16	16	Be it enacted by the Senate and House of Representa-1
17	17	tives of the United States of America in Congress assembled, 2
18	18	SECTION 1. SHORT TITLE. 3
19	19	This Act may be cited as the ‘‘Lower Elwha Klallam 4
20	20	Tribe Project Lands Restoration Act’’. 5
21	21	SEC. 2. LAND TAKEN INTO TRUST FOR THE LOWER ELWHA 6
22	22	KLALLAM TRIBE. 7

24	24	EFINITIONS.—In this section: 8
25	25	(1) R
26	26	ESERVATION.—The term ‘‘Reservation’’ 9
27	27	means the Lower Elwha Indian Reservation, also 10

34	34	ECRETARY.—The term ‘‘Secretary’’ means 3
35	35	the Secretary of the Interior. 4
36	36	(3) T
37	37	RIBE.—The term ‘‘Tribe’’ means the 5
38	38	Lower Elwha Tribal Community, also known as the 6
39	39	Lower Elwha Klallam Tribe, located in the State of 7
40	40	Washington. 8

42	42	ANDHELD INTRUST.— 9
43	43	(1) I
44	44	N GENERAL.—Subject to all valid existing 10
45	45	rights of the United States, the approximately 11
46	46	1,082.63 acres of Federal land generally depicted as 12
47	47	‘‘NPS Parcels to be Transferred to Tribe’’ on the 13
48	48	map entitled ‘‘Olympic National Park Proposed 14
49	49	Transfer of Elwha Lands’’, numbered 149/178020, 15
50	50	and dated December 2021 is hereby taken into and 16
51	51	held in trust by the United States for the benefit of 17
52	52	the Tribe. 18

54	54	NCLUSION IN RESERVATION .—The land 19
55	55	taken into trust under paragraph (1) shall be part 20
56	56	of the Reservation. 21

58	58	AW APPLICABLE TO CERTAIN LAND .—The 22
59	59	land taken into trust under paragraph (1) shall not 23
60	60	be subject to any requirements for valuation, ap-24
61	61	praisal, or equalization under any Federal law. 25

65	65	(c) LANDMANAGEMENT.—Of the land taken into 1
66	66	and held in trust under subsection (b)(1), the portion of 2
67	67	the Elwha River subject to section 3(c)(3) of the Elwha 3
68	68	River Ecosystem and Fisheries Restoration Act (Public 4
69	69	Law 102–495; 106 Stat. 3175) shall be managed in ac-5
70	70	cordance with subsection (b) of the first section of the 6
71	71	Wild and Scenic Rivers Act (16 U.S.C. 1271), except for 7
72	72	necessary modifications under section 3(c)(3) of the Elwha 8
73	73	River Ecosystem and Fisheries Restoration Act (Public 9
74	74	Law 102–495; 106 Stat. 3175). 10

76	76	AP ANDSURVEY.— 11

78	78	OUNDARY ADJUSTMENT ; SURVEY.—As 12
79	79	soon as practicable after the date of enactment of 13
80	80	this Act, the Secretary shall conduct a survey to de-14
81	81	fine the boundaries of the land taken into and held 15
82	82	in trust under subsection (b)(1). 16
83	83	(2) A
84	84	DJUSTMENTS.—The Secretary may— 17
85	85	(A) make minor boundary adjustments to 18
86	86	the land taken into and held in trust under sub-19
87	87	section (b)(1); and 20
88	88	(B) correct any minor errors in any map, 21
89	89	acreage estimate, or description of that land. 22

91	91	AMINGPROHIBITION.—No land taken into and 23
92	92	held in trust for the benefit of the Tribe under this section 24

96	96	shall be considered Indian lands for the purpose of the 1
97	97	Indian Gaming Regulatory Act (25 U.S.C. 2701 et seq.). 2
98	98	SEC. 3. NO IMPACT ON TREATY RIGHTS. 3
99	99	Nothing in this Act affects treaty rights under the 4
100	100	Treaty between the United States of America and the 5
101	101	S’Klallams Indians, concluded at Point no Point, Wash-6
102	102	ington Territory, January 26, 1855 (12 Stat. 933) (com-7
103	103	monly known as the ‘‘Treaty of Point No Point’’). 8
