19	19	To amend titles XVIII and XIX of the Social Security Act,
20	20	title XXVII of the Public Health Service Act, and the
21	21	National Organ Transplant Act to prohibit certain organ
22	22	transplants with specified connections to the People’s

29	29	SECTION 1. SHORT TITLE. 1
30	30	This Act may be cited as the ‘‘Block Organ Trans-2
31	31	plant Purchases from China Act of 2025’’ or the ‘‘Block 3
32	32	Act of 2025’’. 4
33	33	SEC. 2. PROHIBITING CERTAIN ORGAN TRANSPLANTS. 5
34	34	(a) M
35	35	EDICARE.—Section 1862(a) of the Social Secu-6
36	36	rity Act (42 U.S.C. 1395y(a)) is amended— 7
37	37	(1) in paragraph (24), by striking ‘‘or’’ at the 8
38	38	end; 9
39	39	(2) in paragraph (25), by striking the period at 10
40	40	the end and inserting ‘‘; or’’; and 11
41	41	(3) by inserting after paragraph (25) the fol-12
42	42	lowing new paragraph: 13
43	43	‘‘(26) where such expenses are for— 14
44	44	‘‘(A) a prohibited organ transplant (as de-15
45	45	fined in section 402(d) of the National Organ 16
46	46	Transplant Act) furnished on or after January 17
47	47	1, 2026; or 18
48	48	‘‘(B) any item or service furnished on or 19
49	49	after January 1, 2026, in connection with such 20
50	50	a prohibited organ transplant, including a fol-21
51	51	low-up appointment, laboratory test, or drug, 22
52	52	unless such item or service is furnished to save 23
53	53	the life of an individual after such individual re-24
54	54	ceives such a prohibited organ transplant.’’. 25

61	61	cial Security Act (42 U.S.C. 1396a(a)) is amend-2

63	63	(A) in paragraph (86), by striking ‘‘and’’ 4

65	65	(B) in paragraph (87)(D), by striking the 6
66	66	period at the end and inserting ‘‘; and’’; and 7

70	70	under the plan for— 11
71	71	‘‘(A) a prohibited organ transplant (as de-12
72	72	fined in section 402(d) of the National Organ 13
73	73	Transplant Act) furnished on or after January 14
74	74	1, 2026; or 15
75	75	‘‘(B) any item or service furnished on or 16
76	76	after January 1, 2026, in connection with such 17
77	77	a prohibited organ transplant, including a fol-18
78	78	low-up appointment, laboratory test, or drug, 19
79	79	unless such item or service is furnished to save 20
80	80	the life of an individual after such individual re-21
81	81	ceives such a prohibited organ transplant.’’. 22

110	110	TIES.—Section 1903(i) of the Social Security Act 21
111	111	(42 U.S.C. 1396b(i)), as amended by paragraph (2), 22

113	113	paragraph (28) by striking ‘‘and (18)’’ and inserting 24

122	122	300gg–11 et seq.) is amended by adding at the end 4
123	123	the following new section: 5
124	124	‘‘SEC. 2730. PROHIBITION ON COVERAGE FOR CERTAIN 6
125	125	ORGAN TRANSPLANTS. 7
126	126	‘‘A group health plan, and a health insurance issuer 8
127	127	offering group or individual health insurance coverage, 9
128	128	may not provide coverage for— 10
129	129	‘‘(1) a prohibited organ transplant (as defined 11
130	130	in section 402(d) of the National Organ Transplant 12
131	131	Act); or 13
132	132	‘‘(2) any item or service furnished in connection 14
133	133	with such a prohibited organ transplant, including a 15
134	134	follow-up appointment, laboratory test, or drug, un-16
135	135	less such item or service is furnished to save the life 17
136	136	of an individual after such individual receives such 18
137	137	a prohibited organ transplant.’’. 19

139	139	FFECTIVE DATE.—The amendment made 20
140	140	by paragraph (1) shall apply with respect to plan 21
141	141	years beginning on or after January 1, 2026. 22

154	154	ROHIBITION.—Beginning on January 1, 2026, 5
155	155	no health care provider may furnish— 6
156	156	‘‘(1) a prohibited organ transplant; or 7
157	157	‘‘(2) any item or service in connection with such 8
158	158	a prohibited organ transplant, including a follow-up 9
159	159	appointment, laboratory test, or drug, unless such 10
160	160	item or service is furnished to save the life of an in-11
161	161	dividual after such individual receives such a prohib-12
162	162	ited organ transplant. 13

164	164	RIMINALPENALTY.—Any person who know-14
165	165	ingly violates subsection (a) shall be fined under title 18, 15
166	166	United States Code, imprisoned for not more than 2 years, 16
167	167	or both. 17

171	171	N GENERAL.—The Attorney General or 19
172	172	the attorney general of a State where the prohibited 20
173	173	organ transplant or item or service described in sub-21
174	174	section (a) is furnished may bring a civil action in 22
175	175	the appropriate United States district court against 23
176	176	any person who knowingly violates subsection (a) 24
177	177	and, upon proof of such violation by a preponder-25

182	182	a civil penalty equal to three times the cost of fur-2
183	183	nishing such prohibited organ transplant or item or 3
184	184	service (as determined by the Secretary of Health 4
185	185	and Human Services). 5

187	187	UTHORITY TO INTERVENE .—The Attor-6
188	188	ney General may intervene in any civil action 7
189	189	brought by the attorney general of a State under 8
190	190	paragraph (1). 9
191	191	‘‘(d) D
192	192	EFINITIONS.—In this section: 10
193	193	‘‘(1) H
194	194	EALTH CARE PROVIDER .—The term 11
195	195	‘health care provider’ has the meaning given such 12
196	196	term in section 1171 of the Social Security Act. 13
197	197	‘‘(2) P
198	198	ROHIBITED ORGAN TRANSPLANT .—The 14
199	199	term ‘prohibited organ transplant’ means the trans-15
200	200	plantation of a specified human organ that— 16
201	201	‘‘(A) occurs in the People’s Republic of 17
202	202	China; or 18
203	203	‘‘(B) transplants a specified human organ 19
204	204	that is not procured through the Organ Pro-20
205	205	curement and Transplantation Network estab-21
206	206	lished under section 372 of the Public Health 22
207	207	Service Act. 23

209	209	PECIFIED HUMAN ORGAN .—The term 24
210	210	‘specified human organ’ means the human (including 25

215	215	row, cornea, eye, bone, intestine (including the 2
216	216	esophagus, stomach, small intestine, large intestine, 3
217	217	and any other portion of the gastrointestinal tract), 4
218	218	any vascularized composite allograft (as defined in 5
219	219	section 121.2 of title 42, Code of Federal Regula-6
220	220	tions (or any successor regulation)), or any subpart 7
221	221	thereof (including that derived from a fetus).’’. 8

223	223	ULEMAKING.—Not later than January 1, 2026, 9
224	224	the Secretary of Health and Human Services shall issue 10
225	225	such rules as are necessary to identify— 11
226	226	(1) the items and services prohibited under the 12
227	227	amendments made by this section; and 13
228	228	(2) the cost of furnishing a prohibited organ 14
229	229	transplant (as defined in section 402(d) of the Na-15
230	230	tional Organ Transplant Act, as amended by this 16
231	231	Act) or such items and services for purposes of cal-17
232	232	culating the civil penalty under the amendments 18
233	233	made by subsection (d). 19
