7373 Alcohol, Tobacco, Firearms, and Explosives, the 2
7474 Federal Bureau of Investigation, Homeland Se-3
7575 curity Investigations, and U.S. Customs and 4
7676 Border Protection, when machinegun conversion 5
7777 devices are seized at ports of entry; 6
7878 (C) efforts by the Bureau of Alcohol, To-7
7979 bacco, Firearms, and Explosives to collaborate 8
8080 with State and local law enforcement agencies 9
8181 to identify and trace machinegun conversion de-10
8282 vices used in crimes, including identifying the 11
8383 source of the device, whether from a foreign 12
8484 country or the United States; 13
8585 (D) training programs provided by Federal 14
8686 law enforcement agencies to aid State and local 15
8787 law enforcement agencies in identifying ma-16
8888 chinegun conversion devices; 17
8989 (E) the investigation and collection of data 18
9090 regarding the origins of machinegun conversion 19
9191 devices that are seized at ports of entry or re-20
9292 covered by law enforcement agencies in the 21
9393 United States in order to identify patterns and 22
9494 detect vulnerabilities; and 23
9595 (F) the capacity of Federal law enforce-24
9696 ment agencies, including the Bureau of Alcohol, 25

109109 NITIAL REPORT.—Not later than 120 days 8
110110 after the date of enactment of this Act, the Attorney 9
111111 General, the Secretary of Homeland Security, and 10
112112 the Secretary of the Treasury shall submit a report 11
113113 on the strategy developed and implemented under 12
114114 subsection (a), which shall include relevant statis-13
115115 tical information, to— 14
116116 (A) the Committee on the Judiciary of the 15
117117 Senate; 16
118118 (B) the Committee on Homeland Security 17
119119 and Governmental Affairs of the Senate; 18
120120 (C) the Committee on the Judiciary of the 19
121121 House of Representatives; and 20
122122 (D) the Committee on Homeland Security 21
123123 of the House of Representatives. 22

125125 ERIODIC UPDATES.—Not less frequently 23
126126 than once every 2 years, the Attorney General, the 24

134134 scribes progress made on the implementation of the 4
135135 strategy developed under subsection (a). 5
136136 SEC. 4. FORFEITURE OF PROCEEDS FROM MACHINE GUN 6
137137 VIOLATIONS. 7
138138 Section 5872 of the Internal Revenue Code of 1986 8
139139 is amended— 9
140140 (1) in subsection (a), by inserting ‘‘, and any 10
141141 proceeds derived from the illegal trafficking of a ma-11
142142 chine gun,’’ after ‘‘provisions of this chapter’’; and 12
143143 (2) by adding at the end the following: 13
144144 ‘‘(c) I
145145 LLEGALTRAFFICKING OF AMACHINEGUN.— 14
146146 For purposes of subsection (a), the term ‘illegal trafficking 15
147147 of a machine gun’ means the making, manufacture, impor-16
148148 tation, exportation, or transfer of a machine gun in viola-17
149149 tion of the provisions of this chapter or any regulations 18
150150 prescribed under this chapter.’’. 19
151151 SEC. 5. GUN TRAFFICKING REPORT. 20
152152 The Attorney General shall include information about 21
153153 machinegun conversion devices in the annual firearms 22
154154 trafficking report announced by the President on April 7, 23
155155 2021, including— 24
