24	24	To amend title XVIII of the Social Security Act to revise
25	25	certain physician self-referral exemptions relating to phy-
26	26	sician-owned hospitals.
27	27	Be it enacted by the Senate and House of Representa-1
28	28	tives of the United States of America in Congress assembled, 2
29	29	SECTION 1. SHORT TITLE. 3
30	30	This Act may be cited as the ‘‘Physician Led and 4
31	31	Rural Access to Quality Care Act’’. 5

38	38	(a) I
39	39	NGENERAL.—Section 1877 of the Social Secu-4
40	40	rity Act (42 U.S.C. 1395nn) is amended— 5
41	41	(1) in subsection (d)— 6
42	42	(A) in paragraph (2)(C), by inserting 7
43	43	‘‘(other than a covered rural hospital (as de-8
44	44	fined in subsection (h)))’’ after ‘‘a hospital’’; 9
45	45	and 10
46	46	(B) in paragraph (3)(D), by inserting ‘‘in 11
47	47	the case of a hospital other than a covered rural 12
48	48	hospital (as defined in subsection (h)),’’ before 13
49	49	‘‘the hospital’’; and 14
50	50	(2) in subsection (h), by adding at the end the 15
51	51	following new paragraph: 16
52	52	‘‘(8) C
53	53	OVERED RURAL HOSPITAL .—The term 17
54	54	‘covered rural hospital’ means a hospital that— 18
55	55	‘‘(A) is located in a rural area (as defined 19
56	56	in section 1886(d)(2)(D)); and 20
57	57	‘‘(B) as of the date that such hospital en-21
58	58	rolls under this title, is located more than a 35- 22
59	59	mile drive (or, in the case of mountainous ter-23
60	60	rain or in areas with only secondary roads 24
61	61	available, a 15-mile drive) from a hospital or a 25
62	62	critical access hospital.’’. 26

67	67	CIAN-OWNEDHOSPITALS.—Section 1877(i) of the Social 2
68	68	Security Act (42 U.S.C. 1395nn(i)) is amended— 3
69	69	(1) in paragraph (1)(B), by striking ‘‘in para-4
70	70	graph (3)’’ and inserting ‘‘in paragraph (3) or (7)’’; 5
71	71	and 6
72	72	(2) by adding at the end the following new 7
73	73	paragraph: 8
74	74	‘‘(7) S
75	75	UNSET OF EXPANSION PROHIBITION .— 9
76	76	The requirement described in paragraph (1)(B) shall 10
77	77	not apply beginning on the date of the enactment of 11
78	78	this paragraph.’’. 12
