24	24	Be it enacted by the Senate and House of Representa-1
25	25	tives of the United States of America in Congress assembled, 2
26	26	SECTION 1. SHORT TITLE. 3
27	27	This Act may be cited as the ‘‘Children’s Hospital 4
28	28	GME Support Reauthorization Act of 2025’’. 5

35	35	Section 340E of the Public Health Service Act (42 4
36	36	U.S.C. 256e) is amended— 5
37	37	(1) in subsection (a), by striking ‘‘2023’’ and 6
38	38	inserting ‘‘2030’’; 7
39	39	(2) in subsection (b)(3)(D), by inserting ‘‘and 8
40	40	the end of fiscal year 2030,’’ after ‘‘fiscal year 9
41	41	2022,’’; 10
42	42	(3) in subsection (e), by adding at the end the 11
43	43	following new paragraph: 12
44	44	‘‘(4) P
45	45	ROHIBITION ON PAYMENTS TO HOS -13
46	46	PITALS FURNISHING SPECIFIED PROCEDURES AND 14
47	47	DRUGS TO MINORS.— 15
48	48	‘‘(A) I
49	49	N GENERAL.—Notwithstanding any 16
50	50	other provision of this section, no payment may 17
51	51	be made under this section to a children’s hos-18
52	52	pital for a fiscal year (beginning with fiscal year 19
53	53	2026) if, at any point during the preceding fis-20
54	54	cal year, such hospital furnished specified pro-21
55	55	cedures and drugs (as defined in subsection (g)) 22
56	56	to an individual under 18 years of age. 23
57	57	‘‘(B) S
58	58	PECIAL RULE FOR FISCAL YEAR 24
59	59	2026.—In applying subparagraph (A) with re-25

65	65	‘‘(i) the reference to ‘for a fiscal year’ 3
66	66	shall be treated as a reference to ‘for any 4
67	67	portion of fiscal year 2026 occurring after 5
68	68	December 31, 2025’; and 6
69	69	‘‘(ii) the reference to ‘the preceding 7
70	70	fiscal year’ shall be treated as a reference 8
71	71	to ‘the period beginning on September 1, 9
72	72	2025, and ending on December 31, 2025’. 10

74	74	ULE OF CONSTRUCTION .—Nothing 11
75	75	in this paragraph shall be construed as prohib-12
76	76	iting payments for a fiscal year (or, in the case 13
77	77	of payments for fiscal year 2026, during the 14
78	78	portion of such fiscal year described in subpara-15
79	79	graph (B)(i)) to a hospital that, during the pre-16
80	80	ceding fiscal year (or, in the case of payments 17
81	81	for fiscal year 2026, during the period de-18
82	82	scribed in subparagraph (B)(ii)), furnished 19
83	83	mental or behavioral health services to individ-20
84	84	uals under 18 years of age for the treatment of 21
85	85	gender dysphoria not consisting of specified 22
86	86	procedures and drugs.’’; 23
87	87	(4) in subsection (f)— 24
88	88	(A) in paragraph (1)(A)— 25

151	151	artificial implants in the gluteal re-2

153	153	‘‘(ii) Administering, supplying, pre-4
154	154	scribing, dispensing, distributing, or other-5
155	155	wise conveying to an individual medications 6
156	156	for the purposes described in clause (i), in-7
157	157	cluding gonadotrophin releasing hormone 8
158	158	(GnRH) analogues or other puberty-block-9
159	159	ing drugs to stop or delay normal puberty, 10
160	160	and estrogen, testosterone, progesterone, 11
161	161	or other androgens to an individual in an 12
162	162	amount greater than would normally be 13
163	163	produced endogenously in a healthy indi-14
164	164	vidual of that individual’s age and sex. 15
165	165	‘‘(B) E
166	166	XCEPTION.—Subparagraph (A) 16
167	167	shall not apply to the provision by a physician 17
168	168	or health care provider, with the consent of the 18
169	169	child’s parent or legal guardian, of— 19
170	170	‘‘(i) puberty suppression or blocking 20
171	171	prescription drugs for the purpose of nor-21
172	172	malizing puberty for a minor experiencing 22
173	173	precocious puberty; 23

181	181	disorder of sex development, includ-5

183	183	‘‘(aa) 46,XX chromosomes 7
184	184	with virilization; 8
185	185	‘‘(bb) 46,XY chromosomes 9
186	186	with undervirilization; and 10
187	187	‘‘(cc) both ovarian and tes-11
188	188	ticular tissue; or 12
189	189	‘‘(II) sex chromosome structure, 13
190	190	sex steroid hormone production, or 14
191	191	sex hormone action, if determined to 15
192	192	be abnormal by a physician through 16
193	193	genetic or biochemical testing; 17
194	194	‘‘(iii) infection, disease, injury, or dis-18
195	195	order caused or exacerbated by previous 19
196	196	medical procedures as defined in sub-20
197	197	section (g)(4)(A); or 21
198	198	‘‘(iv) a physical disorder, physical in-22
199	199	jury, or physical illness that would, as cer-23
200	200	tified by a physician, place the individual 24
201	201	in imminent danger of death or impair-25

207	207	the procedure or drug is for the purpose 3
208	208	described in subsection (g)(4)(A)(i). 4

210	210	EX.—For purposes of subparagraph 5
211	211	(A), the term ‘sex’ means the indication of male 6
212	212	or female sex by reproductive potential or ca-7
213	213	pacity, sex chromosomes, naturally occurring 8
214	214	sex hormones, gonads, or internal or external 9
215	215	genitalia present at birth.’’. 10
