4949 SECTION 1. SHORT TITLE. 3
5050 This Act may be cited as the ‘‘Stop Harassing Own-4
5151 ers of Rifles Today Act’’ or as the ‘‘SHORT Act’’. 5
5252 SEC. 2. DEFINITION OF FIREARM. 6
5353 (a) I
5454 NGENERAL.—Subsection (a) of section 5845 of 7
5555 the Internal Revenue Code of 1986 is amended to read 8
5656 as follows: 9
5757 ‘‘(a) F
5858 IREARM.— 10
5959 ‘‘(1) I
6060 N GENERAL .—The term ‘firearm’ 11
6161 means— 12
6262 ‘‘(A) a machinegun, 13
6363 ‘‘(B) any silencer (as defined in section 14
6464 921 of title 18, United States Code), and 15
6565 ‘‘(C) a destructive device. 16
6666 ‘‘(2) E
6767 XCEPTION.—The term ‘firearm’ shall not 17
6868 include an antique firearm or any device (other than 18
6969 a machinegun or destructive device) which, although 19
7070 designed as a weapon, the Secretary finds by reason 20
7171 of the date of its manufacture, value, design, and 21
7272 other characteristics is primarily a collector’s item 22
7373 and is not likely to be used as a weapon.’’. 23

8181 shell which the Secretary finds is generally recognized as 2
8282 particularly suitable for sporting purposes’’ and inserting 3
8383 ‘‘except shotgun shells and any weapon that is designed 4
8484 to shoot shotgun shells’’. 5

8686 ONFORMINGAMENDMENTS.—Section 5811(a) of 6
8787 the Internal Revenue Code of 1986 is amended by striking 7
8888 ‘‘, except, the transfer tax on any firearm classified as any 8
8989 other weapon under section 5845(e) shall be at the rate 9
9090 of $5 for each such firearm transferred’’. 10

9292 FFECTIVEDATE.—The amendment made by 11
9393 this section shall apply to calendar quarters beginning 12
9494 after the 90-day period that starts on the date of the en-13
9595 actment of this Act. 14

124124 ONSDETERMINED BY REFERENCE.—In the case of any 14
125125 registration or licensing requirement under State or local 15
126126 law with respect to a short-barreled rifle, short-barreled 16
127127 shotgun, or any other weapon (as defined in section 17
128128 5845(e)) which is determined by reference to the National 18
129129 Firearms Act, any person who acquires or possesses such 19
130130 rifle, shotgun, or other weapon in accordance with chapter 20
131131 44 of title 18, United States Code, shall be treated as 21
132132 meeting any such registration or licensing requirement 22
133133 with respect to such rifle, shotgun, or other weapon.’’. 23

140140 Section 927 of title 18, United States Code, is 4
141141 amended— 5
142142 (1) by striking ‘‘No provision’’ and inserting 6
143143 the following: 7
144144 ‘‘(a) I
145145 NGENERAL.—No provision.’’; and 8
146146 (2) by adding at the end the following: 9
147147 ‘‘(b) T
148148 AXES ON SHORT-BARRELEDRIFLES OR 10

150150 HORT-BARRELED SHOTGUNS.—Notwithstanding sub-11
151151 section (a), a law of a State or a political subdivision of 12
152152 a State that imposes a tax, other than a generally applica-13
153153 ble sales or use tax, on making, transferring, using, pos-14
154154 sessing, or transporting a short-barreled rifle or short-bar-15
155155 reled shotgun in or affecting interstate or foreign com-16
156156 merce, or imposes a marking, recordkeeping, or registra-17
157157 tion requirement with respect to such a rifle or shotgun, 18
158158 shall have no force or effect.’’. 19
159159 SEC. 6. DESTRUCTION OF RECORDS. 20
160160 (a) I
161161 NGENERAL.—Not later than 365 days after the 21
162162 date of the enactment of this Act, the Attorney General 22
163163 shall destroy— 23
164164 (1) any registration of an applicable weapon 24
165165 maintained in the National Firearms Registration 25

172172 tion 5812 of such Code that identifies the transferee 4
173173 of an applicable weapon, and 5
174174 (3) any application to make filed under section 6
175175 5822 of such Code that identifies the maker of an 7
176176 applicable weapon. 8

178178 PPLICABLEWEAPON.—For purposes of this sec-9
179179 tion, the term ‘‘applicable weapon’’ means— 10
180180 (1) a rifle, or weapon made from a rifle, de-11
181181 scribed in paragraph (3) or (4) of section 5845(a) 12
182182 of the Internal Revenue Code of 1986 (as in effect 13
183183 on the day before the enactment of this Act), 14
184184 (2) any shotgun— 15
185185 (A) described in paragraph (1) or (2) of 16
186186 section 5845(a) of the Internal Revenue Code 17
187187 of 1986 (as in effect on the day before the en-18
188188 actment of this Act), or 19
189189 (B) treated as destructive device under 20
190190 5845(f) of such Code (as in effect on the day 21
191191 before the enactment of this Act) and not so 22
192192 treated under such section as in effect imme-23
193193 diately after such date, and 24
