A BILL
To prevent 340B covered entities from using savings derived
for sex reassignment surgeries, hormonal therapies, and
for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘No 340B Savings for 4
Transgender Care Act’’. 5

ROHIBITION ONUSE OF340B SAVINGS FOR 4

ERVICESDESCRIBED.—Section 340B(a)(4) of the Public 5
Health Service Act (42 U.S.C. 256b(a)(5)) is amended by 6
adding at the end the following: 7
‘‘(E) P
ROHIBITION ON USE OF 340B SAV -8
INGS FOR SERVICES DESCRIBED .—A covered 9
entity participating in the program under this 10
section may not use any funds derived from the 11
difference between the 340B ceiling price and 12
the actual acquisition cost of covered outpatient 13
drugs to pay for services described. 14
‘‘(i) D
EFINITIONS.—For purposes of 15
this subsection— 16
‘‘(I) C
OVERED ENTITY .—The 17
term ‘covered entities’ has the mean-18
ing given such term in section 19
340B(a)(4). 20
‘‘(II) S
ERVICES DESCRIBED .— 21
The term ‘services described’ means— 22
‘‘(aa) sex reassignment sur-23
geries furnished for the purpose 24
of the gender alteration of a 25
transgender individual; and 26
