2828 This Act may be cited as the ‘‘States Handling Ac-4
2929 cess to Reciprocity for Employment Act of 2025’’ or the 5
3030 ‘‘SHARE Act of 2025’’. 6

3636 Subtitle E of title VI of the Intelligence Reform and 3
3737 Terrorism Prevention Act of 2004 (34 U.S.C. 41106 et 4
3838 seq.) is amended by adding at the end the following: 5

4545 ECORDINFORMATION.—Subject to the restrictions in 10
4646 subsection (b), the Director of the Federal Bureau of In-11
4747 vestigation shall furnish or otherwise make available to a 12
4848 State licensing authority, through an agreement with a 13
4949 State law enforcement agency or State identification bu-14
5050 reau, criminal history record information to the extent re-15
5151 quired by an interstate compact, or the regulations duly 16
5252 promulgated thereunder, for the purpose of conducting a 17
5353 criminal history background check of any individual seek-18
5454 ing a license or privilege to practice an occupation or pro-19
5555 fession in a compact member State. 20

7171 part thereof with the compact’s Commission, any 5
7272 other State entity or State Licensing Authority, or 6

7575 HARING FACT OF COMPLETION OF CRIMI -8
7676 NAL HISTORY BACKGROUND CHECK EXPRESSLY PER -9
7777 MITTED.—A State licensing authority informing a 10
7878 compact Commission of the completion of the crimi-11
7979 nal history background check, including a binary de-12
8080 termination of whether or not the criminal history 13
8181 background check of an applicant was satisfactory, 14
8282 is expressly permitted under this section and shall 15
8383 not constitute the sharing of criminal history record 16
8484 information under paragraph (1). 17

8686 EFINITIONS.—In this section: 18
8787 ‘‘(1) C
8888 OMMISSION.—The term ‘Commission’ 19
8989 means a joint governmental entity, including an 20
9090 interstate compact commission, established by legis-21
9191 lative enactment of an interstate compact. 22

9494 TION.—The term ‘criminal history record informa-24
9595 tion’ means information collected by criminal justice 25

9999 agencies on individuals consisting of identifiable de-1
100100 scriptions and notations of arrests, detentions, in-2
101101 dictments, information, or other formal criminal 3
102102 charges, and any disposition arising therefrom, in-4
103103 cluding acquittal, sentencing, correctional super-5
104104 vision, and release. The term does not include identi-6
105105 fication information such as fingerprint records if 7
106106 such information does not indicate the individual’s 8
107107 involvement with the criminal justice system. 9
108108 ‘‘(3) L
109109 ICENSE.—The term ‘license’ means a li-10
110110 cense, multistate license, certification, or other au-11
111111 thorization by which a State licensing authority au-12
112112 thorizes an individual to practice an occupation or 13
113113 profession in that State. 14
114114 ‘‘(4) P
115115 RIVILEGE.—The term ‘privilege’ means a 15
116116 grant of authority issued pursuant to an interstate 16
117117 compact to a license holder that permits the license 17
118118 holder to practice in a compact member State. 18
119119 ‘‘(5) S
120120 TATE.—The term ‘State’ means any 19
121121 State, territory, or possession of the United States, 20
122122 and the District of Columbia. 21
123123 ‘‘(6) S
124124 TATE IDENTIFICATION BUREAU .—The 22
125125 term ‘State identification bureau’ has the meaning 23
126126 given such term in section 6402(c). 24
