SHORT TITLE. 3 This Act may be cited as the ‘‘Mechanical Insulation 4 Installation Incentive Act of 2025’’. 5 SEC. 2. LABOR COSTS OF INSTALLING MECHANICAL 3 INSULATION PROPERTY. 4 ‘‘(a) I NGENERAL.—For purposes of section 38, the 5 mechanical insulation labor costs credit determined under 6 this section for any taxable year is an amount equal to 7 10 percent of the mechanical insulation labor costs paid 8 or incurred by the taxpayer during such taxable year. 9 ‘‘(b) M ECHANICALINSULATIONLABORCOSTS.—For 10 purposes of this section— 11 ‘‘(1) I N GENERAL.—The term ‘mechanical insu-12 lation labor costs’ means the labor cost of installing 13 mechanical insulation property (including property 14 assembled offsite) with respect to a mechanical sys-15 tem referred to in paragraph (2)(A) which was origi-16 nally placed in service not less than 1 year before 17 the date on which such mechanical insulation prop-18 erty is installed. 19 ‘‘(2) M ECHANICAL INSULATION PROPERTY .— 20 The term ‘mechanical insulation property’ means in-21 sulation materials, and facings and accessory prod-22 ucts installed in connection to such insulation mate-23 rials— 24 VerDate Sep 11 2014 20:49 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2463.IH H2463 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 2463 IH ‘‘(A) placed in service in connection with a 1 mechanical system which— 2 ‘‘(i) is located in the United States, 3 and 4 ‘‘(ii) is of a character subject to an al-5 lowance for depreciation, 6 ‘‘(B) in a manner that meets or complies 7 with the minimum requirements of Reference 8 Standard 90.1 (as defined in section 9 179D(c)(2)), and 10 ‘‘(C) the installation of which results in a 11 reduction in energy loss from such mechanical 12 system. 13 ‘‘(c) T ERMINATION.—This section shall not apply to 14 mechanical insulation labor costs paid or incurred after 15 December 31, 2028.’’. 16 (b) C REDITALLOWED ASPART OFGENERALBUSI-17 NESSCREDIT.—Section 38(b) of such Code is amended 18 by striking ‘‘plus’’ at the end of paragraph (40), by strik-19 ing the period at the end of paragraph (41) and inserting 20 ‘‘, plus’’, and by adding at the end the following new para-21 graph: 22 ‘‘(42) the mechanical insulation labor costs 23 credit determined under section 45BB(a).’’. 24 (c) C ONFORMINGAMENDMENTS.— 25 VerDate Sep 11 2014 20:49 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2463.IH H2463 ssavage on LAPJG3WLY3PROD with BILLS 4 •HR 2463 IH (1) Section 280C of such Code is amended by 1 adding at the end the following new subsection: 2 ‘‘(i) M ECHANICALINSULATIONLABORCOSTSCRED-3 IT.— 4 ‘‘(1) I N GENERAL.—No deduction shall be al-5 lowed for that portion of the mechanical insulation 6 labor costs (as defined in section 45BB(b)) other-7 wise allowable as deduction for the taxable year 8 which is equal to the amount of the credit deter-9 mined for such taxable year under section 45BB(a). 10 ‘‘(2) S IMILAR RULE WHERE TAXPAYER CAP -11 ITALIZES RATHER THAN DEDUCTS EXPENSES .—If— 12 ‘‘(A) the amount of the credit determined 13 for the taxable year under section 45BB(a), ex-14 ceeds 15 ‘‘(B) the amount of allowable as a deduc-16 tion for such taxable year for mechanical insu-17 lation labor costs (determined without regard to 18 paragraph (1)), 19 the amount chargeable to capital account for the 20 taxable year for such costs shall be reduced by the 21 amount of such excess.’’. 22 (2) The table of sections for subpart D of part 23 IV of subchapter A of chapter 1 of such Code is 24 VerDate Sep 11 2014 20:49 Apr 03, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2463.IH H2463 ssavage on LAPJG3WLY3PROD with BILLS 5 •HR 2463 IH amended by adding at the end the following new 1 item: 2 ‘‘Sec. 45BB.
