To amend the Clean Air Act to ensure that tailpipe
regulations do not limit the availability of new motor vehicles.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Choice in Automobile 4
Retail Sales Act of 2025’’. 5
SEC. 2. ENSURING TAILPIPE REGULATIONS DO NOT LIMIT 6
THE AVAILABILITY OF NEW MOTOR VEHI-7
CLES. 8
(a) I
NGENERAL.—Section 202(a)(2) of the Clean 9
Air Act (42 U.S.C. 7521(a)(2)) is amended— 10

(1) by striking ‘‘(2) Any regulation’’ and insert-1
ing ‘‘(2)(A) Any regulation’’; and 2
(2) by adding at the end the following: 3
‘‘(B) Any regulation proposed or prescribed, in-4
cluding any revision to a regulation, under para-5
graph (1) on or after January 1, 2021, shall not— 6
‘‘(i) mandate the use of any specific tech-7
nology; or 8
‘‘(ii) result in limited availability of new 9
motor vehicles based on the type of new motor 10
vehicle engine in such new motor vehicles.’’. 11
(b) N
ECESSARYREVISIONS TOREGULATIONS.—Not 12
later than 24 months after the date of enactment of this 13
Act, the Administrator of the Environmental Protection 14
Agency shall promulgate such revisions to regulations as 15
may be necessary to conform such regulations to section 16
202(a)(2)(B) of the Clean Air Act, as added by subsection 17
(a). 18
