15	15	Be it enacted by the Senate and House of Representa-1
16	16	tives of the United States of America in Congress assembled, 2
17	17	SECTION 1. SHORT TITLE. 3
18	18	This Act may be cited as the ‘‘Spectrum Coordination 4
19	19	Act’’. 5
20	20	SEC. 2. IMPROVING SPECTRUM MANAGEMENT. 6
21	21	Part A of the National Telecommunications and In-7
22	22	formation Administration Organization Act is amended by 8
23	23	adding at the end the following: 9

29	29	EDERALCOORDINATIONPROCEDURES.— 2
30	30	‘‘(1) N
31	31	OTICE.—With respect to each spectrum 3
32	32	action, the Assistant Secretary shall file in the pub-4
33	33	lic record with respect to such spectrum action, not 5
34	34	later than the end of the period for submitting com-6
35	35	ments to the Commission with respect to such spec-7
36	36	trum action, information (redacted as necessary if 8
37	37	the information is protected from disclosure for a 9
38	38	reason described in paragraph (3)) regarding— 10
39	39	‘‘(A) the date on which the Commission 11
40	40	provided to the Assistant Secretary notice of 12
41	41	the spectrum action, as required under the 13
42	42	Memorandum; 14
43	43	‘‘(B) the Federal entities that may be im-15
44	44	pacted by the spectrum action; 16
45	45	‘‘(C) the date on which the Assistant Sec-17
46	46	retary provided to the Federal entities described 18
47	47	in subparagraph (B) notice of the spectrum ac-19
48	48	tion; 20
49	49	‘‘(D) a summary of technical or procedural 21
50	50	concerns, if any, of Federal entities with respect 22
51	51	to the spectrum action; and 23
52	52	‘‘(E) a summary of policy concerns, if any, 24
53	53	of the Assistant Secretary with respect to the 25
54	54	spectrum action. 26

58	58	‘‘(2) FINAL RULE.—If the Commission promul-1
59	59	gates a final rule under section 553 of title 5, 2
60	60	United States Code, involving a spectrum action, the 3
61	61	Commission shall prepare, make available to the 4
62	62	public, and publish in the Federal Register along 5
63	63	with the final rule an interagency coordination sum-6
64	64	mary that describes— 7
65	65	‘‘(A) the date on which the Commission 8
66	66	provided to the Assistant Secretary notice of 9
67	67	the spectrum action, as required under the 10
68	68	Memorandum; 11
69	69	‘‘(B) whether concerns were raised under 12
70	70	subparagraph (D) or subparagraph (E) of para-13
71	71	graph (1) and, if so, the concerns raised; and 14
72	72	‘‘(C) how any such concerns were resolved. 15
73	73	‘‘(3) R
74	74	ULE OF CONSTRUCTION .—Nothing in 16
75	75	this subsection may be construed to require the dis-17
76	76	closure of classified information, or other informa-18
77	77	tion reflecting technical, procedural, or policy con-19
78	78	cerns that are exempt from disclosure under section 20
79	79	552 of title 5, United States Code. 21
80	80	‘‘(b) M
81	81	EMORANDUM.— 22
82	82	‘‘(1) M
83	83	EMORANDUM UPDATES .—Not later than 23
84	84	3 years after the date of the enactment of this sec-24
85	85	tion, and not less frequently than every 4 years 25

89	89	thereafter, the Commission and the NTIA shall up-1
90	90	date the Memorandum. 2
91	91	‘‘(2) N
92	92	ATURE OF UPDATES .—In updating the 3
93	93	Memorandum under paragraph (1), the Commission 4
94	94	and the NTIA shall ensure that each update reflects 5
95	95	changing technological, procedural, and policy cir-6
96	96	cumstances, as determined necessary and appro-7
97	97	priate by the Commission and the NTIA. 8
98	98	‘‘(c) D
99	99	EFINITIONS.—In this section: 9
100	100	‘‘(1) M
101	101	EMORANDUM.—The term ‘Memorandum’ 10
102	102	means the Memorandum of Understanding between 11
103	103	the Commission and the NTIA (relating to increased 12
104	104	coordination between Federal spectrum management 13
105	105	agencies to promote the efficient use of the radio 14
106	106	spectrum in the public interest), signed on August 1, 15
107	107	2022, or any successor memorandum. 16
108	108	‘‘(2) S
109	109	PECTRUM ACTION.—The term ‘spectrum 17
110	110	action’ means any proposed action by the Commis-18
111	111	sion to reallocate radio frequency spectrum that is 19
112	112	anticipated to result in a system of competitive bid-20
113	113	ding conducted under section 309(j) of the Commu-21
114	114	nications Act of 1934 (47 U.S.C. 309(j)) or licens-22
115	115	ing that could potentially impact the spectrum oper-23
116	116	ations of a Federal entity.’’. 24
