150150 minent threat to the health or safety of the victim 8
151151 or another person. 9
152152 ‘‘(3) To a victim advocate or healthcare pro-10
153153 vider, if required for the provision of victim services. 11
154154 ‘‘(4) To a State or Federal court, if pursuant 12
155155 to a court order or if disclosure is required by Fed-13
156156 eral or State statute. 14

159159 TION.—If information described in subsection (a) is dis-16
160160 closed under that subsection, the Secretary shall— 17

175175 phere, shall update the policies developed under sections 4
176176 3541 and 3542 with respect to the mechanism established 5
177177 under subsections (b)(3)(B) and (b)(5)(B) of those sec-6
178178 tions, respectively, such that each such mechanism pro-7
179179 vides for a restricted reporting system that allows an em-8
180180 ployee of the Administration, member of the commissioned 9
181181 officer corps of the Administration, or covered personnel 10
182182 who alleges to have been sexually harassed or sexually as-11
183183 saulted to confidentially disclose the details of such sexual 12
184184 harassment or sexual assault to specified individuals and 13
185185 receive the services outlined in this subtitle— 14
186186 ‘‘(1) without the dissemination of the personally 15
187187 identifying information of such individual, except as 16
188188 necessary for the provision of such services and as 17
189189 provided by section 3548(a); and 18
190190 ‘‘(2) without automatically triggering an inves-19
191191 tigative process. 20

206206 ‘‘(A) an employee or contractor of the Ad-5
207207 ministration who is required to hold a valid 6
208208 merchant mariner credential as a condition of 7
209209 employment; or 8
210210 ‘‘(B) a crewmember of a vessel that, at the 9
211211 time of such incident, was operating under a 10
212212 contract with the Administration. 11

214214 ESTRICTED REPORTS .—Paragraph (1) 12
215215 does not apply with respect to an incident of sexual 13
216216 harassment or sexual assault reported on a re-14
217217 stricted basis pursuant to the mechanisms estab-15
218218 lished for such reporting under sections 16
219219 3541(b)(3)(B) and 3542(b)(5)(B), respectively. 17

228228 responsible entity of a vessel is made aware of 23
229229 the incident of sexual harassment or sexual as-24
230230 sault that is the subject of the report. 25

236236 quired under subsection (a)(1) to a single entity 3
237237 in the Coast Guard designated by the Com-4
238238 mandant of the Coast Guard to receive such re-5
239239 ports by the fastest telecommunication channel 6
240240 available to the responsible entity of a vessel. 7

242242 ONTENTS OF REPORT .—Each report 8
243243 made under this section shall include, to the best of 9
244244 the knowledge of the responsible entity of a vessel— 10
245245 ‘‘(A) the name, Coast Guard merchant 11
246246 mariner credential reference number, if applica-12
247247 ble, official position or role in relation to the 13
248248 vessel, and contact information of each indi-14
249249 vidual involved in the incident of sexual harass-15
250250 ment or sexual assault that is the subject of the 16
251251 report; 17
252252 ‘‘(B) the name and official number of the 18
253253 vessel; 19
254254 ‘‘(C) the time and date of the incident of 20
255255 sexual harassment or sexual assault; 21
256256 ‘‘(D) the geographic position or location of 22
257257 the vessel when the incident of sexual harass-23
258258 ment or sexual assault occurred; and 24

281281 submitted pursuant to section 3541(b)(3)(B) or 17
