3636 URPOSE.—The purpose of this subsection 4
3737 is to encourage States to improve State-level cement, 5
3838 concrete, asphalt binder, and asphalt mixture speci-6
3939 fications and standards to facilitate the purchase of 7
4040 low-emissions cement, concrete, asphalt binder, or 8
4141 asphalt mixtures. 9

4343 STABLISHMENT.—The Administrator of 10
4444 the Federal Highway Administration (referred to in 11
4545 this section as the ‘‘Administrator’’) shall provide to 12
4646 States— 13
4747 (A) reimbursement for the additional cost 14
4848 of using low-emissions cement, concrete, asphalt 15
4949 binder, and asphalt mixtures used in highway 16
5050 projects of the State; 17
5151 (B) incentives for the acquisition of low- 18
5252 emissions cement, concrete, asphalt binder, and 19
5353 asphalt mixtures for use in highway projects of 20
5454 the State; 21
5555 (C) technical assistance to update the spec-22
5656 ifications and standards of the State to be per-23
5757 formance-based specifications and standards; 24
5858 and 25

6565 EIMBURSEMENT AND INCENTIVE 3
6666 AMOUNTS.— 4

6868 EIMBURSEMENT AMOUNT .—The 5
6969 amount of reimbursement under paragraph 6
7070 (2)(A) shall be equal to the incrementally high-7
7171 er cost of using such materials relative to the 8
7272 cost of using traditional materials, as deter-9
7373 mined by the State and verified by the Adminis-10
7474 trator. 11

7676 NCENTIVE AMOUNT .—The amount of 12
7777 an incentive under paragraph (2)(B) shall be 13
7878 equal to 2 percent of the cost of using low-emis-14
7979 sions cement, concrete, asphalt binder, and as-15
8080 phalt mixtures on a highway project of the 16
8181 State. 17

8383 IMITATION.—Amounts provided for 18
8484 reimbursement and incentives under this sub-19
8585 section may not exceed the amount authorized 20
8686 to be appropriated under paragraph (6). 21

9797 such as environmental product declarations, that fa-3
9898 cilitate the purchase of low-emissions cement, con-4
9999 crete, asphalt binder, and asphalt mixtures. 5

101101 OORDINATION.—In carrying out this sub-6
102102 section, the Administrator shall leverage the Every 7
103103 Day Counts Initiative of the Department of Trans-8
104104 portation to promote the commercialization of low- 9
105105 emissions cement, concrete, asphalt binder, and as-10
106106 phalt mixtures. 11

108108 UTHORIZATION OF APPROPRIATIONS .— 12
109109 There is authorized to be appropriated to the Sec-13
110110 retary to carry out this subsection $15,000,000 for 14
111111 the period of fiscal years 2025 through 2027. 15

113113 IRECTORY OFLOW-EMISSIONCEMENT, CON-16
114114 CRETE, ASPHALTBINDER, ORASPHALTMIXTURES.— 17
115115 (1) I
116116 N GENERAL.—The Administrator shall es-18
117117 tablish and maintain a publicly available directory of 19
118118 low-emissions cement, concrete, asphalt binder, or 20
119119 asphalt mixtures submitted by States that the Ad-21
120120 ministrator determines to be eligible for reimburse-22
121121 ment or incentives under subsection (a). 23

123123 UBMISSION AND APPROVAL .— 24

128128 days after the date of enactment of this Act, 2
129129 the Administrator shall establish a procedure 3
130130 under which States may submit new low-emis-4
131131 sions cement, concrete, asphalt binder, or as-5
132132 phalt mixtures to be included in the directory 6
133133 under paragraph (1). 7
134134 (B) S
135135 UBMISSION.—To be considered for 8
136136 inclusion in the directory under paragraph (1), 9
137137 a State shall submit an application relating to 10
138138 the low-emissions cement, concrete, asphalt 11
139139 binder, or asphalt mixture to the Administrator 12
140140 at such time, in such manner, and containing 13
141141 such information as the Administrator deter-14
142142 mines to be necessary. 15

144144 ECISION DEADLINE.—Not later than 16
145145 180 days after the date on which the Adminis-17
146146 trator receives an application under subpara-18
147147 graph (B), the Administrator shall— 19
148148 (i) approve the application and include 20
149149 the low-emissions cement, concrete, asphalt 21
150150 binder, or asphalt mixture in the directory 22
151151 under paragraph (1); or 23
152152 (ii) deny the application. 24

162162 ROJECT SELECTION .—Low-emissions ce-6
163163 ment, concrete, asphalt binder, or asphalt mixtures 7
164164 approved under paragraph (2)(C)(i) and included in 8
165165 the directory under paragraph (1) may be used in 9
166166 any highway project. 10
167167 SEC. 3. ADVANCE PURCHASE COMMITMENT PROGRAM. 11

169169 URPOSE.—The purposes of this section are— 12
170170 (1) to allow States to purchase or contractually 13
171171 guarantee the direct purchase of conforming low- 14
172172 emissions cement, concrete, asphalt binder, or as-15
173173 phalt mixtures; and 16
174174 (2) to encourage continuous innovation and 17
175175 long-term emissions reductions in the production of 18
176176 concrete, cement, asphalt binder, and asphalt mix-19
177177 tures. 20

179179 LIGIBLEPROJECTS.—Section 133 of title 23, 21
180180 United States Code, is amended— 22
181181 (1) in subsection (b) by adding at the end the 23
182182 following: 24

187187 tive, domestically produced cement, concrete, asphalt 2
188188 mixture, or asphalt binder manufactured using a 3
189189 process described in subsection (l). 4
190190 ‘‘(26) Subject to subsection (m), a project that 5
191191 is carried out through an advance multiyear contract 6
192192 with a producer for a specified quantity and speci-7
193193 fied price of innovative, domestically produced ce-8
194194 ment, concrete, asphalt mixture, or asphalt binder 9
195195 manufactured using a process described in sub-10
196196 section (l).’’; and 11
197197 (2) by adding at the end the following: 12
198198 ‘‘(l) R
199199 EQUIREMENTS FOR CERTAINPROJECTS.—The 13
200200 process referred to in paragraphs (25) and (26) of sub-14
201201 section (b) is a manufacturing process that— 15
202202 ‘‘(1) produces materials with— 16
203203 ‘‘(A) superior durability to conventional 17
204204 materials; and 18
205205 ‘‘(B) superior performance with respect 19
206206 to— 20
207207 ‘‘(i) compressive strength; 21
208208 ‘‘(ii) tensile strength; or 22
209209 ‘‘(iii) workability; or 23

214214 ing specifications of the State and achieve superior 2
215215 performance with respect to— 3
216216 ‘‘(A) environmental performance; or 4
217217 ‘‘(B) energy efficiency.’’. 5

219219 TATEFLEXIBILITY.—Section 133(h)(6) of title 6
220220 23, United States Code, is amended by adding at the end 7
221221 the following: 8
222222 ‘‘(D) P
223223 ROCUREMENT FOR INNOVATIVE 9
224224 BUILDING MATERIALS.— 10
225225 ‘‘(i) I
226226 N GENERAL.—A State may use 11
227227 the funds set aside under this subsection 12
228228 to enter into an advance multi-year con-13
229229 tract described in subsection (m) for a 14
230230 specified quantity and specified price of in-15
231231 novative, domestically produced cement, 16
232232 concrete, asphalt mixture, or asphalt bind-17
233233 er. 18
234234 ‘‘(ii) U
235235 SE OF FUNDS.—States may not 19
236236 provide payments to the producer as part 20
237237 of the advance procurement under clause 21
238238 (i) unless materials have been delivered ac-22
239239 cording to contract terms and conditions.’’. 23

243243 (d) LIMITATION.—Section 133 of title 23, United 1
244244 States Code, is further amended by adding at the end the 2
245245 following: 3
246246 ‘‘(m) A
247247 DVANCEMULTI-YEARCONTRACTS.—Except 4
248248 as otherwise provided in this section, none of the funds 5
249249 made available under this section may be used for a multi- 6
250250 year contract unless— 7
251251 ‘‘(1) cancellation provisions in the contract do 8
252252 not include consideration of recurring manufacturing 9
253253 costs of the producer associated with the production 10
254254 of unfunded units to be delivered under the contract; 11
255255 ‘‘(2) the contract provides that payments to the 12
256256 producer under the contract shall not be made in ad-13
257257 vance of incurred costs on funded units; 14
258258 ‘‘(3) the contract does not provide for a price 15
259259 adjustment based on a failure to award a follow-on 16
260260 contract; 17
261261 ‘‘(4) the producer submits a statement describ-18
262262 ing the quantity and cost of the cement, concrete, 19
263263 asphalt mixture, and asphalt binder; 20
264264 ‘‘(5) the producer demonstrates material steps 21
265265 towards commercial production and operational ca-22
266266 pacity of cement, concrete, asphalt mixture, or as-23
267267 phalt binder production with respect to logistics, 24
268268 planned material storage, handling capacities, and 25

273273 material progress towards commercial production 2
274274 and operational capacity may result in termination 3
275275 of a portion or all of the advance procurement at the 4
276276 sole discretion of the State; and 5
277277 ‘‘(6) the contract fulfills, to the maximum ex-6
278278 tent possible, preference criteria set by the State.’’. 7

280280 OW-EMISSIONSCEMENT, CONCRETE, ANDAS-8
281281 PHALTDEFINED.—In this Act, the term ‘‘low-emissions 9
282282 cement, concrete, and asphalt’’ means cement, concrete, 10
283283 asphalt binder, or asphalt mixture that reduces, to the 11
284284 maximum extent practicable, greenhouse gas or directly 12
285285 related pollutant emissions to levels below commercially 13
286286 available cement, concrete, or asphalt. 14
