3838 (a) I
3939 NGENERAL.—Section 1877 of the Social Secu-4
4040 rity Act (42 U.S.C. 1395nn) is amended— 5
4141 (1) in subsection (d)— 6
4242 (A) in paragraph (2)(C), by inserting 7
4343 ‘‘(other than a covered rural hospital (as de-8
4444 fined in subsection (h)))’’ after ‘‘a hospital’’; 9
4545 and 10
4646 (B) in paragraph (3)(D), by inserting ‘‘in 11
4747 the case of a hospital other than a covered rural 12
4848 hospital (as defined in subsection (h)),’’ before 13
4949 ‘‘the hospital’’; and 14
5050 (2) in subsection (h), by adding at the end the 15
5151 following new paragraph: 16
5252 ‘‘(8) C
5353 OVERED RURAL HOSPITAL .—The term 17
5454 ‘covered rural hospital’ means a hospital that— 18
5555 ‘‘(A) is located in a rural area (as defined 19
5656 in section 1886(d)(2)(D)); and 20
5757 ‘‘(B) as of the date that such hospital en-21
5858 rolls under this title, is located more than a 35- 22
5959 mile drive (or, in the case of mountainous ter-23
6060 rain or in areas with only secondary roads 24
6161 available, a 15-mile drive) from a hospital or a 25
6262 critical access hospital.’’. 26
