244244 the candidate meets Office of Personnel Manage-9
245245 ment qualification standards.’’; 10

306306 tions of their approved budgets, the operators of Job 8
307307 Corps campuses shall have the authority, without prior ap-9
308308 proval from the Secretary, to— 10
309309 ‘‘(1) hire staff and invest in staff professional 11
310310 development; 12
311311 ‘‘(2) enter into agreements with local partners, 13
312312 such as secondary and postsecondary schools or em-14
313313 ployers; and 15
314314 ‘‘(3) engage with and educate stakeholders 16
315315 about Job Corps operations and activities.’’. 17

334334 standards of conduct, positive behavioral interven-6
335335 tions and supports, and multi-tier systems of sup-7
336336 ports. 8

339339 TESTING.— 10
340340 ‘‘(A) D
341341 ISCIPLINARY MEASURES .—To pro-11
342342 mote the proper behavioral standards in the 12
343343 Job Corps, the director of each Job Corps cam-13
344344 pus shall, consistent with the applicable behav-14
345345 ioral management plan described in paragraph 15
346346 (1), have the authority to take appropriate dis-16
347347 ciplinary measures against enrollees if such di-17
348348 rector determines that an enrollee has com-18
349349 mitted a violation of the standards of conduct. 19
350350 The director shall adopt a policy of dismissing 20
351351 enrollees for an act of violence that seriously 21
352352 endangers the safety of students, staff, or the 22
353353 local community, and for illegal activity on the 23
354354 campus. 24

366366 ERO TOLERANCE POLICY .—The 6
367367 term ‘zero tolerance policy’ means a policy 7
368368 under which an enrollee shall be automati-8
369369 cally dismissed from the Job Corps after a 9
370370 determination by the director that the en-10
371371 rollee has carried out an act of violence 11
372372 that seriously endangers the safety of stu-12
373373 dents, staff, or the local community or en-13
374374 gaged in an illegal activity on the campus. 14
375375 ‘‘(3) A
376376 DVISORY GROUP.—The Secretary shall 15
377377 periodically convene an advisory group of Job Corps 16
378378 operators and service providers and subject matter 17
379379 experts to review the reporting data collected under 18
380380 paragraph (5) and provide recommendations for Job 19
381381 Corps behavioral management plans based on evi-20
382382 dence-based research regarding effective and equi-21
383383 table behavioral policies. 22
384384 ‘‘(4) L
385385 AW ENFORCEMENT AGREEMENTS .—The 23
386386 directors of each Job Corps campus shall enter into 24
387387 an agreement with the relevant local law enforce-25

395395 NCIDENT REPORTING .—The Secretary 4
396396 shall establish procedures for— 5
397397 ‘‘(A) reporting significant health incidents, 6
398398 including substance abuse, self-harm, and acci-7
399399 dents resulting in bodily harm; and 8
400400 ‘‘(B) reporting significant behavioral inci-9
401401 dents, defined as acts of violence or illegal ac-10
402402 tivity. 11
403403 ‘‘(6) A
404404 CCOUNTABILITY.—The Secretary shall 12
405405 establish standards under which a Job Corps cam-13
406406 pus shall be required to take performance improve-14
407407 ment actions described in section 159(f), based on 15
408408 an evaluation of such Job Corps campus, which shall 16
409409 take into account reporting data collected under 17
410410 paragraph (5) and recommendations of the advisory 18
411411 group pursuant to paragraph (3).’’. 19

414414 SISTANCE.—Section 156(a) of the Workforce Innovation 21
415415 and Opportunity Act (29 U.S.C. 3206(a)) is amended to 22

427427 finds would prevent the Secretary from carrying out the 5
428428 projects (other than sections 145, 147, and 159(c)) pro-6
429429 vided that— 7
430430 ‘‘(1) the project will not result in a reduction in 8
431431 the number of students served; and 9
432432 ‘‘(2) if the Secretary informs the Committee on 10
433433 Education and Labor of the House of Representa-11
434434 tives and the Committee on Health, Education, 12
435435 Labor, and Pensions of the Senate, in writing, not 13
436436 less than 90 days in advance of issuing such waiv-14
437437 er.’’. 15
