3434 (a) I
3535 NGENERAL.—Clause (v) of section 1860D– 5
3636 14(a)(3)(B) of the Social Security Act (42 U.S.C. 1395w– 6
3737 114(a)(3)(B)) is amended— 7
3838 (1) in subclause (I), by striking ‘‘and’’ at the 8
3939 end; 9
4040 (2) in subclause (II), by striking the period and 10
4141 inserting ‘‘; and’’; and 11
4242 (3) by inserting after subclause (II) the fol-12
4343 lowing new subclause: 13
4444 ‘‘(III) shall, notwithstanding the 14
4545 preceding clauses of this subpara-15
4646 graph, provide that any part D eligi-16
4747 ble individual not described in sub-17
4848 clause (I) or (II) who is enrolled, as 18
4949 of the day before the date on which 19
5050 such individual attains the age of 65, 20
5151 for medical assistance under a State 21
5252 plan under title XIX (or a waiver of 22
5353 such plan) pursuant to clause 23
5454 (i)(VIII) or (ii)(XX) of section 24
5555 1902(a)(10)(A), and who has income 25
5656 below 200 percent of the poverty line 26
