5656 tion from all hazards, including natural disasters, acts of 8
5757 terrorism, and other man-made disasters, by leading and 9

125125 T. Stafford Disaster Relief and Emergency Assistance Act 18

143143 gating, responding to, and recovering from any haz-7
144144 ard; 8
145145 (3) response, by conducting emergency oper-9
146146 ations to save lives and property through positioning 10
147147 emergency equipment, personnel, and supplies, 11
148148 through evacuating potential victims, through pro-12
149149 viding food, water, shelter, and medical care to those 13
150150 in need, and through restoring critical public serv-14
151151 ices; and 15
152152 (4) recovery, by rebuilding communities so indi-16
153153 viduals, businesses, and governments can function 17
154154 on their own, return to normal life, and protect 18
155155 against future hazards. 19

157157 ESPONSEDUTIES.—In carrying out subsection 20
158158 (c)(3), the Director, at a minimum, shall— 21
159159 (1) help to ensure the effectiveness of emer-22
160160 gency response providers in responding to a hazard; 23
161161 (2) coordinate and provide the Federal Govern-24
162162 ment’s response to hazards; 25

172172 plan to be known as the National Response Plan; 7
173173 (5) administer and ensure the implementation 8
174174 of the National Response Plan, including coordi-9
175175 nating and ensuring the readiness of each emergency 10
176176 support function under the National Response Plan; 11
177177 and 12
178178 (6) help ensure the acquisition of operable and 13
179179 interoperable communications capabilities by Fed-14
180180 eral, State, local, and tribal governments and emer-15
181181 gency response providers. 16

183183 ONTINUITY OF GOVERNMENT.—The Director 17
184184 shall prepare and implement the plans and programs of 18
185185 the Federal Government for— 19
186186 (1) continuity of operations; 20
187187 (2) continuity of Government; and 21
188188 (3) continuity of plans. 22

190190 THERDUTIES.—The Director shall— 23
191191 (1) coordinate the National Advisory Council; 24

196196 National Response Coordination Center (or its suc-2
197197 cessor); 3
198198 (3) develop and maintain a national emergency 4
199199 management system that is capable of preparing for, 5
200200 responding to, recovering from, and mitigating haz-6
201201 ards of all magnitudes, including catastrophic disas-7
202202 ters; and 8
203203 (4) supervise grant programs administered by 9
204204 the Agency. 10
205205 (g) A
206206 LL-HAZARDSAPPROACH.—In carrying out the 11
207207 responsibilities under this section, the Director shall co-12
208208 ordinate the implementation of an all-hazards strategy 13
209209 that builds those common capabilities necessary to prepare 14
210210 for, respond to, recover from, and mitigate hazards. 15
211211 SEC. 5. OFFICE OF THE INSPECTOR GENERAL. 16
212212 The Agency shall have an Office of the Inspector 17
213213 General, headed by an Inspector General, in accordance 18
214214 with chapter 4 of title 5, United States Code (commonly 19
215215 known as the ‘‘Inspector General Act of 1978’’). 20
216216 SEC. 6. TRANSFER OF FUNCTIONS. 21
217217 (a) I
218218 NGENERAL.—There shall be transferred to the 22
219219 Director all functions of the Federal Emergency Manage-23
220220 ment Agency, as such Agency was constituted on the day 24
221221 before the date of enactment of this Act. 25

225225 (b) INSPECTORGENERAL.—There shall be trans-1
226226 ferred to the Inspector General all functions relating to 2
227227 the Inspector General that were transferred from the Fed-3
228228 eral Emergency Management Agency to the Department 4
229229 of Homeland Security on or after January 1, 2003. 5
230230 (c) T
231231 RANSITIONPERIOD.—The transfers under this 6
232232 section shall be carried out not later than 365 days fol-7
233233 lowing the date of enactment of this Act. During the tran-8
234234 sition period, the Secretary of Homeland Security shall 9
235235 provide to the Director such assistance, including the use 10
236236 of personnel and assets, as the Director may request in 11
237237 preparing for the transfer. 12
238238 SEC. 7. PERSONNEL AND OTHER TRANSFERS. 13
239239 (a) P
240240 ERSONNELAPPOINTMENTS.—The Director may 14
241241 appoint and fix the compensation of such officers and em-15
242242 ployees as may be necessary to carry out the respective 16
243243 functions transferred by section 6. 17
244244 (b) T
245245 RANSFER AND ALLOCATIONS OF APPROPRIA-18
246246 TIONS ANDPERSONNEL.—Except as otherwise provided 19
247247 in this Act, the personnel employed in connection with, 20
248248 and the assets, liabilities, contracts, property, records, and 21
249249 unexpended balances of appropriations, authorizations, al-22
250250 locations, and other funds employed, used, held, arising 23
251251 from, available to, or to be made available in connection 24
252252 with the functions transferred by section 6, subject to sec-25

257257 ferred to the Agency. Unexpended funds transferred pur-2
258258 suant to this subsection shall be used only for the purposes 3
259259 for which the funds were originally authorized and appro-4
260260 priated. 5
261261 (c) I
262262 NCIDENTALTRANSFERS.—The Director of the 6
263263 Office of Management and Budget, in consultation with 7
264264 the Director of the Federal Emergency Management 8
265265 Agency, may make such determinations as may be nec-9
266266 essary with regard to the functions transferred by section 10
267267 6, and may make such additional incidental dispositions 11
268268 of personnel, assets, liabilities, grants, contracts, property, 12
269269 records, and unexpended balances of appropriations, au-13
270270 thorizations, allocations, and other funds held, used, aris-14
271271 ing from, available to, or to be made available in connec-15
272272 tion with such functions, as may be necessary to carry out 16
273273 the provisions of this Act. The Director of the Office of 17
274274 Management and Budget shall provide for the termination 18
275275 of the affairs of all entities terminated by this Act and 19
276276 for such further measures and dispositions as may be nec-20
277277 essary to effectuate the purposes of this Act. 21
278278 (d) E
279279 FFECT ONPERSONNEL.— 22
280280 (1) I
281281 N GENERAL.—Except as otherwise pro-23
282282 vided by this Act, the transfer pursuant to this Act 24
283283 of full-time personnel (except special Government 25

288288 nent positions shall not cause any such employee to 2
289289 be separated or reduced in grade or compensation 3
290290 for 1 year after the date of transfer of such em-4
291291 ployee under this Act. 5

293293 XECUTIVE SCHEDULE POSITIONS .—Except 6
294294 as otherwise provided in this Act, any person who, 7
295295 on the day preceding the date of the transfers of 8
296296 functions by section 6, held a position compensated 9
297297 in accordance with the Executive Schedule pre-10
298298 scribed in chapter 53 of title 5, United States Code, 11
299299 and who, without a break in service, is appointed in 12
300300 the Agency to a position having duties comparable to 13
301301 the duties performed immediately preceding such ap-14
302302 pointment shall continue to be compensated in such 15
303303 new position at not less than the rate provided for 16
304304 such previous position, for the duration of the serv-17
305305 ice of such person in such new position. 18
306306 SEC. 8. SAVINGS PROVISIONS. 19

324324 scribed in this paragraph are all orders, determina-6
325325 tions, rules, regulations, permits, agreements, 7
326326 grants, contracts, certificates, licenses, registrations, 8
327327 privileges, and other administrative actions that 9
328328 both— 10
329329 (A) have been issued, made, granted, or al-11
330330 lowed to become effective by the President, any 12
331331 Federal agency or official thereof, or by a court 13
332332 of competent jurisdiction, in the performance of 14
333333 functions that are transferred by section 6; and 15
334334 (B) are in effect on the date of the trans-16
335335 fers of functions by section 6, or were final be-17
336336 fore such date and are to become effective on 18
337337 or after such date. 19

339339 ROCEEDINGSNOTAFFECTED.—The provisions 20
340340 of this Act shall not affect any proceedings, including no-21
341341 tices of proposed rulemaking, or any application for any 22
342342 license, permit, certificate, or financial assistance pending 23
343343 before the Agency on the date of the transfers of functions 24
344344 by section 6, with respect to functions transferred by sec-25

349349 tinue. Orders shall be issued in such proceedings, appeals 2
350350 shall be taken therefrom, and payments shall be made pur-3
351351 suant to such orders, as if this Act had not been enacted, 4
352352 and orders issued in any such proceedings shall continue 5
353353 in effect until modified, terminated, superseded, or re-6
354354 voked by a duly authorized official, by a court of com-7
355355 petent jurisdiction, or by operation of law. Nothing in this 8
356356 paragraph shall be considered to prohibit the discontinu-9
357357 ance or modification of any such proceeding under the 10
358358 same terms and conditions and to the same extent that 11
359359 such proceeding could have been discontinued or modified 12
360360 if this Act had not been enacted. 13

362362 AUSES OFACTIONNOTAFFECTED.—The provi-14
363363 sions of this Act shall not affect any cause of action com-15
364364 menced before the date of the transfers of functions by 16
365365 section 6, and in all such causes of action, proceedings 17
366366 shall be had, appeals taken, and judgments rendered in 18
367367 the same manner and with the same effect as if this Act 19
368368 had not been enacted. 20

370370 ONABATEMENT OF CAUSES OFACTION.—No 21
371371 cause of action commenced by or against the Agency, or 22
372372 by or against any individual in the official capacity of such 23
373373 individual as an officer of the Agency, shall abate by rea-24
374374 son of the enactment of this Act. 25

382382 section 6 may be continued by the Agency with the same 5
383383 effect as if this Act had not been enacted. 6

387387 Federal Emergency Management Agency in any law, Ex-9
388388 ecutive order, rule, regulation, certificate, directive, in-10
389389 struction, delegation of authority, or other official paper 11
390390 shall be considered to refer and apply to the Agency estab-12
391391 lished by section 2. 13
