Be it enacted by the Senate and House of Representa-1 tives of the United States of America in Congress assembled, 2 SECTION 1. SHORT TITLE. 3 This Act may be cited as the ‘‘Combating Racist 4 Teaching in Schools Act’’ or the ‘‘CRT Act’’. 5 SEC. 2. PROHIBITION ON AWARD OF FEDERAL FUNDS TO 6 CERTAIN SCHOOLS. 7 (a) P ROHIBITION ONAWARD OFFUNDS TOCERTAIN 8 E LEMENTARY AND SECONDARYSCHOOLS.—No Federal 9 funds received by a State or local educational agency may 10 VerDate Sep 11 2014 23:31 Apr 04, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2276.IH H2276 ssavage on LAPJG3WLY3PROD with BILLS 2 •HR 2276 IH be allocated to an elementary or secondary school that pro-1 motes the race-based theories described in subsection (c) 2 or compels teachers or students to affirm, adhere to, 3 adopt, or process beliefs in a manner that violates title 4 VI of the Civil Rights Act of 1964. 5 (b) P ROHIBITION ONAWARD OFFUNDS TOCERTAIN 6 I NSTITUTIONS OF HIGHEREDUCATION.—No Federal 7 funds may be awarded to an institution of higher edu-8 cation if such institution promotes the race-based theories 9 described in subsection (c) or compels teachers or students 10 to affirm, adhere to, adopt, or process beliefs in a manner 11 that violates title VI of the Civil Rights Act of 1964. 12 (c) R ACE-BASEDTHEORIESDESCRIBED.—The race- 13 based theories described in this subsection are the fol-14 lowing: 15 (1) Any race is inherently superior or inferior 16 to any other race, color, or national origin. 17 (2) The United States is a fundamentally racist 18 country. 19 (3) The Declaration of Independence or Con-20 stitution of the United States are fundamentally rac-21 ist documents. 22 (4) An individual’s moral character or worth is 23 determined by the individual’s race, color, or na-24 tional origin. 25 VerDate Sep 11 2014 23:31 Apr 04, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2276.IH H2276 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 2276 IH (5) An individual, by virtue of the individual’s 1 race, is inherently racist or oppressive, whether con-2 sciously or unconsciously. 3 (6) An individual, because of the individual’s 4 race, bears responsibility for the actions committed 5 by other members of the individual’s race, color, or 6 national origin. 7 (d) R ULES OFCONSTRUCTION.— 8 (1) P ROTECTED SPEECH NOT RESTRICTED .— 9 Nothing in this section shall be construed to restrict 10 the speech of a student, teacher, or any other indi-11 vidual outside of a school setting. 12 (2) A CCESS TO MATERIALS FOR THE PURPOSE 13 OF RESEARCH OR INDEPENDENT STUDY .—Nothing 14 in this section shall be construed to prevent an indi-15 vidual from accessing materials that advocate theo-16 ries described in subsection (c) for the purpose of re-17 search or independent study. 18 (3) C ONTEXTUAL EDUCATION .—Nothing in this 19 section shall be construed to prevent a covered 20 school from stating theories described in subsection 21 (c) or assigning materials that advocate such theo-22 ries for educational purposes in contexts that make 23 it clear the school does not sponsor, approve, or en-24 dorse such theories or materials. 25 VerDate Sep 11 2014 23:31 Apr 04, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2276.IH H2276 ssavage on LAPJG3WLY3PROD with BILLS 4 •HR 2276 IH (e) DEFINITIONS.—In this section: 1 (1) C OVERED SCHOOL .—The term ‘‘covered 2 school’’ means an elementary school, a secondary 3 school, or an institution of higher education. 4 (2) ESEA TERMS.—The terms ‘‘elementary 5 school’’, ‘‘local educational agency’’, ‘‘secondary 6 school’’, and ‘‘State’’ have the meanings given those 7 terms in section 8101 of the Elementary and Sec-8 ondary Education Act of 1965 (20 U.S.C. 7801). 9 (3) I NSTITUTION OF HIGHER EDUCATION .—The 10 term ‘‘institution of higher education’’ has the 11 meaning given that term in section 102 of the High-12 er Education Act of 1965 (20 U.S.C. 1002). 13 (4) P ROMOTE.—The term ‘‘promote’’, when 14 used with respect to a race-based theory described in 15 subsection (c), means— 16 (A) to include such theories or materials 17 that advocate such theories in curricula, read-18 ing lists, seminars, workshops, trainings, or 19 other educational or professional settings in a 20 manner that could reasonably give rise to the 21 appearance of official sponsorship, approval, or 22 endorsement; 23 (B) to contract with, hire, or otherwise en-24 gage speakers, consultants, diversity trainers, 25 VerDate Sep 11 2014 23:31 Apr 04, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2276.IH H2276 ssavage on LAPJG3WLY3PROD with BILLS 5 •HR 2276 IH and other persons for the purpose of advocating 1 such theories; 2 (C) to compel students to profess a belief 3 in such theories; or 4 (D) to segregate students or other individ-5 uals by race in any setting, including in edu-6 cational or training sessions. 7 Æ VerDate Sep 11 2014 23:31 Apr 04, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6301 E:\BILLS\H2276.IH H2276 ssavage on LAPJG3WLY3PROD with BILLS
