2929 NGENERAL.—Chapter 155 of title 28, United 3
3030 States Code, is amended by adding at the end the fol-4
3131 lowing: 5
3232 ‘‘§ 2285. Appeal of order granting a nationwide in-6
3333 junction 7
3434 ‘‘(a) I
3535 NGENERAL.—In the case that a district court 8
3636 of the United States grants a nationwide injunction, the 9
3737 appeal from the order granting such injunction shall lie 10
3838 to the Supreme Court. 11
3939 ‘‘(b) D
4040 EFINITION.—In this section, the term ‘nation-12
4141 wide injunction’ means an order issued by a Federal court 13
4242 that purports to restrain the enforcement of a Federal 14
4343 statute, regulation, order, or similar authority against a 15
4444 non-party, unless the non-party is represented by a party 16
4545 acting in a representative capacity pursuant to the Federal 17
4646 Rules of Civil Procedure.’’. 18

4848 LERICALAMENDMENT.—The table of sections 19
4949 for chapter 155 of title 28, United States Code is amended 20
5050 by inserting after the item relating to section 2285 the 21
5151 following: 22
