3535 SEC. 2. COUNTERING TRANSNATIONAL REPRESSION. 5

3737 NGENERAL.—Subtitle H of title VIII of the 6
3838 Homeland Security Act of 2002 (6 U.S.C. 361 et seq.) 7
3939 is amended by adding at the end the following new section: 8
4040 ‘‘SEC. 890E. STRENGTHENING STATE AND LOCAL LAW EN-9
4141 FORCEMENT EFFORTS TO COUNTER 10
4242 TRANSNATIONAL REPRESSION AND TER-11
4343 RORISM THREATS RELATED TO 12
4444 TRANSNATIONAL REPRESSION. 13
4545 ‘‘(a) I
4646 NGENERAL.—The Secretary, in consultation 14
4747 with public and private sector stakeholders, shall, in a 15
4848 manner consistent with the protection of privacy rights, 16
4949 civil rights, and civil liberties, develop, through the Fed-17
5050 eral Law Enforcement Training Centers and in coordina-18
5151 tion with the Assistant Secretary for State and Local Law 19
5252 Enforcement and the Under Secretary for Intelligence and 20
5353 Analysis, a training program to enhance the capabilities 21
5454 of State, local, Tribal, campus, and territorial law enforce-22
5555 ment personnel, including personnel of the National Net-23
5656 work of Fusion Centers, to counter transnational repres-24
5757 sion and terrorism threats related to transnational repres-25
5858 sion. 26

6363 oped pursuant to subsection (a) shall relate to the fol-2

6565 ‘‘(1) Identifying instances of transnational re-4
6666 pression and terrorism threats related to 5
6767 transnational repression. 6
6868 ‘‘(2) Types of information that should be col-7
6969 lected and recorded in information technology sys-8
7070 tems to help identify suspected perpetrators of 9
7171 transnational repression and terrorism threats re-10
7272 lated to transnational repression. 11
7373 ‘‘(3) Types of information that should be 12
7474 shared routinely with the private sector, including 13
7575 faith-based organizations, educational institution au-14
7676 thorities, and communities that may be targets or 15
7777 are victims of transnational repression and terrorism 16
7878 threats related to transnational repression. 17
7979 ‘‘(4) Identifying suspected targets or victims of 18
8080 transnational repression and terrorism threats re-19
8181 lated to transnational repression. 20
8282 ‘‘(5) Personal safety best practices for individ-21
8383 uals and communities that may be targets or are vic-22
8484 tims of transnational repression and terrorism 23
8585 threats related to transnational repression to prevent 24
8686 and mitigate transnational repression and terrorism 25

9393 port resources, including such resources offered by 4
9494 the Cybersecurity and Infrastructure Security Agen-5
9595 cy, United States Citizenship and Immigration Serv-6
9696 ices, and the Office for Civil Rights and Civil Lib-7
9797 erties, to address the immediate and long-term needs 8
9898 of such targets and victims. 9
9999 ‘‘(c) P
100100 ROVISION OFCERTAINTRAININGS.—Trainings 10
101101 developed pursuant to subsection (a) shall be provided by 11
102102 the Federal Law Enforcement Training Centers or an-12
103103 other office or component of the Department if the Direc-13
104104 tor of the Federal Law Enforcement Training Centers de-14
105105 termines such other office or component is accredited by 15
106106 the Federal Law Enforcement Training Accreditation 16
107107 Model Practice Clearinghouse or pursuant to a substan-17
108108 tially similar process. 18
109109 ‘‘(d) C
110110 OMMUNITYAWARENESSBRIEFINGS.—The As-19
111111 sistant Secretary of Partnership and Engagement and the 20
112112 Officer for Civil Rights and Civil Liberties, in coordination 21
113113 with the Under Secretary for Intelligence and Analysis, 22
114114 as appropriate, shall engage with State, local, Tribal, cam-23
115115 pus, and territorial law enforcement personnel, including 24
116116 personnel of the National Network of Fusion Centers, and 25

131131 ERSONAL SAFETY BEST PRACTICES .— 10
132132 The term ‘personal safety best practices’ means 11
133133 measures for enhancing individuals’ and commu-12
134134 nities’ physical security, situational awareness, and 13
135135 online security. 14
136136 ‘‘(2) T
137137 RANSNATIONAL REPRESSION .—The term 15
138138 ‘transnational repression’ means an action of a for-16
139139 eign government or an agent of a foreign govern-17
140140 ment that satisfies each of the following: 18
141141 ‘‘(A) The action involves any of the fol-19
142142 lowing: 20
143143 ‘‘(i) Any effort intended to coerce, 21
144144 harass, or digitally or physically threaten, 22
145145 including by force or reasonable fear of 23
146146 death or serious bodily injury or imprison-24
147147 ment of a person or an immediate family 25

155155 coerce, including by force or reasonable 5
156156 fear of death or serious bodily injury or 6
157157 imprisonment, a person to forebear from 7
158158 exercising the First Amendment rights of 8
159159 such person or any other right guaranteed 9
160160 to the person by the Constitution or laws 10
161161 of the United States, or to retaliate 11
162162 against a person for having exercised such 12
163163 a right. 13
164164 ‘‘(iii) An extrajudicial killing. 14
165165 ‘‘(iv) Any act intended to further the 15
166166 efforts specified in clause (i), (ii), or (iii). 16
167167 ‘‘(B) The action is engaged in for or in the 17
168168 interests of such a foreign government. 18
169169 ‘‘(C) The action— 19
170170 ‘‘(i) occurs, in whole or in part, in the 20
171171 United States; or 21
172172 ‘‘(ii) is committed against a United 22

187187 ordinate with the Under Secretary for Science and Tech-7
188188 nology and the Assistant Secretary for State and Local 8
189189 Law Enforcement of the Department of Homeland Secu-9
190190 rity to— 10
191191 (1) carry out research and development of a 11
192192 technology to enhance participation rates in training 12
193193 offered to other State, local, Tribal, campus, and 13
194194 territorial law enforcement personnel, including per-14
195195 sonnel of the National Network of Fusion Centers, 15
196196 for the purpose of enhancing domestic preparedness 16
197197 for and collective response to transnational repres-17
198198 sion and terrorism threats related to transnational 18
199199 repression and other homeland security threats; and 19
200200 (2) share information relating to researching 20
201201 and developing methods for identifying instances, 21
202202 suspected targets, and victims of transnational re-22
203203 pression and terrorism threats related to 23
204204 transnational repression, and methods for collecting 24
205205 and recording information to help identify suspected 25

213213 than two years after the date of the enactment of this Act, 4
214214 the Comptroller General of the United States shall submit 5
215215 to Congress a report on the implementation of section 6
216216 890E of the Homeland Security Act of 2002, as added 7
217217 by subsection (a). 8

219219 LERICALAMENDMENT.—The table of contents 9
220220 in section 1(b) of the Homeland Security Act of 2002 is 10
221221 amended by inserting after the item relating to section 11
222222 890D the following new item: 12
223223 ‘‘Sec. 890E. Strengthening State and local law enforcement efforts to counter
224224 transnational repression and terrorism threats related to
225225 transnational repression.’’.
