16	16	Program; Streamlining the Medicaid, Children’s Health
17	17	Insurance Program, and Basic Health Program Applica-
18	18	tion, Eligibility Determination, Enrollment, and Renewal
19	19	Processes’’, and for other purposes.
20	20	Be it enacted by the Senate and House of Representa-1
21	21	tives of the United States of America in Congress assembled, 2
22	22	SECTION 1. SHORT TITLE. 3
23	23	This Act may be cited as the ‘‘Ensuring Medicaid Eli-4
24	24	gibility Act of 2025’’. 5

30	30	The Secretary of Health and Human Services may 3
31	31	not implement, enforce, or otherwise give effect to the rule 4
32	32	entitled ‘‘Medicaid Program; Streamlining the Medicaid, 5
33	33	Children’s Health Insurance Program, and Basic Health 6
34	34	Program Application, Eligibility Determination, Enroll-7
35	35	ment, and Renewal Processes’’ (89 Fed. Reg. 22780) pub-8
36	36	lished on April 2, 2024. 9
37	37	SEC. 3. PROHIBITING ENROLLMENT IN THE MEDICAID PRO-10
38	38	GRAM PRIOR TO VERIFICATION OF CITIZEN-11
39	39	SHIP OR SATISFACTORY IMMIGRATION STA-12
40	40	TUS; ENSURING ELIGIBILITY. 13
41	41	Section 1902(a) of the Social Security Act (42 U.S.C. 14
42	42	1396a(a)) is amended— 15
43	43	(1) in paragraph (86), by striking ‘‘and’’ at the 16
44	44	end; 17
45	45	(2) in paragraph (87), by striking the period 18
46	46	and inserting a semicolon; and 19
47	47	(3) by inserting after paragraph (87) the fol-20
48	48	lowing new paragraphs: 21
49	49	‘‘(88) provide that no individual is enrolled 22
50	50	under such plan (or under a waiver of such plan) 23
51	51	prior to the date that such State verifies that such 24
52	52	individual is a citizen or national of the United 25

56	56	States or an individual in satisfactory immigration 1
57	57	status (as defined in section 1137(d)(1)); and 2
58	58	‘‘(89) provide that, in the case of an individual 3
59	59	enrolled under such plan (or under a waiver of such 4
60	60	plan) whose eligibility is based in part by reference 5
61	61	to the income of such individual (as determined 6
62	62	under subsection (e)(14)), the eligibility of such indi-7
63	63	vidual is verified not less frequently than quar-8
64	64	terly.’’. 9
65	65	SEC. 4. LIMITING MEDICAID COVERAGE OF PAROLEES AND 10
66	66	TPS AND DACA RECIPIENTS. 11
67	67	(a) I
68	68	NGENERAL.—Section 1903(v) of the Social Se-12
69	69	curity Act (42 U.S.C. 1396b(v)) is amended— 13
70	70	(1) in paragraph (2), in the matter preceding 14
71	71	subparagraph (A), by inserting ‘‘or (5)’’ after ‘‘para-15
72	72	graph (1)’’; and 16
73	73	(2) by adding at the end the following new 17
74	74	paragraph: 18
75	75	‘‘(5) Notwithstanding sections 401(a), 402(b), and 19
76	76	403 of the Personal Responsibility and Work Opportunity 20
77	77	Reconciliation Act of 1996 and any other provision of this 21
78	78	title, subject to paragraphs (2) and (4), no payment may 22
79	79	be made to a State under this section for medical assist-23
80	80	ance furnished to an alien who is— 24

84	84	‘‘(A) granted parole under section 212(d)(5) or 1
85	85	236(a)(2)(B) of the Immigration and Nationality 2
86	86	Act; 3
87	87	‘‘(B) granted deferred action or deferred en-4
88	88	forced departure, including pursuant to the memo-5
89	89	randum of the Department of Homeland Security 6
90	90	entitled ‘Exercising Prosecutorial Discretion with 7
91	91	Respect to Individuals Who Came to the United 8
92	92	States as Children’ issued on June 15, 2012; 9
93	93	‘‘(C) granted asylum under section 208 of such 10
94	94	Act; 11
95	95	‘‘(D) granted temporary protected status under 12
96	96	section 244 of such Act; or 13
97	97	‘‘(E) granted withholding of removal under sec-14
98	98	tion 241(b)(3) of such Act.’’. 15

100	100	ONFORMINGAMENDMENT.—Section 1902(a) is 16
101	101	amended, in matter at the end, in the last sentence, by 17
102	102	inserting ‘‘or an alien described in section 1903(v)(5)’’ 18
103	103	after ‘‘color of law’’. 19
