3131 OTICE.—With respect to each spectrum 3
3232 action, the Assistant Secretary shall file in the pub-4
3333 lic record with respect to such spectrum action, not 5
3434 later than the end of the period for submitting com-6
3535 ments to the Commission with respect to such spec-7
3636 trum action, information (redacted as necessary if 8
3737 the information is protected from disclosure for a 9
3838 reason described in paragraph (3)) regarding— 10
3939 ‘‘(A) the date on which the Commission 11
4040 provided to the Assistant Secretary notice of 12
4141 the spectrum action, as required under the 13
4242 Memorandum; 14
4343 ‘‘(B) the Federal entities that may be im-15
4444 pacted by the spectrum action; 16
4545 ‘‘(C) the date on which the Assistant Sec-17
4646 retary provided to the Federal entities described 18
4747 in subparagraph (B) notice of the spectrum ac-19
4848 tion; 20
4949 ‘‘(D) a summary of technical or procedural 21
5050 concerns, if any, of Federal entities with respect 22
5151 to the spectrum action; and 23
5252 ‘‘(E) a summary of policy concerns, if any, 24
5353 of the Assistant Secretary with respect to the 25
5454 spectrum action. 26

5858 ‘‘(2) FINAL RULE.—If the Commission promul-1
5959 gates a final rule under section 553 of title 5, 2
6060 United States Code, involving a spectrum action, the 3
6161 Commission shall prepare, make available to the 4
6262 public, and publish in the Federal Register along 5
6363 with the final rule an interagency coordination sum-6
6464 mary that describes— 7
6565 ‘‘(A) the date on which the Commission 8
6666 provided to the Assistant Secretary notice of 9
6767 the spectrum action, as required under the 10
6868 Memorandum; 11
6969 ‘‘(B) whether concerns were raised under 12
7070 subparagraph (D) or subparagraph (E) of para-13
7171 graph (1) and, if so, the concerns raised; and 14
7272 ‘‘(C) how any such concerns were resolved. 15
7373 ‘‘(3) R
7474 ULE OF CONSTRUCTION .—Nothing in 16
7575 this subsection may be construed to require the dis-17
7676 closure of classified information, or other informa-18
7777 tion reflecting technical, procedural, or policy con-19
7878 cerns that are exempt from disclosure under section 20
7979 552 of title 5, United States Code. 21

8383 EMORANDUM UPDATES .—Not later than 23
8484 3 years after the date of the enactment of this sec-24
8585 tion, and not less frequently than every 4 years 25

9292 ATURE OF UPDATES .—In updating the 3
9393 Memorandum under paragraph (1), the Commission 4
9494 and the NTIA shall ensure that each update reflects 5
9595 changing technological, procedural, and policy cir-6
9696 cumstances, as determined necessary and appro-7
9797 priate by the Commission and the NTIA. 8
9898 ‘‘(c) D
9999 EFINITIONS.—In this section: 9
100100 ‘‘(1) M
101101 EMORANDUM.—The term ‘Memorandum’ 10
102102 means the Memorandum of Understanding between 11
103103 the Commission and the NTIA (relating to increased 12
104104 coordination between Federal spectrum management 13
105105 agencies to promote the efficient use of the radio 14
106106 spectrum in the public interest), signed on August 1, 15
107107 2022, or any successor memorandum. 16
108108 ‘‘(2) S
109109 PECTRUM ACTION.—The term ‘spectrum 17
110110 action’ means any proposed action by the Commis-18
111111 sion to reallocate radio frequency spectrum that is 19
112112 anticipated to result in a system of competitive bid-20
113113 ding conducted under section 309(j) of the Commu-21
114114 nications Act of 1934 (47 U.S.C. 309(j)) or licens-22
115115 ing that could potentially impact the spectrum oper-23
116116 ations of a Federal entity.’’. 24
