25	25	Be it enacted by the Senate and House of Representa-1
26	26	tives of the United States of America in Congress assembled, 2
27	27	SECTION 1. SHORT TITLE. 3
28	28	This Act may be cited as the ‘‘States Handling Ac-4
29	29	cess to Reciprocity for Employment Act of 2025’’ or the 5
30	30	‘‘SHARE Act of 2025’’. 6

36	36	Subtitle E of title VI of the Intelligence Reform and 3
37	37	Terrorism Prevention Act of 2004 (34 U.S.C. 41106 et 4
38	38	seq.) is amended by adding at the end the following: 5
39	39	‘‘SEC. 6404. SHARING AND USE OF CRIMINAL HISTORY 6
40	40	RECORD INFORMATION. 7
41	41	‘‘(a) R
42	42	EQUIREMENT FOR FEDERALBUREAU OFIN-8
43	43	VESTIGATIONTOPROVIDECERTAINCRIMINALHISTORY 9

45	45	ECORDINFORMATION.—Subject to the restrictions in 10
46	46	subsection (b), the Director of the Federal Bureau of In-11
47	47	vestigation shall furnish or otherwise make available to a 12
48	48	State licensing authority, through an agreement with a 13
49	49	State law enforcement agency or State identification bu-14
50	50	reau, criminal history record information to the extent re-15
51	51	quired by an interstate compact, or the regulations duly 16
52	52	promulgated thereunder, for the purpose of conducting a 17
53	53	criminal history background check of any individual seek-18
54	54	ing a license or privilege to practice an occupation or pro-19
55	55	fession in a compact member State. 20

60	60	ROHIBITION.—A State licensing author-23
61	61	ity that is a member of an interstate compact that 24
62	62	requires completion of a criminal history background 25
63	63	check for an individual for the purpose of acting 26

67	67	upon a license or privilege of that individual to prac-1
68	68	tice an occupation or profession in a State shall use 2
69	69	such information solely for that purpose and may 3
70	70	not share criminal history record information or any 4
71	71	part thereof with the compact’s Commission, any 5
72	72	other State entity or State Licensing Authority, or 6
73	73	the public. 7
74	74	‘‘(2) S
75	75	HARING FACT OF COMPLETION OF CRIMI -8
76	76	NAL HISTORY BACKGROUND CHECK EXPRESSLY PER -9
77	77	MITTED.—A State licensing authority informing a 10
78	78	compact Commission of the completion of the crimi-11
79	79	nal history background check, including a binary de-12
80	80	termination of whether or not the criminal history 13
81	81	background check of an applicant was satisfactory, 14
82	82	is expressly permitted under this section and shall 15
83	83	not constitute the sharing of criminal history record 16
84	84	information under paragraph (1). 17
85	85	‘‘(c) D
86	86	EFINITIONS.—In this section: 18
87	87	‘‘(1) C
88	88	OMMISSION.—The term ‘Commission’ 19
89	89	means a joint governmental entity, including an 20
90	90	interstate compact commission, established by legis-21
91	91	lative enactment of an interstate compact. 22
92	92	‘‘(2) C
93	93	RIMINAL HISTORY RECORD INFORMA -23
94	94	TION.—The term ‘criminal history record informa-24
95	95	tion’ means information collected by criminal justice 25

99	99	agencies on individuals consisting of identifiable de-1
100	100	scriptions and notations of arrests, detentions, in-2
101	101	dictments, information, or other formal criminal 3
102	102	charges, and any disposition arising therefrom, in-4
103	103	cluding acquittal, sentencing, correctional super-5
104	104	vision, and release. The term does not include identi-6
105	105	fication information such as fingerprint records if 7
106	106	such information does not indicate the individual’s 8
107	107	involvement with the criminal justice system. 9
108	108	‘‘(3) L
109	109	ICENSE.—The term ‘license’ means a li-10
110	110	cense, multistate license, certification, or other au-11
111	111	thorization by which a State licensing authority au-12
112	112	thorizes an individual to practice an occupation or 13
113	113	profession in that State. 14
114	114	‘‘(4) P
115	115	RIVILEGE.—The term ‘privilege’ means a 15
116	116	grant of authority issued pursuant to an interstate 16
117	117	compact to a license holder that permits the license 17
118	118	holder to practice in a compact member State. 18
119	119	‘‘(5) S
120	120	TATE.—The term ‘State’ means any 19
121	121	State, territory, or possession of the United States, 20
122	122	and the District of Columbia. 21
123	123	‘‘(6) S
124	124	TATE IDENTIFICATION BUREAU .—The 22
125	125	term ‘State identification bureau’ has the meaning 23
126	126	given such term in section 6402(c). 24

130	130	‘‘(7) STATE LICENSING AUTHORITY .—The term 1
131	131	‘State licensing authority’ means a State licensing 2
132	132	board, agency, department, or other entity that is 3
133	133	empowered under the law of that State to grant a 4
134	134	license to practice an occupation or profession.’’. 5
