17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘TANF State Expendi-4
21	21	ture Integrity Act of 2025’’. 5
22	22	SEC. 2. AUTHORITY TO PREVENT AND ADDRESS INTEN-6
23	23	TIONAL MISUSE OF SUBRECIPIENT FUNDS 7
24	24	UNDER THE TANF PROGRAM. 8
25	25	(a) I
26	26	NGENERAL.—Section 417 of the Social Security 9
27	27	Act (42 U.S.C. 617) is amended— 10

38	38	UBRECIPIENT MONITORING .— 6
39	39	‘‘(A) I
40	40	N GENERAL.—The Secretary— 7
41	41	‘‘(i) shall develop a framework for the 8
42	42	monitoring of subrecipient use of funds 9
43	43	provided under section 403(a)(1) of this 10
44	44	Act, for the purpose of identifying inten-11
45	45	tional misuse, to supplement single State 12
46	46	audits conducted under chapter 75 of title 13
47	47	31, United States Code; 14
48	48	‘‘(ii) may establish State plan require-15
49	49	ments or formats relating to clause (i); and 16
50	50	‘‘(iii) may require States to report to 17
51	51	the Secretary such information to supple-18
52	52	ment the report provided under section 19
53	53	411(a) as the Secretary determines is nec-20
54	54	essary to enable the Secretary to comply 21
55	55	with clauses (i) and (ii) of this subpara-22
56	56	graph. 23

58	58	O EFFECT ON SINGLE STATE AUDIT 24
59	59	AUTHORITY.—Clause (i) of this subparagraph 25

64	64	the Secretary to conduct single State audits 2
65	65	under chapter 75 of title 31, United States 3

68	68	ROGRAM INTEGRITY UNIT AUTHORIZA -5
69	69	TION AND FUNDING.— 6
70	70	‘‘(A) TANF
71	71	PROGRAM INTEGRITY UNIT .— 7
72	72	The Secretary shall create a TANF Program 8
73	73	Integrity Unit at the Administration for Chil-9
74	74	dren & Families, which shall conduct the moni-10
75	75	toring described in paragraph (1)(A)(i). 11
76	76	‘‘(B) A
77	77	PPROPRIATION.—Out of any money 12
78	78	in the Treasury not otherwise appropriated, the 13
79	79	amount made available in section 403(a)(1)(C) 14
80	80	for each fiscal year shall be increased by 15
81	81	$10,000,000, and the amount of the increase 16
82	82	shall be available for the staffing and oper-17
83	83	ations of the TANF Program Integrity Unit 18
84	84	and related functions. 19
85	85	‘‘(3) A
86	86	NNUAL REPORT TO THE CONGRESS .— 20
87	87	The Secretary shall submit an annual report to the 21
88	88	Congress on the activities undertaken under para-22
89	89	graph (2)(A) in the fiscal year covered by the re-23
90	90	port.’’. 24

94	94	(b) REMEDIES.—Section 409(a)(1)(B) of such Act 1
95	95	(42 U.S.C. 609(a)(1)(B)) is amended— 2

108	108	Secretary finds, as a result of subrecipient 11
109	109	monitoring under section 417(b)(1) of this 12
110	110	Act, that an amount has been intentionally 13
111	111	misused in violation of this part, then the 14
112	112	Secretary shall— 15
113	113	‘‘(I) notify the State involved of 16
114	114	the finding; and 17
115	115	‘‘(II) in addition to any penalty 18
116	116	imposed under clause (i), require the 19
117	117	State to expend, in addition to any 20
118	118	other amount required to be expended 21
119	119	under the State program funded 22
120	120	under this part, an amount equal to 23
121	121	the amount so misused, for the provi-24
122	122	sion of cash assistance directly to 25

136	136	ULEMAKING.—Within 2 years after the date of the en-9
137	137	actment of this Act, the Secretary of Health and Human 10
138	138	Services shall publish a notice of rulemaking to implement 11
139	139	the amendments made by this section. 12

141	141	FFECTIVEDATE.—The amendments made by 13
142	142	this section shall take effect on the later of— 14
143	143	(1) the 1st day of the 5th calendar quarter that 15
144	144	begins after the date of the enactment of this Act; 16
145	145	or 17
146	146	(2) the 1st day of the 1st Federal fiscal year 18
147	147	that begins after such date of enactment. 19
