1818 This Act may be cited as the ‘‘Creating Resources 4
1919 for Every American To Experiment with Artificial Intel-5
2020 ligence Act of 2025’’ or the ‘‘CREATE AI Act of 2025’’. 6

3030 datasets necessary for artificial intelligence research 5
3131 and development is often limited to very large tech-6
3232 nology companies. 7
3333 (3) The lack of access to computational and 8
3434 data resources has resulted in insufficient diversity 9
3535 in the artificial intelligence research and develop-10
3636 ment community. 11
3737 (4) Engaging the full and diverse talent of the 12
3838 United States is critical for maintaining United 13
3939 States leadership in artificial intelligence and ensur-14
4040 ing that artificial intelligence is developed in a man-15
4141 ner that benefits all people of the United States. 16
4242 (5) The National Artificial Intelligence Re-17
4343 search Resource Task Force, authorized under sec-18
4444 tion 5106 of the National Artificial Intelligence Ini-19
4545 tiative Act of 2020 (15 U.S.C. 9401 et seq.), rec-20
4646 ommended the establishment of a National Artificial 21
4747 Intelligence Research Resource in a report entitled 22

9797 NAIRR Steering Subcommittee that the Director de-11

9999 ‘‘(A) have substantial expertise; 13

247247 STABLISHMENT.—Not later than one year 7
248248 after the date of the enactment of the Creating Resources 8
249249 for Every American To Experiment with Artificial Intel-9
250250 ligence Act of 2025, the Director of the National Science 10
251251 Foundation, in coordination with the NAIRR Steering 11
252252 Subcommittee, shall establish the National Artificial Intel-12
253253 ligence Research Resource to— 13
254254 ‘‘(1) spur innovation and advance the develop-14
255255 ment of artificial intelligence to stimulate cutting- 15
256256 edge research and propel the strategic development 16
257257 of artificial intelligence capabilities; 17
258258 ‘‘(2) improve access to artificial intelligence re-18
259259 sources for researchers and students of artificial in-19
260260 telligence; 20
261261 ‘‘(3) improve capacity for artificial intelligence 21
262262 research in the United States; and 22
263263 ‘‘(4) support the testing, benchmarking, and 23
264264 evaluation of artificial intelligence systems developed 24
265265 and deployed in the United States. 25

347347 ated services for users to access resources 20

367367 nual reports reviewing the performance of 12
368368 the NAIRR, the resources of the NAIRR, 13
369369 and the NAIRR governance structures; 14
370370 ‘‘(viii) establishing and administering 15
371371 training to new users on accessing a re-16
372372 source of the NAIRR, research design, and 17
373373 issues related to privacy, ethics, safety, and 18
374374 trustworthiness of artificial intelligence 19
375375 systems; 20
376376 ‘‘(ix) facilitating connections to AI 21
377377 testbeds; and 22
378378 ‘‘(x) making educational resources of 23
379379 the NAIRR available to other Federal 24
380380 agencies, and to Congress, for the purpose 25

386386 ‘‘(c) A
387387 DVISORYCOMMITTEES.—The head of the Pro-3
388388 gram Management Office, acting through the Director of 4
389389 the Operating Entity, shall establish Advisory Committees 5
390390 to provide advice to the Operating Entity and the Program 6
391391 Management Office. Any such Advisory Committees shall 7
392392 be comprised of members from government agencies, the 8
393393 private sector, academia, and public interest groups. 9
394394 Chapter 10 of title 5, United States Code, shall not apply 10
395395 to any such Advisory Committee. 11
396396 ‘‘SEC. 5603. RESOURCES OF THE NAIRR. 12
397397 ‘‘(a) I
398398 NGENERAL.—The head of the Program Man-13
399399 agement Office, acting through the Director of the Oper-14
400400 ating Entity and in coordination with the NAIRR Steering 15
401401 Subcommittee and any relevant Advisory Committee, 16
402402 shall— 17
403403 ‘‘(1) coordinate and provision resources of the 18
404404 NAIRR; 19
405405 ‘‘(2) establish processes to manage the procure-20
406406 ment of new resources of the NAIRR, and intake of 21
407407 in-kind contribution of resources of the NAIRR, 22
408408 from Federal agencies or other entities; 23

413413 of the NAIRR for concerns related to ethics and pri-2

415415 ‘‘(4) retire resources of the NAIRR no longer 4
416416 available or needed; and 5
417417 ‘‘(5) publicly report a summary of categories of 6
418418 available resources of the NAIRR, categories of 7
419419 sources of such resources of the NAIRR, and issues 8
420420 related to resources of the NAIRR. 9
421421 ‘‘(b) R
422422 ESOURCES OF THE NAIRR.—The NAIRR 10
423423 shall offer resources that include, at a minimum, all of 11
424424 the following, subject to the availability of appropriations: 12
425425 ‘‘(1) A mix of computational resources, includ-13
426426 ing— 14
427427 ‘‘(A) on-premises, cloud-based, hybrid, and 15
428428 emergent resources; 16
429429 ‘‘(B) public cloud providers providing ac-17
430430 cess to popular computational and storage serv-18
431431 ices for NAIRR users; 19
432432 ‘‘(C) an open source software environment 20
433433 for the NAIRR; 21
434434 ‘‘(D) an application programming interface 22
435435 providing structured access to artificial intel-23
436436 ligence models; and 24

443443 ‘‘(A)(i) in coordination with the National 4
444444 Institute of Standards and Technology and con-5
445445 sistent with the guidance of the National 6
446446 Science and Technology Council titled ‘Desir-7
447447 able Characteristics of Data Repositories for 8
448448 Federally Funded Data,’ dated May 2022, or 9
449449 any successor document, publishing interoper-10
450450 ability standards for data repositories based on 11
451451 the data sharing and documentation standards 12
452452 and guidelines produced under section 22A of 13
453453 the National Institute of Standards and Tech-14
454454 nology Act (15 U.S.C. 278h–1); and 15
455455 ‘‘(ii) selecting and developing, through a 16
456456 competitive bidding process, data repositories to 17
457457 be available to NAIRR users; 18
458458 ‘‘(B) establishing acceptable criteria for 19
459459 datasets used as resources of the NAIRR; 20
460460 ‘‘(C) identifying and providing access to 21
461461 existing curated datasets of value and interest 22
462462 to the NAIRR user community; 23

633633 in subparagraph (A) when ranking applications 17

712712 Operating Entity may only charge fees in such fee sched-9

714714 ‘‘(1) may differ by type of eligible user and type 11
715715 of affiliated entity described in subsection (a); 12
716716 ‘‘(2) shall include a free tier of access based on 13
717717 appropriated funds and anticipated costs and de-14
718718 mand; 15
719719 ‘‘(3) may include cost-based charges for eligible 16
720720 users to purchase resources of the NAIRR beyond 17
721721 the resources included in a free or subsidized tier; 18
722722 and 19
723723 ‘‘(4) shall ensure that the primary purpose of 20
724724 the NAIRR is to support research. 21
