2121 This Act may be cited as the ‘‘Dietary Guidelines Re-4
2222 form Act of 2025’’. 5
2323 SEC. 2. ESTABLISHMENT OF DIETARY GUIDELINES. 6
2424 (a) I
2525 NGENERAL.—Section 301(a) of the National 7
2626 Nutrition Monitoring and Related Research Act of 1990 8
2727 (7 U.S.C. 5341(a)) is amended— 9

9494 based on continuous review of the totality of 7
9595 publicly available scientific evidence. 8

9797 OTIFICATION OF UPDATE.— 9
9898 ‘‘(A) I
9999 N GENERAL.—Not later than 90 10
100100 days before the Secretaries plan to update a re-11
101101 port under paragraph (1), the Secretaries shall 12
102102 submit notification of that plan, in writing, to 13
103103 the Committees on Agriculture, Nutrition, and 14
104104 Forestry and Health, Education, Labor, and 15
105105 Pensions of the Senate and the Committees on 16
106106 Agriculture and Energy and Commerce of the 17
107107 House of Representatives. 18
108108 ‘‘(B) J
109109 USTIFICATION.—The notification 19
110110 under subparagraph (A) shall include a jus-20
111111 tification for updating the report. 21

113113 NDEPENDENT ADVISORY BOARD .— 22

116116 days after the Secretaries submit a notification 24
117117 under paragraph (4)(A), the Secretaries shall 25

125125 prise not more than 8 members, of which— 4
126126 ‘‘(i) 4 shall be appointed by the Secre-5
127127 taries, 2 of whom shall not be Federal em-6
128128 ployees; and 7
129129 ‘‘(ii) 1 shall be appointed by each of 8
130130 the highest-ranking Member on each Com-9
131131 mittee described in paragraph (4)(A) of 10
132132 the opposite political party of the President 11
133133 of the United States. 12

135135 XPERTISE.—Each member ap-13
136136 pointed to the Board shall have expertise in nu-14
137137 trition science or food science, including aca-15
138138 demic and applied experience. 16

143143 of the Board shall take place on or after 19

157157 the establishment of the Board, the Board shall 2
158158 submit to the Secretaries and the Committees 3
159159 described in paragraph (4)(A) a list of scientific 4
160160 questions based on the proposed report under 5
161161 paragraph (1), which questions shall be used to 6
162162 inform the work of the Secretaries on that re-7
163163 port and any relevant work of the Committees 8
164164 described in paragraph (4)(A). 9

166166 ERMINATION.—The authority of the 10
167167 Board shall terminate, and the Board shall dis-11
168168 band, immediately after carrying out subpara-12
169169 graph (E). 13

171171 IETARY REFERENCE INTAKE UPDATES .— 14

173173 N GENERAL.—The Secretaries shall 15
174174 coordinate with the Joint United States-Canada 16
175175 Dietary Reference Intake Working Group to en-17
176176 sure that the Food and Nutrition Board of the 18
177177 National Academies of Sciences, Engineering, 19
178178 and Medicine update the dietary reference in-20
179179 take values to represent the most up-to-date 21
180180 understanding of nutritional science. 22
181181 ‘‘(B) U
182182 PDATES.—The Joint United States- 23
183183 Canada Dietary Reference Intake Working 24
184184 Group is encouraged— 25

193193 XCLUSION.—The information and guide-5
194194 lines contained in each report required under para-6
195195 graph (1) shall not be based on or include topics 7
196196 that are not relevant to dietary guidance, as deter-8
197197 mined by the Secretaries, in consultation with the 9
198198 Independent Advisory Board established under para-10
199199 graph (5), including taxation, social welfare policies, 11
200200 purchases under Federal feeding programs, food and 12
201201 agricultural production practices, food labeling, so-13
202202 cioeconomic status, race, religion, ethnicity, culture, 14
203203 or regulations relating to nutrition.’’; and 15
204204 (6) by adding at the end the following: 16
205205 ‘‘(9) E
206206 VIDENCE-BASED REVIEW.— 17
207207 ‘‘(A) D
208208 EFINITION OF EVIDENCE -BASED 18
209209 REVIEW.—In this paragraph, the term ‘evi-19
210210 dence-based review’ means a process under 20
211211 which— 21
212212 ‘‘(i) the totality of the scientific evi-22
213213 dence relevant to a question of interest is 23
214214 collected, analyzed, and evaluated; 24

219219 and recommendations are rated, adhering 2
220220 strictly to standardized, generally accepted 3
221221 evidence-based review methods; and 4
222222 ‘‘(iii) external peer review is con-5
223223 ducted by nongovernment experts with rec-6
224224 ognized expertise in quality-of-evidence 7
225225 evaluation. 8
226226 ‘‘(B) S
227227 TRENGTH OF EVIDENCE .—Each 9
228228 guideline contained in a report published under 10
229229 paragraph (1) shall be assigned a rating by the 11
230230 Secretaries for the strength of evidence used, 12
231231 including the extent to which the guideline will 13
232232 improve the Healthy Eating Index. 14
233233 ‘‘(10) T
234234 RANSPARENCY.— 15
235235 ‘‘(A) D
236236 ISCLOSURE.—Any individual ap-16
237237 pointed to the Dietary Guidelines Advisory 17
238238 Committee or an Independent Advisory Board 18
239239 established under paragraph (5) shall provide 19
240240 full disclosure of all financial and nonfinancial 20
241241 conflicts of interest relevant to their member-21
242242 ship using the Office of Government Ethics 22
243243 Form 450 (or successor form). 23
244244 ‘‘(B) P
245245 UBLICATION.—Notwithstanding any 24
246246 other provision of law, not later than 30 days 25

251251 Advisory Committee is established, the Secre-2
252252 taries shall make publicly available— 3
253253 ‘‘(i) the disclosures required under 4
254254 subparagraph (A), categorized by the name 5
255255 of the individual; and 6
256256 ‘‘(ii) a detailed plan for managing any 7
257257 disclosed conflicts of interest, including fi-8
258258 nancial or ethical conflicts of interest, pref-9
259259 erences, values, and beliefs. 10
260260 ‘‘(11) F
261261 UNDING.—Of the funds made available 11
262262 by section 32 of the Act of August 24, 1935 (7 12
263263 U.S.C. 612c), the Secretary of Agriculture shall 13
264264 make available to carry out this subsection 14
265265 $5,000,000 for each of fiscal years 2025 through 15
266266 2029, to remain available until expended.’’. 16

268268 ONTROLLING REPORT.—The 2020 Dietary 17
269269 Guidelines for Americans published by the Secretaries 18
270270 under section 301(a)(1) of the National Nutrition Moni-19
271271 toring and Related Research Act of 1990 (7 U.S.C. 20
272272 5341(a)(1)) (as in effect before the date of enactment of 21
273273 this Act) shall be considered the most recent Dietary 22
274274 Guidelines for Americans until the publication of the first 23
275275 report under that section (as amended by subsection (a)). 24
